Dear Ms. Wolfe:
The Weld County Board of Commissioners is in receipt of your letter dated March 2, 2006, to Commissioner
Glenn Vaad that references your concerns about traffic, dust, and safety on WCR 38 % in the vicinity of your
residence. On behalf of the Board, I would like to thank you for taking the time to clearly articulate your
concerns to us.
First, let me assure you that you are not alone in your concerns. Weld County maintains over 2,500 miles of
gravel roadways and there are similar problems such as this in many areas of the County. Unfortunately, this
problem is only exacerbated during times such as this when we experienced one of the driest winters on record
and when the oil and gas construction activity has increased dramatically.
As you may be aware, the County does have a policy stating under what conditions dust control chemicals are
applied on gravel roads, and it requires that the traffic volume is 200 or more vehicles per day. The most recent
counts taken on WCR 38 % last year showed there were only approximately 50 vehicles per day.
However, since you indicated that the traffic has increased substantially, the Public Works Department will take
some additional traffic counts to see if the application of dust control chemicals is warranted as per the County's
policy. They will also examine WCR 38 % to see if a reduction in the speed limit is warranted as you suggest.
The Public Works Department will contact you directly when the results of the counts and analysis is complete.
Finally, the Department will make contact with A&W Water in the attempt to help remediate the problem. The
staff member that will be coordinating these efforts will be Mr. Perry Eisenach, Engineering Division Manager
with the Public Works Department, who can be reached at(970) 304-6496, Extension 3758.

I am not sure if I am in District 2 or District 3. When looking at the District map, it was very close
to one of these two. So, if I am not in District 2, would you please forward this on to Rob Madsen?
I have been prompted to write this letter after reading an article in the Greeley Tribune on February
9, 2006 regarding the situation on Weld County Road 17 where the neighbors complained about
traffic, noise and dust. Theirs is not the only situation that needs attention. I live on WCR 38 1/2
between Highways 85 and 60. There are five homes on this small stretch of road, that sit close to
the road. Up until the past few months, this area has been relativiely quiet and traffic free.
However, A&W water has opted to utilize this road continuously between their pick up and drop off
points. As of today, I have written A&W water three times, with documentation and pictures. I have
asked them to: 1. slow down; 2. to water down the road; and 3. when they can, to consider utilizing
other roads where there are fewer homes near the road, or to use the paved roads (i.e., WCR 42, 46
and Junction 256 - which are easily accessible). They acknowledged that they would do what they
could. For one week they were very accomodating - one week (this was in January). They may water
the road for dust, but, only occasionally. These A&W Water rigs, with the size and load, are still
driving too fast in the area, creating an unsafe situation, plus the poor visibility from all of the dust.
Another situation, was a truck carrying a refraction bin to a site off of Hwy 85 and CR 41. That
truck was going dangerously fast, in my opinion (this same situation occured on 2.28.06). I could
not believe they will drive in that manner with a load, or without a load. And of course, the faster
they go and the bigger they are, creates an enormous amount of dirt and dust.
There are elderly people living or visiting in this area, we have children visit us, we have pets. We like
to be outdoors on a nice day, we enjoy opening doors and windows to let fresh air in, maybe have a
bar-be-que, sit on the deck - anything outside. But given this situation, a person cannot be outside
due to the amount of traffic and dust they produce. Granted we cannot do anything about Mother
Nature and her wind. I do not want to be outdoors when it gets as windy as it does out here. I
know this is not the only area that is affected by the water trucks, oil companies, etc. Just look
across the horizon and see the amount of dirt in the air - it's terrible. There is enough pollution in
the air without these folks contributing to the situation. I understand they have a job to do and the
oil business has multiplied over the last few years. But I feel these people, like A&W Water, need to
respect the folks and their homes when working in these areas. I also feel that there should be
requirements in a situation as this.

I've enclosed some pictures for you to review and information from EPA. These pictures depict what it
is like out here when they make trip after trip after trip. It's like a tornado or earthquake. You can
hear it, feel the floor shake, the windows rattle, there's dust everywhere, and there it is! - a water
truck. It is awful. With them driving too fast, the dirt and dust, something's bound to happen.
When I am behind one of these rigs and there is a large amount of dust, I cannot see if someone is
pulling out of their drive way or if there is a vehicle coming in the other direction. It's blinding and it's
dangerous. And granted, there are the occasional vehicles other than A&W Water vehicles traveling
on this road - what I would call normal for a county road - but, THIS is not normal - it's just
dangerous.
And, as I understand, on a separate issue, there may be more traffic, dust, etc. if the plan for Merit
Energy's Hydrocarbon contamination site is approved. The site will be approximately 500 feet from
my home. This is of great concern to me.
I believe A&W Water has made minimal attempts to rectify the situation. I am asking for some
direction or help from Weld County. I believe this has become an unhealthy situation, as well as
environmentally unsafe. We had contacted Public Works and they put a counter on the road for a few
days, but that was before A&W Water trucks begain using this road continuously. So the count they
recorded did not justify putting any protection on the road. Should they opt to do another count, I
would suggest they put the counter closer to my home, due to the fact that the neighbor's trucking
business goes by my home (west to Highway 60) more often than going east towards Highway 85.
My thoughts and questions are: Is there a requirement, or can it be required, that companies put
protection on a road for situations as this? Can they be required to use the paved roads as often
as they can? Can magnesium chloride or calcium chloride be put down? Or, like County Road 38, west
of Hightway 60 - some sort of asphalt? Could a speed limit sign, please, in both directions of 25
mph or less, be put up?
I am very concerned about this situation. I would appreciate any help you can give me on this matter.
