Dear EnCana Oil & Gas ( USA ) Inc . :
It has been brought to the Department of Planning Services by the Weld County Environmental
Health Department that the above referenced facility is not in compliance with the existing Site
Specific Development Permit , AmUSR- 589 . This facility is permitted for a gas processing plant
only , any other activity , including the ongoing centralized E & P waste management facility
( petroleum contaminated soils landfarm ) without the appropriate local land use approval is not
permitted and is subject a hearing before the Board of County Commissioners for consideration
for the revocation of the existing permit .
Given this situation , the Department of Planning Services formally requests that the existing
permit be modified to include this use and all other uses presently occurring on site . This office
will afford Encana forty-five (45 ) days to obtain and submit a complete USR land use
application , including the payment of applicable fees for processing . Failure to submit an
application in a timely manner will require action by this office in scheduling Encana before the
Board of County Commissioners for a Show Cause/ Probable Cause hearing to determine if the
existing AmUSR permit should be revoked .
The Department of Planning Services strongly encourages Encana to contact this office for
assistance . Specific questions concerning the existing E & P waste management facility
( petroleum contaminated soils landfarm ) should be directed to Troy Swain , Environmental
Health Specialist at 970- 356 -4000 extension 2702 .

Dear Jacqueline,
As per our discussion on Thursday, March 2, 06, we are requesting a 30 day extension on submittal of
our amended USR. As we discussed, EnCana is continuing work on resolving a deed discrepancy that
was identified when we had the subject property surveyed by Drexel, Barrell Surveyors. Currently we are
working on an internal solution to the problem and hope to have the matter resolved in the next few
weeks.
Thank you for your understanding our situation and granting us the necessary extensions in order to
resolve the problem. I met with Troy Swain of the county environmental department last month and we
are working in tandem on issues of concern to his department. Also we want to thank you for the
documents you provided related to the boundary issues. I have forwarded the same to our land and legal
departments. Please give me a call if you have any questions regarding this matter. You may also contact
our Land Manager, Ms. Lois Hall, in Denver is you so desire. Her direct number is 720/876 —3612. Thank
