HomeMy WebLinkAbout20062499.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600221 AGAINST ROSALIO AND MARYANN REYES FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rosalio and Mary Ann Reyes, VI #0600221, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of August, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time this matter was continued to September 12, 2006,to allow staff adequate time to notify the property owners of the hearing date. WHEREAS, on the 12th day of September, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS,Rosalio and Mary Ann Reyes were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Rosalio and Mary Ann Reyes to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. 2006-2499 '. April 25, 2006 Wendi Inloes, sent another letter advising that the mobile home must be removed in order to avoid a violation being initiated. May 22, 2006 Initial complaint received. July 10, 2006 Property inspected. Property remains in violation. July 12, 2006 Letter sent to property owner indicating that the violation case was scheduled before the Board of County Commissioners. August 1, 2006 Re-sent letter to property owner indicating that the violation case was scheduled before the Board of County Commissioners through regular Mail. The mobile home may not be used on any basis as a dwelling or as overnight or temporary housing for any person. A zoning permit for temporary storage of a mobile home shall be for a period of six(6) months, and is renewable for additional six-month periods only by grant of the Board of County Commissioners, and shall be required to pay an additional fee for further extensions beyond six (6) months. 4. All temporary permits for mobile homes shall not be transferable by the applicant and/o r owner to any successor; the zoning permit shall terminate automatically upon conveyance or lease of the property. The mobile home shall be removed from the property, or a new zoning permit shall be applied for and approved.. 5. The applicant must obtain a building permit for a mobile home and must comply with all installation standards of Chapter 29 of the Weld County Code applicable to mobile homes; provided, however,that no utility hookups to the mobile home of any type, including septic systems, shall be allowed. 6. The property is in violation of Chapter 23 of the Weld County Code(Violation#0500115). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer. 7. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 8. Derelict manufactured(mobile)home:a manufactured(mobile)home that is partially or totally damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance,vandalism, or infestation with vermin or rodents. Any such derelict manufactured (mobile)home shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Building Inspection Department, or it shall be removed from the site. 9. Any future structures or uses on site must obtain the appropriate zoning and building permits. 10. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County Code. 11.
