Gesick, Deputy Clerk to the Board COLORADO SUBJECT: Request for Pre-advertisement Cedar Creek Wind Energy, LLC / Green Light Energy, Inc., have submitted a request that the applications for Use by Special Review Permits #1562 and #1563, which will be heard by the Planning Commission on July 18, 2006, be pre-advertised. If you wish to approve this request, a hearing before the Board on August 9,2006,will allow adequate time for advertising for both cases. 2006-1701 PL1845 PL1846 MEMORANDUM WinneTO: Board of County Commissioners COLORADO DATE: June 20, 2006 FROM: Kim Ogle, Planning Manager Chris Gathman, Planner II SUBJECT: Cedar Creek Wind Energy LLC; Green Light Energy Inc Planning Case No.'s USR-1562 and USR-1563 The applicants Cedar Creek Wind Energy LLC and Green Light Energy Inc have requested a pre- Advertisement hearing before the Board of County Commissioners on August 2, 2006 for case numbers USR-1562 and USR-1563 for: A Site Specific Development Plan and a Special Review Permit for a Major Facility of a Public Utility(a 72 mile 230 KV transmission line and one new switching station)[USR-1562] and Site Specific Development Plan and a Special Review Permit for a Major Facility of a Public Utility(Up to 300 individual three-bladed wind turbine generators) [USR-1563] in the A(Agricultural)Zone District. Per the applicant's letter fo June 19, 2006, [Cedar Creek Wind Energy LLC] states "In order to complete construction of the project and achieve a commercial operations date of December 2007 as required by the power purchase agreement between Cedar Creek and Public Service of Colorado (Xcel), Cedar Creek intends to commence its construction activities in the Fall of 2006. Critical to commencement of construction will be the project's obtaining its necessary USR permit from the County. Accordingly, setting an August 2, 2006 public hearing date is of significance to Cedar Creek as it allows the project to meet its construction schedule and its contractual obligations with Xcel. These two cases are scheduled to be heard by the Planning Commission on July 18, 2006. The Department of Planning Services supports the applicant's request of a pre-advertisement hearing of August 2, 2006. 2006-1701 CEDAR CREEK WIND ENERGY,LLC June 19, 2006 Via Electronic and U.S. Mail Department of Planning Services—Weld County Attention: Kim Ogle—Planning Manager Southwest Office 4209 CR 24.5 Longmont, Colorado 80504 Re: Pre-Advertisement Request for Cedar Creek Wind Energy, LLC Use By Special Review Applications Dear Mr. Ogle: Cedar Creek Wind Energy, LLC ("Cedar Creek") respectfully requests from the Department of Planning Services and Board of County Commissioners of Weld County their approval of this "pre-advertisement" request made with respect to USR applications — 1562 and 1563 and the August 2, 2006 meeting of the Board of County Commissioners (the "Board"). Cedar Creek currently is scheduled to have a public hearing before the Planning Commission on July 18, 2006 and would like the Board to schedule a public hearing before it on August 2, 2006. The reasoning for this request is as follows: In order to complete construction of the project and achieve a commercial operations date of December 2007 as required by the power purchase agreement between Cedar Creek and Public Service of Colorado (Xcel), Cedar Creek intends to commence its construction activities in the Fall of 2006. Critical to commencement of construction will be the project's obtaining its necessary USR permit from the County. Accordingly, setting an August 2, 2006 public hearing date is of significance to Cedar Creek as it allows the project to meet its construction schedule and its contractual obligations with Xcel. Cedar Creek appreciates the Board's consideration of this request. Should any additional information be required, please do not hesitate to contact me at 434-220-1406. Sincerely yours, tionvare9, .
