PerV7 26 RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR AN OPEN CUT MINE OPERATION FOR GRAVEL FOR THE COLORADO STATE HIGHWAY DEPARTMENT, P . O . BOX 850 , GREELEY, COLORADO 80632 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 21st day of May, 1980 at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of the Colorado State Highway Department, P. O. Box 850 , Greeley, Colorado 80632, for a Special Use Permit for an open cut mine operation for gravel on the following described real estate, to-wit: A portion of the Northeast Quarter of the Northeast Quarter of Section 16, Township 7 North, Range 59 West of the 6th Principal Meridian, Weld County, Colorado, being more particu- larly described as follows : Beginning at the Northeast corner of said Section 16 , proceed South 02°05 ' West a distance of 800 . 6 feet to the true point of beginning. Thence West 275. 0 feet; thence North 480 . 0 feet; thence West 560.0 feet; thence South 667 . 0 feet; thence East 835. 0 feet; thence North 187 . 0 feet more or less to the true point. WHEREAS, evidence was presented in support of the granting of the Special Use Permit for an open cut mine operation for gravel on the above described real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural Zone District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been t, 1JC1 7,2 j s fully informed, is satisfied that the request for a Special Use Permit for an open cut mine operation for gravel on the herein- above described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the application of the petitioner for a Special Use Permit for an open cut mine operation for gravel on the above described tract of land be, and hereby is, granted subject to the Operation Standards contained in the Special Use Permit and also subject to the conditions as recom- mended by the Weld County Planning Commission. No excavation or processing of materials shall be permitted nearer than ten (10) feet to the boundary of adjacent property, easement or irrigation ditch or right- of-way, nor nearer than 125 feet to any existing residence, unless by written agreement to the owner or owners of such adjacent property consent to a lesser distance and the Planning Commission approves such lesser distance. 3. All extraction operations shall be conducted during the hours of daylight, except in cases of public or private emergency, or to make necessary repairs to equipment. This restriction shall not apply to the operation of administrative and executive offices or repair facilities if located on the property. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be main- tained in such a manner as to present a neat and well kept appearance. 5. Existing trees and ground cover along public road frontage and drainageways shall be preserved, maintained and supplemented if necessary, for the depth of the setback in order to protect against and/or reduce noise, dust and erosion. 6. Where topsoil is removed, sufficient arable soil shall be set aside, for respreading over the excavated area. 7. Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100,000.00 against liability for any negligent act or omision by the operator from the operation, maintenance, extraction, and/ or production of the sand and gravel and shall include all activities connected with or incidental thereto. 8. All phases of the operation shall comply with all applicable County, State and Federal Health Standards and Regulations and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 9. No stockpiling shall be allowed on the Special Use Permit area which would cause damage to adjacent properties or county road right of-way by altering the historic drainage pattern. 10. A rock crusher and asphalt mixing plant shall be permitted on the site. 11. The Special Use Permit shall be limited to the plans shown hereon and governed by the Operations Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Operations Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Operations Standards shall be permitted. According to the geologic map, this site apparently is located in conglomerate beds of the Chadron Formation. Such beds are probably the only suitable source of coarse material in the area as they lay about halfway between outcrops of the Ogallala Formation to the north and limited terrace gravels to the south near Fort Morgan. This will be a rather limited-impact operation affecting less than 10 acres for a period of only several months. Mineral Dime_-- Re is Lessee Permittee Y ` STATE LAND - ASHBAUGH PIT EXHIBIT B: MINING PLAN We presently plan to award a contract for road work in this area sometime during the Spring or early Summer of 1980. At that time material from this pit will be made available for the contractors use. The work under this contract should be completed in the late Summer or Fall of 1980. However, it is quite possible that future highway construction projects and our maintenance forces will also utilize 'material from this source for their work. All such operations would be of relatively short duration with the affected area probably being used for less than 180 days per year. The affected area is adjacent to Weld County Road 115 so access will be directly onto the road. It is possible that we will utilize this site as a source of both gravel and borrow material. We will not designate any specific areas as plant and stockpile sites. This will allow those doing the work to locate the sites in the most advantageous area for their particular operation, so long as they remain within the permitted area. The Department has outlined and specified the following general requirements concerning the mining of borrow and/or gravel from the area. However, those doing the work will be given latitude as to the sequence of operations, methods, and equipment used. The following is a general outline of the mining operation: A) A barb wire fence will be constructed to separate the permitted area from the adjacent grazing land. B) The top 0.5' , approximately, of overburden in the plant, stockpile, and undisturbed portion of the pit area will be stripped and stockpiled. C) Any excess overburden lying below the top 0.5' could be utilized as borrow material; or if not utilized as borrow it will be stockpiled and then at the completion of our operation it will be placed uniformly in the bottom of our excavation. D) The exposed sand and gravel will then be removed and processed over screens or through a crushing plant. E) If it is stockpiled in the affected area it will be later hauled directly to the roadway, or it will be processed through a plant where it will be mixed with asphalt and then hauled from the area. F) The site will be reclaimed in accordance with the _ . ' reclamation plan. ' G) The following types of equipment could possibly be used in the permit area: earth moving scrapers, dozers, front end loaders, trucks, motor graders, screening plant, brusher, asphalt mixing plant, farm type tractors, seed drills, mulchers, and fertilizer spreaders. fi' SOILS The Soil Conserv, )n Service soils map of the al ted area indicates that it is in a gravel breaks range site. The soil in the area where we will excavate is a cascajo gravelly sandy loam. This is a deep and excessively drained soil. It has moderately rapid to rapid permeability with moderate available water capacity. Runoff is slow with a moderate hazard of water erosion and a slight soil blowing hazard. A small portion of the site could contain an olney fine sandy loam which is a deep well drained soil. This soil has a moderate permeability with high available water capacity. , The runoff is slow to medium with a slight hazard of water erosion or soil blowing. Our investigations in the area show that the south eastern portion of the affected area has 10 feet of overburden over the gravel. The depth of the gravel in this area was not determined. Due south and - west of the existing pit the overburden depths ranged from 2 to 6 feet with gravel depths of 6 to 10 feet. The extreme western limits of the area were not drilled as they are at the bottom of the slopes of the hill and it is not anticipated that any gravel will be located in this area.
