HomeMy WebLinkAbout20062891 HEARING CERTIFICATION DOCKET NO. 2006-68 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1573 FORA MINERAL RESOURCE DEVELOPMENT FACILITY(CONCRETE BATCH PLANT) IN THE A(AGRICULTURAL)ZONE DISTRICT-GEORGE EHMKE, C/O CEDAR CREEK WIND ENERGY, LLC A public hearing was conducted on October 18, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden - EXCUSED Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Cyndy Giauque Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated September 29,2006,and duly published October 4, 2006, in the Fort Lupton Press,a public hearing was conducted to consider the request of George Ehmke, do Cedar Creek Wind Energy, LLC, for a Site Specific Development Plan and Use by Special Review Permit#1573 fora Mineral Resource Development Facility(concrete batch plant) in the A(Agricultural)Zone District. Cyndy Giauque,Assistant County Attorney,made this a matter of record, and advised the applicant's representative, Mike Bachli, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and make the determining vote. Mr. Bachli indicated he would like to proceed today. Chris Gathman,Department of Planning Services,presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site,and stated the batch plant will be located east of Weld County Road 105. He further stated the Weld County Road 105 section line,extending south of Weld County Road 122, will be upgraded to access the site. He stated the proposed use is associated with the wind farm facility, approved under Use by Special Review Permit #1563 in August 2006. Mr. Gathman stated the applicant is proposing a temporary concrete batch plant facility to provide concrete for the foundations of the wind turbines. He stated the site will be in operation for approximately seven months,and upon completion,the facility will be removed and the site reclaimed to its original condition. He further stated the site is currently vacant ground, the nearest residence is three-quarters of a mile to the east, and there is another residence one mile to the north. Mr.Gathman stated the applicant is requesting an early release of building permits for the project. 2006-2891 PL1853 tai HEARING CERTIFICATION - GEORGE EHMKE, CIO CEDAR CREEK WIND ENERGY, LLC (USR#1573) PAGE 2 Char Davis, Department of Public Health and Environment, stated this request is for a temporary site, therefore, staff is requiring portable toilets, hand washing stations, and bottled water. Donald Carroll, Department of Public Works, stated the applicant will be required to obtain the appropriate permits prior to using or crossing Weld County rights-of-way, as well as transport permits if they are moving overweight or overwidth equipment. He stated the office and batch plant facilities are located south of Weld County Road 122, east of Weld County Road 105, and if the applicant imports concrete or gravel, they will need to coordinate with the Department of Public Works and the Grader Division to ensure the roads remain in good condition. Mr.Carroll stated the applicant will also be required to apply dust suppressant chemicals in front of residences along the haul route within Weld County. He stated the haul route runs from Kimball, Nebraska, along Interstate 80, and then south on Weld County Road 105 to Weld County Road 122 and the site entrance. He further stated the applicant will be required to install 15-inch minimum culverts, construct adequate turning radiuses, provide weed control, install signs during the construction phase and at all crossings, and comply with Best Management Practices for stormwater management. Mr.Carroll stated tracking pads will also be required to prevent traffic from tracking mud and debris onto County roads. He stated the previously discussed issues will also be addressed through a Long-Term Road Maintenance Improvements Agreement,and a Nonexclusive License Agreement will be required for upgrades and maintenance of the Weld County Road 105 section line for one mile south of Weld County Road 122. Mr. Bachli stated he was authorized by Nelson Teague to state the applicant is in agreement with the requirements of the County,and to request approval of an early release of building permits. In response to Chair Geile, Mr. Gathman stated he spoke with Nelson Teague who indicated he has reviewed and concurs with the Conditions of Approval and Development Standards. In response to Commissioner Long, Mr. Bachli reiterated he was authorized by Nelson League to speak on behalf of the applicant,and that they are agreeable with the Conditions of Approval and Development Standards. Responding to Commissioner Long, Mr. Bachli stated each wind turbine foundation requires 250 yards of concrete, and the slabs are 50 feet by 50 feet, and seven feet deep. Mr. Carroll added the batch plant will produce six to eight loads of concrete per day, require ten water trucks daily, generate 11 semi-trucks hauling cement mix, and employ 15 people. Responding to CommissionerJerke, Mr. Carroll stated the water trucks will come from Cheyenne Wyoming. Ms.Davis stated the site will also have a 15,000-gallon cistern which provides a two-day supply. No public testimony was offered concerning this matter. Commissioner Long moved to approve the early release of building permits. Seconded by Commissioner Vaad, the motion carried unanimously. Commissioner Long moved to approve the request of George Ehmke, c/o Cedar Creek Wind Energy, LLC for a Site Specific Development Plan and Use by Special Review Permit#1573 for a Mineral Resource Development Facility(concrete batch plant)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Comm issionerJerke,and it carried unanimously.
