RE: APPROVAL OF RECORDED EXEMPTION NO. 564 - JAMES R. JAKEL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 564 , being the property of James
R. Jakel, described as part of the Wz Wz of Section 30, T1N, R63W
of the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant
and known as Exhibit "A" , said plat to be recorded, does not come
within the purview of the definition of the terms, "subdivision"
and "subdivided land" , pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove des-
cribed parcel of land owned by James R. Jakel be, and hereby is ,
exempt from the definition of the terms, "subdivision" and "sub-
divided land" .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 4th day of
August, A.D. , 1982.

Re: Recorded Exemption #564
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from James R. Jakel for a recorded exemption. The parcel of land
on which this request is being made is described as the W1 W1 of Section 30,
T1N, R63W of the 6th P.M. , Weld County, Colorado.
The property is located 6 miles south of Keenesburg on Weld County Road 6.
The property contains approximately 172 acres of Class I, II, and III
irrigated and Class III and VI nonirrigated soils.
The request is to divide the property into parcels of 168 acres and 4 acres,
more or less. Mr. Jakel would like to maintain the existing residence (and
improvements) on the four acre parcel and sell the balance of the farmland.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2C. of the Weld County Subdivision
Regulations submission requirements.
2. The request complies with Section 9-2E. of the Subdivision Regulations
as follows:
- The one-hundred seventy two (172) acres, more or less, under
consideration will allow agricultural and related uses to be
the predominant uses. The uses will be compatible with existing
surrounding agricultural uses. These facts support the proposal
as being consistent with the intent clause of the agricultural
zone district.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land division
complies with the Weld County Comprehensive plan; therefore, the
proposed use is consistent with efficient and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Division of Water Services has indicated adequate water
service is available for this proposal.
- The proposed lots are not part of a recorded exemption within
the last five (5) years.
- The two lots proposed will have adequate access from Weld County
Roads 6 and 61.
- The Weld County Health Department has indicated, in a letter
dated July 14, 1982 that both lots will have adequate sewage
capacity.

Dear Sirs :
James R. Jakel and Karen L. Jakel, husband and wife, of 30040
Weld County Road 6, Keenes burg Colorado, request that the Weld
County Planning Commission grant a Recorded Exemption of approximately
four acres, our present home and farmstead. We need the Recorded
Exemption to provide ua a place to live and operate the remainder
of our farm holdings.
James R Jakel has been disable by a disease called hitiocytia
Lymphoma, a form of Cancer associated with lymph nodes. Enclosed is
statement from our doctor as to the condition and health of James
R. Jakel which to us is a just cause for the Weld County Planning
Commission and the County Commisioners to grant us a recorded exempt-
ion of our present living quarters, and farmstead. We intend to
use this as our home-site as long as we can hang on to it.
We intend to use this recorded exemption for agricultural purposes,
and to use said property in a lawfull manner, and comply with all rules
regulations of Weld County to the best of our ability,
The recorded exemption will not add any additional building sites
and is now being used by us as our home and farmstead.
A registered Surveyer,Associated Engineers of Greeley, formerly
Freese Engineering, has been employed to survey the property with the
corners of said recorded exemption being agreed upon by Seller, and
Purchaser. The Corners of said recorded exemption to be set as
agreed by James R Jakel, seller, and William Bell purchaser, with Dave
Bernhardt, Realtor witnessing samee befor surveyer surveys same.
Certificate of conveyances affecting title of said land by
a title company are enclosed.
