Pioneer Service Plans 12/20/2005
The Pioneer Regional Metropolitan District and Metropolitan Districts #1 — 6
Service Plans shall be revised to address the concerns and questions identified
by Weld County staff in the letters dated November 21 , 2005 (Planning Services)
and December 5, 2005 (Finance and Administration), including, but not limited to,
the following conditions:
1. Prior to, or at the time of, hearing before the Board of County Commissioners
(and presented for the Board's information at their January 4 meeting to set a
hearing date) sufficient existing and projected need for services shall be
established through an amendment to the Weld County Comprehensive Plan
and/or rezoning of the subject property to support urban-level development,
defined by densities and characteristics consistent with Weld municipalities or
the Mixed Use District ("M.U.D.") identified in the Comprehensive Plan.
2. Prior to hearing before the Board of County Commissioners (and presented
for the Board's information at their January 4 meeting to set a hearing date)
build-out assumptions that form the basis for the projected pro forma financial
plans within the Service Plans shall be found to be realistic and feasible, as
determined by Weld County.
3. Prior to hearing before the Board of County Commissioners (and presented
for the Board's information at their January 4 meeting to set a hearing date)
the proposed Service Plans shall be modified as follows, to the satisfaction of
Weld County staff:
A. Economic and sufficient water service shall be demonstrated by identifying
a source(s) and providing information concerning the quantity, quality,
availability (transmission), and dependability of the water. Planned
Intergovernmental Agreements or other contractual agreements shall
provide details sufficient for Weld County to evaluate actual service
requirements. The Plans shall include a notification and review option
clause, as referred to in the draft Weld County Policies concerning Special
Districts.
B. Economic and sufficient sewer service shall be demonstrated by
identifying a source facility (proposed or existing) and providing
information about capacity, expansion, and regulatory capabilities.
C. Television relay and transmission shall be omitted as a potential service of
the Districts.

D. The Plans shall include a notification and review option clause concerning
inclusion into, or exclusion of property from, the Districts' boundaries, as
referred to in the draft Weld County Policies concerning Special Districts.
E. The Plans shall include a notification and review option clause concerning
extraterritorial service agreements, as referred to in the draft Weld County
Policies concerning Special Districts.
F. The Plans shall contain language limiting the Districts' powers of eminent
domain to those consistent with the Service Plans. The Plans shall
include a notification and review option clause, as referred to in the draft
Weld County Policies concerning Special Districts.
G. The Plans shall include language clearly limiting the Mill Levy Cap
(aggregate of debt and operations/maintenance) to 65 mills.
H. The Plans shall include a notification and review option clause concerning
proposed ballot questions for a formation election, debt authorization, or
"de-Brucing," as referred to in the draft Weld County Policies concerning
Special Districts.
I. The Plans shall include provision for dissolution, under the circumstances
described in the draft Weld County Policies concerning Special Districts.
J. The Service District (i.e., "Pioneer Regional Metropolitan District") Service
Plan shall detail the governing structure and board of the proposed
Service District and provide for citizen participation and control of the
Board at an appropriate point in its operation.
K. Other textual and clarification items previously identified by staff shall be
addressed.
