RE: Faith Estates Fire Flow Agreement.
To Whom It May Concern:
The Eaton Fire Protection District, Fire Prevention Bureau, has recently met with die
developer of Faith Estates subdivisions located at.Weld County Road 37 neat'Highway
392, and have agreed to the Following requirements:
• Developer (Gary Harkless) agrees to submit a leper to the. Eaton Fire Protection
from Lesh Drilling Inc. stating the fire [low gallons per minute in which water well
has been tested.
• The Eaton Fire Protection District requires one (1)-5 inch Storz adaptor
connection, and two (2)- 2 1/ National Standard Thread (NST) connections. The
developer will provide this equipment..
• A certified well company, to assure lire flows, will test the well and power source
quarterly. Documentation will be kept and maintained by the subdivision
Homeowners Association. A copy will also be sent.to the Eaton Fire Protection
District..
• An alternative to providing electric power to the fire well pump from an apparatus
mounted generator will he established in case operations arc called for during a
power failure.
The Eaton Fire Protection District approves the release of permits for this subdivision and
it is understood that no building will be constructed until said requirements au-e met. If you
have any questions or concerns please contact the Eaton Fire Protection District at 454-
2115.

Thank you for your assistance in helping to resolve this request for paving of the interior roadway
for the Faith Estates Subdivision, As you requested, attached please find the final pavement
design sealed by the engineer of record. Also for your review, we have summarized the collateral
for improvements information below.
The Total estimated cost of improvements and supervision in the previously executed
Improvements Agreement(Private Road Maintenance)was $ 231,805. The "Warranty
Collateral"in the amount of 1.5%of the value of the improvements was $ 34.771. The increase in
the cost of improvements due to the paving of the interior roadway is estimated to be $ 103,270.
The new total estimated cost of improvements would be $ 335.075. Based upon the new total
estimated cost of improvements, the "Warranty Collateral" in the amount of 15% of the value of
the improvements would be $ 50 262

This morning I met with Chris Gathman about a different project and he mentioned that the
Planning Department might require the plat he resubmitted for Board of County Commissioner
approval instead of just attaching this exhibit to the previously approved plat. Chris said that he

d County Public Works Department has reviewed subdivision final plan materials and has the following
�l development referral comments.
Comments
❑ The Public Works Department has received a request by the applicant, Gary Harkless,to pave the interior roadway for
Faith Estates Minor Subdivision in a letter dated March 21, 2006. Additional email correspondence with their
engineer,Pickett Engineering, Inc.,has also been received.
❑ Upon further discussion and evaluation: Public Works has reviewed this request and is in support of paving the
interior roadway. (With regards to paving after acceptance of the subdivision by the Board of County
Commissioners; the Department would request engineering information normally required prior to said approval.)
Public Works'support is based upon the following standard Department conditions prior to paving activities:
o The applicant is required to submit a signed Improvements Agreement According to Policy Regarding
Collateral for Improvements (Public Road Maintenance) for review and acceptance by Public Works
should the applicant desire Weld County permanent interior road maintenance.
OR
The applicant is required to submit a signed (revised) Improvements Agreement According to Policy
Regarding Collateral for Improvements (Private Road Maintenance), for review and acceptance by
Public Works should the applicant desire the Homeowners Association to provide permanent interior road
maintenance.
o The applicant is required to provide the County with surety (Collateral) to cover paving improvements
prior to recording the improvements agreement.
o The improvements agreement shall be approved by the Board of County Commissioners (BOCC) and
Recorded prior to any paving activities.
o The applicant is required to submit a Pavement Design sealed by the Engineer of Record for review and
acceptance by Public Works prior to recording the improvements agreement.
o The applicant is required to provide independent testing of pavement materials verifying construction
methodology in coordination with a Weld County Field Inspector (Public Works). Testing must be
included and itemized in the improvements agreement.
o The applicant must notify Weld County Field Inspection(Public Works)of any construction prior to work
activities.
o The applicant shall be required to provide a One-Year Warranty Period covered by retaining 15% of
Collateral monies for paved roadway construction costs upon completion of the paving.

o The applicant is required to amend the Final Plat with the proposed roadway cross-section shown on the
plan drawing, a depiction of the approved roadway cross-section corresponding to the pavement design,
and a note indicating responsibility (Weld County OR Homeowners Association) of maintenance for said
interior roadway. The amended Final Plat shall be recorded; after acceptance and recording of the
improvements agreement by the Board of County Commissioners.
o The applicant shall be required to amend the Homeowners Association Covenants pertaining to the
responsibility (Weld County OR Homeowners Association) of maintenance for the interior roadway of
the subdivision. The amended Homeowners Association Covenants shall be recorded; after acceptance
and recording of the improvements agreement by the Board of County Commissioners.
o The applicant will be required to obtain written permission from the Public Works Department prior to
paving construction activities. The Planning Department will be copied with this notification.
o The applicant shall be required to amend the drainage/ stormwater report to accommodate paving of the
interior roadway for review and acceptance by Public Works. The Planning Department will be notified
in writing of Public Work's acceptance of the drainage report.
❑ The Public Works Department will continue its review of paving when all engineering information and documents
have been submitted to our office. A piecemeal submittal of the paving items necessary to process this request is not
recommended.
❑ The Public Works Department will prepare comments with respect to this request to the Planning Department thru the
standard Weld County process. Public Works will proceed only with the endorsement of the Planning Department.
Recommendation
❑ The above comments are prerequisites and shall be fulfilled prior to paving the interior road.

Thank you for your patience ... until Public Works could respond to your email.
Please provide the developer /applicant with the following information with respect to paving an existing
gravel interior roadway for a subdivision:
1. Letter addressed to Director of Public Works requesting paving of interior gravel subdivision roadway.
2. Pavement Design sealed by Engineer of Record.
3. Weld County Field Inspection of construction work.
4. Testing of Pavement verifying construction methodology in coordination with Field Inspector.
5. Improvements Agreement (Private - for HOA maintenance OR Public - for Weld County Maintenance)
approved by BOCC.
6. Collateral Escrow.
7. One-year Warranty Period covered by Retaining 15% of Collateral for Roadway Construction Costs.
8. Revised Plat depicting Pavement for internal roadway cross-section and note with respect to roadway
maintenance (HOA or County).
9. Revised HOA Covenants pertaining to maintenance of paved internal roadway (HOA or County).
10. Approval in writing by Weld County Public Works Department prior to any construction / paving
activities.
This is much like the standard procedure to do the paving upfront, with the exceptions of the revisions to
plats, covenants, etc.
Public Works feels this protects the Public, since at some future date the HOA may ask the County to take
the internal road for maintenance.
Appropriate documentation and engineering is required to ensure minimum standards are being met for
development within the County.
Additionally, consistent guidelines must be followed regardless of when an improvement is being proposed.

After I spoke with you earlier today, Gary Harkiess delivered the remainder of the information
required to record the Final Plat as outlined in the Board of County Commissioners resolution
from the public hearing held on September 14, 2005. Attached please find a response to the

RESPONSES TO THE BOARD OF COUNTY COMMISSIONERS RESOLUTION
TO APPROVE MINOR SUBDIVISION PLAN

The following are responses to the list of requirements that must be addressed prior to recording the minor
subdivision final plat, as specifically identified in the resolution shown above.
PLAT REVISIONS AND AMENDMENTS
The plat has been revised to include the required notes, labels and delineations as described in items 1.A,
M, and N. As discussed with Chris Gathman the county planner, items 1.N.2, 3, and 6 were revised to
reflect the relocation of the proposed water well (for fire fighting purposes) from Outlot A to Outlot B.
Please see attached email correspondence from Chris Gathman dated 11/02/05. The revised plat has been
attached.
ACCEPTANCE OF THE IMPROVEMENTS AGREEMENT
As required by item 1.B, copies of the Improvements Agreement and the Irrevocable Letter of Credit No. 1
have been attached as the form of collateral for the Board of County Commissioners approval. The Weld
County Public Works Department has previously approved the draft copy of the Improvements Agreement.
Please see attached email correspondence from Chris Gathman dated 09/29/05.
APPROVAL OF THE COVENANTS
As required by item 1.C, a copy of the Covenants was forwarded to the Weld County Attorney's Office for
their review and approval on 10/17/05. A follow-up email to Lee Morrison was sent on 11/07/05. Not
having received a response from the Attorney's Office,Pickett Engineering spoke with Chris Gathman and
submitted an email on 11/22/05 stating that we would submit the remainder of the information once it was
available. Please find the attached transmittal and email messages described above. A copy of the Faith
Estates Covenants and the Faith Estates Homeowners' Association Bylaws has been attached. A signed
copy of the Covenants will be submitted with the Mylar copy of the plat for recording.
OWNERSHIP OF OUTL0TS A AND B
As required by item 1.D, attached please find a quitclaim deed granting ownership of Outlots A and B to
the Faith Estates Homeowners' Association. The quitclaim deed will be executed upon recording of the
final plat.
REGISTRATION OF FAITH ESTATES HOMEOWNERS'ASSOCIATION
As required by item 1.E, attached please find a copy of the Certificate from the Secretary of State of the
State of Colorado showing the Faith Estates Homeowners' Association has been formed and registered

Chris,
Thank you for your time earlier today. This email is just a follow up to summarize our phone conversations. As we
discussed:
1. When Pickett Engineering (PEI) submits the package containing all of the required information prior to recording the
final plat as outlined in the BOCC resolution, we will submit two paper copies of the plat and will submit a copy of the
finalized Covenants. Once this information has been accepted, we will submit a mylar copy of the plat with the required
recording fee. We will also submit the original copy of the Covenants and the recording fee.
2. When PEI submits the package containing all of the required information, we will have to submit a copy of the
Improvements Agreement and attach the original letter of credit. As you and I discussed, the attached copy of the
Improvements Agreement will have the first page of the agreement replaced with a new sheet that does not have
an "entered into" date typed in the blank.
The original copy (with original signatures) of this Improvements Agreement was submitted to your office (without a
letter of credit) in June of this year when we submitted the Final Plat for review and approval. If you would like us to
submit another original copy of the Improvements Agreement with a current signature date please let me
know.
3. PEI has not received a statement of approval from the Weld County Attorneys Office in regard to the Covenants.
Lee Morrison will not be back in the office until after Thanksgiving. We hope to submit the the package containing all of
the required information sometime before Thanksgiving. If this submittal does occur this week we will have to
coordinate with Lee Morrison to provide the statement of approval as soon as possible upon his return to office.
Please let me know if you have any questions and if you would like a current original copy of the Improvements

The resolution approved by the BOCC had a couple of references to Outlot's A& B and the emergency fire well. Under
the list of"Prior to Recording the Final Plat:" please see items 1, N (2,3,&6). During the past few weeks three test wells
have been drilled to confirm the flows expected from the emergency fire well. The test well that produced the most flow
was surprisingly located in Outlot B instead of Outlot A. We would like to change the notes on the plat to reflect that the
emegency well will be placed in Outlot B instead of Outlot A. We have already reviewed this change with the Eaton
Fire Protection District and have recieved their approval. See the attached pdf file. The new fire well location will be
located in the very northwest corner of Outlot B and will be easily accessable from the"knee cap" corner on Faith
Lane. Please let me know what you think about this proposed change to the plat notes. Thank you.
