Dear Ms. Miller,
Weld County Public Works Department, Planning Department, Building Inspection
Department, and Environmental Health Services have reviewed your requested Flood
Hazard Development Permit (FHDP) application for the above referenced oil and gas
well sites and tank batteries to be located on Eastman Kodak parcels number 0807-26-
2-00-006 and 0807-33-0-00-026, and Broe Land Acquisitions parcel number 0807-35-1-
00-032. The FHDP permit is conditionally approved subject to the requirements below.
COMMENTS
Department of Planning Services
Request, revised 4/19/06, and again 5/24/06, is for placement of 12 well heads structures and 2
tank batteries.
Legal: Portions of Section 26, 27, 34 and 35, T6N, R67W of the 6th P.M., Weld County,
Colorado
Situs Address: Unknown
Parcel Number: 0807 26 20006, 0807 35 000026, 0807 35 100032, and other parcels as
delineated, USR-1462 and USR-1467
The property appears to be within an area designated Floodplain/ Floodway. Given the
interpretation by this office additional supporting documents are required by the applicant or the
applicants engineer. Should this documentation be forthcoming and is acceptable to t
Department of Public Works, this office has additional comments and requirements. EXHIBIT

Building Department
Based on information submitted for Flood Hazard Development Permit #507 Oil-Gas
Wells in an Industrial Zone the following staff recommendations are offered:
1. A building permit is required for gas and oil operational equipment.
2. Building setbacks and offset distance shall be determined by the Zoning Ordinance.
3. All equipment blow BFE in a Flood Zone shall be flood proofed and tied down to resist
hydraulic forces.

No comments.
Public Works Department
The applicant submitted a FHDP certification stamped and signed by Aaron K. Asquith
(#336602) on behalf of Petro-Canada. The proposed oil and gas wells and tank batteries are
located within the current effective 100-year floodplain of the Cache La Poudre and tributary
creeks as defined by FEMA on FIRM Community 80622, Panel # 0605 D. The area is
upstream of the Corps of Engineers study area for the proposed floodplain revision for the
Cache La Poudre River currently under review by FEMA.
REQUIREMENTS:
Environmental Health Services
1. A Weld County Septic Permit is required for the septic system(s) as required by USR 1529,
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S. flood plain policy (attached). In accordance with the Colorado
I.S.D.S. Regulations, no septic systems shall be installed within the floodway.
Department of Planning Services
The property appears to be within an area designated floodplain. Given the interpretation by
this office additional supporting documents are required by the applicant or the applicant's
engineer. Should this documentation be forthcoming and is acceptable to the Department of
Public Works, this office has five additional comments.
Installation of utilities shall comply with the conditions listed in the Flood Hazard Development
Permit Certificate.
Construction shall comply with all requirements/conditions of the Weld County Building Code.
All proposed or existing structures will or do meet the minimum setback and offset requirements
for the zone district in which the property is located.
Any future structures or uses on site must obtain the appropriate zoning and building permits.
The applicant shall demonstrate compliance with, and obtain approval by the Board of County
Commissioners for land use case number AmUSR-1467. All Conditions of Approval and
Development Standards shall be addressed and complied with at all times.
Building Department
None.
Department of Health and Environment
No requirements.
Public Works
Per Weld County Flood Hazard Development Standards, oil and gas production facilities shall
meet the requirements of Weld County Code Sec. 23-5-260.
RECOMMENDATIONS:
The Weld County Public Works Department recommends conditional approval of this
application.

Revised Site Plan and responses prior to recording the plat
Dear Brad:
Attached are(2)copies of the latest plat, which encompasses elements from USR-1467 in
addition to those elements proposed by AmUSR-1467. Please note(2)proposed wells located in
section 34 will utilize an existing tank battery which was previously permitted under USR-1462.
1) Windsor/Severance Fire Protection District: PCR field supervisor, Dave Gipson
will acquire a special hazard permit from the Windsor/Severance Fire Protection
District.
2) All 21 wells noted on the plat are located more than 60' from the Poudre Public
trail,therefore chain link fencing around the facilities will not be installed.
3) CDOT: PCR field supervisor, Dave Gipson will contact Gloria Hice-Idler to
verify an access permit for State Highway 257 and any additional requirements
that may be needed.
4) Prior to drilling, the contractor will obtain the necessary permits for overweight
and over width vehicles.
