RE: GRANT MOBILE HOME PERMIT NO. 951 - ROCKY MOUNTAIN READY MIX
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 13th day of November, 1984 , considered the
request of Rocky Mountain Ready Mix for one mobile home to be
used as more than one Accessory Use in the Industrial-Three
(I-3) Zone District, and
WHEREAS , said mobile home is to be used as an office and
placed on a parcel of land being more particularly described as
follows:
Part of the NWT and Part of the NE1, Section 31,
Township 1 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado
WHEREAS , the Board of County Commissioners , having heard
the testimony, finds that said request should be granted subject
to the following conditions: 1) the applicant applying for a
building permit for the mobile home within thirty days from the
date of approval by the Board of County Commissioners; 2) prior
to the issuance of a building permit, the owner shall submit
evidence that the proposed well is supplying water in such a
manner as to be adequate in quality, quantity and dependability
for the proposed use; and 3) the mobile home shall not be
occupied until such time that the applicant has complied with
the above mentioned conditions .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Rocky Mountain Ready Mix to place one mobile home to be used as
more than one Accessory Use on the above described parcel of
land, which was found to be in compliance with Section 43 of the
Weld County Zoning Ordinance be, and hereby is, granted subject
to the hereinabove listed conditions.

Location: Approximately 1 mile north of Brighton; west of Hwy 85.
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the reasons:

COMMENTS:
This application is a result of Violation #501:84: 103. The applicant would
like to provide additional office space for their business. The Department of
Planning Services has not received any objections to this proposal.
The Department of Planning Services staff recommendation for approval is
conditional upon:
1. The applicant applying for a building permit for the mobile home within
thirty (30) days from the date of approval by the Board of County
Commissioners.
2. Prior to the issuance of a building permit, the owner shall submit
evidence that the proposed well is supplying water in such a manner as to
be adequate in quality, quantity and dependability for the proposed use.
3. The mobile home shall not be occupied until such time that the applicant
has complied with Conditions 1, 2 and \ above.

COMMENTS:
The subject site is a 6.9 acre tract of land owned by Roger Phillips. Norden
and Sons Contractors were the former owners of this parcel. Access to the site
is directly opposite of Weld County Road 4 off of Highway 85, and is a shared
access with the Mobile Premix Plant. Improvements on the 6.9 acres includes a
concrete batch plant and maintenance garage (Rocky Mountain Ready Mix) , large
metal garage, four mobile homes, a concrete block building, several small metal
buildings, and stored equipment. The improvements are situated above the South
Platte River Flood Plain. Fill materials is currently being dumped west of the
improvements into the flood plain.

Explanation of Site Plan and Sketch Plan
The parcel of land described in Exhibit "A", a tract of approximately
6.9 acres and outlined on the site plan,is owned by Roger Phillips, 6744
Benton Street, Arvada, Colorado, 80003. Rocky Mountain Ready Mix Concrete,
Inc. leases a portion of the Phillips property. The lease was entered into
in July of 1981 with Norden and Sons Contractors, Inc. Phillips is successor
to Norden by virtue of being the current property owner.
The land Rocky Mountain leases is an undescribed and unsurveyed portion
of the property consisting of approximately one acre. The site plan shows
approximate boundaries and location of the land leased by Rocky Mountain.
The sketch plan shows a more detailed description of the property
including approximate distances from property lines to structures on the
property, the location of improvments, and the existing access and state
highway frontage.

This lease agreement , made and entered into this 20th day
of July , 1981 , by and between ROCKY MOUNTAIN READY MIX CONCRETE ,
INC . , a Colorado corporation , (hereinafter referred to as "Rocky
Mountain" ) , and NORDEN & SONS CONTRACTORS , INC . , a Colorado corporation,
(hereinafter referred to as "Norden" )
WITNESSETH :
WHEREAS , Norden is the owner of that certain real property
located north of the city limits of Brighton , Colorado , on U . S .
Highway 85 , in Weld County , more particularly described in Exhibit
"A" , and
WHEREAS , Rocky Mountain desires to lease a portion of said
real property for the purpose of establishing a ready mix concrete
operation and other lawful business pursuits , .and
WHEREAS , Norden desires to lease a portion of said real property ,
NOW , THEREFORE , for and in consinration of the lease ments
herein agreed to be paid , and in consideration of the mutual
covenants and conditions hereinafter set forth , Norden agrees to
lease to Rocky Mountain and Rocky fountain agrees to lease from
Norden a portion of the real property described in Exhibit "A" ,
to wit :
1. SITE DESCRIPTION
The property to be leased shall he a parcel of land of one
acre , more or less , in dimensions of approximately 274 feet by
158 feet , located south and southeast of the garage facility located
on the property described in Exhibit "A . " The location of the
property to be leased is shown in a drawing labeled E>:hibit " B" and
made a part of this agreement by reference thereto .
2 . SITE REQUIREMENTS
Norden agrees the site shall conform to the following described
requirements and that Norden shall bear all costs and expenses
required to insure said site meets all the requirements outlined

below. The leased site shall be level , clean , and compacted ,
suitable for a plant location and heavy truck use . The site
shall be furnished with power (110/220 ) and shall be furnished
with potable water ( from a well or a pipeline from a well rated
at not less than 25 gpm. ) Utilities , including water and
electical poser, will be furnished at Norden ' s expense to the
point of location of Rocky Mountain ' s plant on the leased site .
Location of Rocky Mountain ' s plant and other auxiliary buildings
including an office and a maintenance garage is as indicated on
the drawing Exhibit "B . " The site shall be properly zoned for the
intended use and Norden shall bear all costs and expenses required
by Weld County to insure said site meets the requirements necessary
to be zoned for its intended use . Rocky Mountain has permission
from Norden to construct a leach field or to utilize an existing
septic system at Rocky Mountain ' s expense .
3 . SITE USEAGE
It is understood and agreed that in its operation , Rocky
Mountain willpour concrete pads for various structures including
a plant , mobile office , fuel and water tanks , a fuel rump , and
other storage facilities . Rocky Mountain agrees to remove these
concrete pads at its own expense when it vacates the property or
to leave these cads for Norden ' s use , solely at Norden ' s discretion .
It is understood and agreed that in its operation , Rocky Mountain
may errect a pole shed or metal building suitable for storage and
truck maintenance . Rocky Mountain agrees to remove this building
at its own expense when it vacates the property or to sell said
building to Norden at fair market value , solely at Norden ' s dis-
cretion . It is understood and agreed that Rocky Mountain shall
stockpile aggregate materials on said site , shall ark trucks on
said site , and shall dump left-over concrete on said site .
4 . SITE ACCESS
Rocky Mountain is hereby granted access to the leased site
via a non-exclusive easement for ingress and egress to and from
said site over the existing driveway along the east fenceline of
Norden ' s property and along the north property line of the leased

site between said site and the existing helicopter pad , both as
outlined on the drawing labeled Exhibit " B . " The non-exclusive
easement for ingress and egress includes full use of the front
gate from Norden ' s property entering U . S . Highway 85 and said
non-exclusive easement is granted to Rocky Mountain , its heirs ,
assigns , guests , invitees , licensees , personal representatives ,
and others so designated including but not limited to suppliers
of aggregate and cement .
5 . TERMS AND CONDITIONS
The lease shall run for a period of seven years , commencing
July 1 , 1981 , renewable by Rocky Mountain annually . Consideration
for the lease shall be $ 500 per month paid in advance on the first
day of each month . The consideration for the lease for year two
and for year three shall be $500 per month . Commencing in year
four, beginning July 1 , 1984 , the rate of consideration for the
lease may be negotiated between the parties hereto . Norden agrees
to assign this lease agreement to any financial institution recaiiring
such an a.. s- umcnt asa condition of loaning funds co Rocky Mountain
to establish its business operation . This lease agreement shall be
binding to the parties hereto and to their resn ccti-ve _ _ sonal
representativee , successors , assigns , and heirs .

Dear Bob:
Rocky Mountain Ready Mix Concrete, Inc. is making application to locate a
second mobile home on property we lease on Highway 85 in Weld County. The mobile
home will be used as additional office space. The need for additional office space
is acute because the company has grown significantly since its formation.
Because,our operation is located on leased ground, we can not construct
a permanent office facility at the present site. It is our intention to locate
suitable property and construct an office building and permanent plant prior to
the expiration of our lease.
During the interim years prior to the time it becomes economically fesible
to construct a permanent facility for our company, we need additional office
space for the comfort and operating efficiency of our employees. The location
of a second mobile home office will meet these business needs.
