HomeMy WebLinkAbout20062988.tiff tit RESOLUTION RE: APPROVE VACATIONOF USE BYSPECIALREVIEW PERMIT#108-JOHN SOBCZAK WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #710309, dated August 25, 1971, the Board of County Commissioners approved Use by Special Review Permit#108 for expansion of an existing poultry operation for John Sobczak, Route 1, Box 92, Erie,Colorado 80516,on the following described real estate, to-wit: Lot 6, Block 2 of Ranch Eggs Subdivision, being part of the NW1/4 of Section 34, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS,the Board has received a request from Timothy and Arlene Rockwell,General Delivery, Four Corners, Wyoming, 82715-9999, current property owners, to vacate said Use by Special Review Permit#108, since the use is no longer being performed on the property, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicants and the recommendation of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. The property owners are requesting that SUP-108 be vacated from the following parcels,1467 34 201007 & 1467 34 201006 since the use is no longer being performed on the property. The Department of Planning Services conducted a site visit of your property and noticed the Use by Special Review `for an expansion of an existing poultry operation originally approved on August 9, 1971 `by the Board of County Commissioners is no longer being conducted on the property. The Department of Planning Services request that you submit in writing to our office a request to either vacate the Use by Special Review or submit written evidence that the approved uses are still in operation. I have enclosed a form for you to indicate your wishes and sign along with an envelope for you to mail the form back to the Department of Planning Services. If no response is received the Department of Planning Services will be setting up SUP-108 for a probable cause hearing before the Board of County Commissioners to review compliance with the permit. All conditions of the original permit must be in compliance by October 30, 2006 or a Probable Cause public hearing, pursuant Chapter 23, Article II (2), Division 4, Section 23-2-270 of the Weld County Code, will be scheduled. If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review case number SUP-108, for compliance with the Development Standards and Conditions of Approval, as approved by the Board of County Commissioners on August 9, 1971 to determine if probable cause exists to hold a hearing on revocation of the permits. The Department of Planning Services has determined that per section 23-2-200 of the Weld County Code the Use by Special Review (SUP-108) for an existing poultry operation is not being conducted on site.
