HomeMy WebLinkAbout20062517.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ROSA CABELLO FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rosa Cabello, VI#0600021, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of September, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Rosa Cabello and J.D. Cabello, property owners,were present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 12, 2007, to allow adequate time for the property owner to remove the mobile home and to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #0600021 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Rosa Cabello to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties,with an instruction for delay of action upon such referral until March 12, 2007, to allow adequate time for the property owner to remove the mobile home, and to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance. 2006-2517 PL0824 Cry Pt, VIOL 6Q --o6 VIOLATIONS - VI #0600021 - ROSA CABELLO PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 12th day of September, A.D., 2006. Barker, Weld County Attorney, below named, and for its Complaint against the Respondents, Manuel Cabello and Rosa Cabello, allege as follows: GENERAL ALLEGATIONS 1. This is a Complaint seeking relief,pursuant to Rule 65,C.R.C.P.,and C.R.S.,Section 30-28-124, and C.R.S., Section 30-28-209,prohibiting the Respondents from using, or allowing the use,of their property in violation of the Weld County Code hereinafter"County Code," with respect to the non-commercial junkyard and the mobile home in violation of the Weld County Code hereinafter "County Code." 2. Petitioner, Weld County,by and through the Board of County Commissioners of Weld County, Colorado,is a political subdivision of the State of Colorado and a body corporate and politic and is a Home Rule County organized pursuant to statutes of the State of Colorado, and the Weld County Home Rule Charter. Pursuant to the authority of C.R.S., Section 30-28-101, et seq., as amended, the Weld County Board of County Commissioners duly enacted and adopted the Zoning Resolution, a comprehensive resolution establishing land use, zoning and regulations for the use of land and buildings within the unincorporated portions of Weld County, Colorado. The Zoning Resolution, with amendments, was in full force and effect until August 25, 1981, at which time, it was superseded by Weld County Ordinance No. 89 (Zoning Ordinance). The Zoning Ordinance, which was codified as Chapter 23 of the County Code, effective January 2, 2001,with amendments, has been in full force and effect at all times material herein and is applicable to the property in question. FIRST CLAIM FOR RELIEF (Non- Commercial Junkyard) 3. The allegations of paragraphs 1 and 2 are incorporated as if fully set forth herein. 4. That at all times material hereto, the Respondents have been the owners/occupants of property described as Lotj 7 add 8, Block 21, Aristocrat Ranchettes, Inc. Subdivision, County of Weld, State of Colorado, also know by street and number as vaeantlaud, unincorporated, Colorado 80621, "A (Agricultural) Zone District. 7(. 'r C -k v\ • 5. Respondents have been given notice of the violation, and the Weld County Board of County Commissioners have authorized legal action for failure to remove, restore or completely screen non-commercial junkyard from all adjacent properties and public rights-of-way. 6. That on April 11, 2006 at a Violation Hearing, the Board of County Commissioners deemed it advisable to refer said violation to the County Attorney's Office. That since at least January 25, 2006 and continuing through May 4,2006, and continuing on information and belief,to this date, the Respondents, Manuel Cabello and Rosa Cabello have used, maintained, stored, or occupied or allowed the use, maintenance, storage, or occupancy of the non-commercial junkyard located on the above-described property, and continue to use,maintain, store, or occupy or allow the use, maintenance, storage, or occupancy of the non-commercial junkyard located on the above- described property without first complying with the Weld County Code. The violation of the County Code, therefore, continues and there appears to be no adequate remedy at law with which to compel compliance with the County Code. 7. The Respondents'above-described violation of the Weld County Code by their failure to remove,restore or completely screen non-commercial junkyard from all adjacent properties and public rights-of-way in order to use the property in a manner consistent with the Weld County Code is detrimental to the County of Weld and its inhabitants in that it frustrates the purpose of the County Code to preserve and protect the public health, safety, and general welfare of the residents of Weld County. Respondents' continued failure and refusal to cease and desist from such violation will result in irreparable harm to the County of Weld and its inhabitants for which the Petitioner has no adequate remedy at law. SECOND CLAIM FOR RELIEF (Mobile Home) 8. The allegations of paragraphs 1 through 7 as incorporated as if fully set forth herein. 9. Respondents have been given notice of the violation, and the Weld County Board of County Commissioners has authorized legal action for failure remove mobile home. 10. That on April 11,2006 at a Violation Hearing,the Board of County Commissioners deemed it advisable to refer said violation to the County Attorney's Office. That since at least January 25,2006,and continuing through May 4,2006,and continuing,on information and belief,to this date, the Respondents, Manuel Cabello and Rosa Cabello have used, maintained, stored, or occupied or allowed the use,maintenance,storage, or occupancy of the mobile home located on the above-described property, and continue to use, maintain, store, or occupy the mobile home located on the above described property without first complying with the Weld County Code. The violation of the County Code, therefore, continues and there appears to be no adequate remedy at law with which to compel compliance with the County Code. 11.
