This project falls primarily under purview of the Use by Special Review Standards Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 19 is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. ,EE-2617, Lot A (Greenhouse/Market): The Weld County Public Works has asked that the access directly uth of State Highway 66 be closed as it is too close to the intersection. This was closed with the a green portable fence section for a number of months, but appears to be reopened. My comments have always been to use control access points for this particular site. RE-4089, Lots A and B: is in the process of splitting off the existing residence directly south of the greenhouse to Lot A and the remaining portion 73 ± acres for Lot B. In the questionnaire, the applicant indicated that the lot be a 73 acre parcel with a double wide structure on it for the hired man with no indication of the proposed USR festival facility. In comparing the two questionnaires between the RE and the proposed USR, the USR application was dated 4/8/2005, which predates the RE application of 4/23/2005 so the applicant did know that Lot B was being planned as a guest farm/playground area/festival facility. REQUIREMENTS: Access: In referring with staff, RE-2617, Lot A, The Greenhouse/Market shall be included in the proposed USR. The Weld County Public Works Department is requiring that the access directly south of State Highway 66 be permanently closed again. This is an unsafe access point. It has been addressed previously by our department and the state. Lot A of RE-4089 previously RE-2617, Lot B, shall be granted one residential access. (2± acre parcel) The remaining portion of Lot B of RE-4089 previously, Lot B of RE-2617: The applicant is identifying two „parking areas to accommodate the festival facility. The north parking area directly south of the residential wcel west of the irrigation ditch is identified as a market and parking area. Overflow parking or a larger parking lot is being identified east and south of the irrigation. It is parallel to WCR 19. Utilize this access point with adequate turning radiuses in both directions. Berming/Landscaping: The applicant should consider berming or landscaping the entire frontage adjacent to the parking lot to define approved access points. The existing condition is unsafe with uncontrolled access points to the north parking lot. Storm Water Drainage: Section 8 In the questionnaire was not addressed on storm water drainage. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The Environmental Health Services Division was unable to locate a septic permit for the septic system serving the existing market-greenhouse structure. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. 2. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. 3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 6. The applicant shall operate in accordance with the approved "waste handling plan". 2 7. No on-site disposal of produce of any type shall be permitted at anytime. Produce shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, blowing of debris, fugitive dust, or spoiled produce on or around the facility. 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 9. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 10.Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. The facility shall utilize portable toilets and self-contained hand washing units for up to 6 months. 11.A handwash station, with soap and paper towels, shall be set-up in close proximity to the Petting Zoo and shall be available for use by the public at all times. 12.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 13.Water shall be available to patrons at all times. The facility shall supply bottled water or utilize the existing public water supply. (Central Weld County Water District). 14.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 15.If applicable, the applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. Building and structures associated with the site development are required to meet all building code requirements for the new intended usage for each existing building on the site and/or new structures that will be part of the on going activities permitted with the USR. The following life, safety, health and public welfare building code concerns must be addressed: .1- Individual building permits are required for the following: a Any structure, mechanical,plumbing or electrical work that does not meet the exceptions to Section 105 of the 2003 IBC is required to have a building permit for its intended use. This includes temporary structures that exceed 120 square feet in used gathering together 10 or more people in accordance with 3103. b A change in use permit is required for the any existing building that will be used or occupied by the public as part of the permitted USR. Buildings that require a change in use will be required to comply with all requirements for the new intended use in accordance with Chapter 34. 2 Occupancy usage will be granted for existing structures,as well as new structures, based on the intended nature and character of use for those structures that will be part of the site development granted through the USR. It appears that the sales shed barn for wholesale/retail use will be a mixed M or B/S usage. Non building structures, enclosed areas, special play activities and amusements will potentially be a B or A usage in accordance with 411. Actual occupancy usage for buildings and non building structures will be determined at the time a permit is granted in accordance with Section 302 and Chapter 4 of the IBC. 2 Building permits applications shall include two complete set of plans—to include a site plan specifically indicating those building and structures that will be included as open to the public. The site plan is to indicate location on property, distances between building and structures and intended usage for each building. Additionally all new structures shall include structural, architectural, mechanical, plumbing &electrical plans. Permits for change in use, in addition to 2 the above, shall include an as built of the existing building and any proposed renovation work for new intended usage. Any foundation work shall be engineered, ie.wall or facades for theatrical or festive effects. Granting of a Certificate of Occupancy for any new intended usage of existing buildings will require the existing buildings to meet all requirements for the new intended use in accordance with the 2003 IBC.
