RESOLUTION RE: APPROVE IN PART PETITION FOR ABATEMENTOR REFUND OF TAXES-ROBERT MAHAN WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners of Weld County, State of Colorado, at a duly and lawfully called regular meeting held on the 11th day of December,2006,at which meeting there were present the following members: Chair M.J.Geile,and Commissioners William H.Jerke, David E. Long, and Robert D. In 1980 Ronald M. Jones and Keith Mahan applied for a Subdivision Exemption to change the property line between their adjoining properties. Mr. Jones wished to deed Mr. Mahan 4.512 acres. The application materials and Board of County Commissioners resolution clearly show that this 4.512 acre parcel was to be combined with Mr. Mahan's property and would not create an additional lot. Because the 4.512 acre parcel was never combined with Mr. Hahan's property, both would be considered illegal. State and County law prohibit the creation of parcels less than 35 acres without approval through the County under the appropriate process defined in Section 24 of the Weld County Code. Therefore, parcels of land resulting from a sale or transfer of land which creates any parcel less than 35 acres are ineligible for a building permit, unless the recognized process was utilized in creating the lot(s)in question or the lot was legally created prior to August 31, 1972 . The act of subdividing land which results in a lot being less than 35 acres in size is defined by State Statute as a criminal activity, The property owners are eligible to apply for a Recorded Exemption to create the lots legally or the lots can be recombined. Illegal lots have a limited resale value and are not eligible for land use applications which do not fix the illegal lots. Further, no building permits will be issued on the lots. It is in the best interest of both property owners to work together to remedy the situation, however, our office can not force the property owners to do so. Because the weld county planning board has claimed my property is also an illegal lot. I have been told by staff at the planning office that I cant do anything with this property. I have also been told by staff that I must sell this property to one of my neighbors and then in the buy it back from them to make it legal. This sound very strange . the lot has exchange hands four times to my knowledge in the past 23 years. The property was originally owned by Ron Jones a neighbor, my father and mother( Kieth and Wilma Mahan owed the adjacent 20 acre Pig farm( 13031 wcr 88 Pierce Colorado. They purchased the 4.5 acres from Ron Jones to build a retirement home. As Farmers National Bank had a lien on the 20 acre Hog farm. My mother and father paid cash for this property. When the Farm began to have income issue they sold it to Dan Brecthal. To raise money to meet bills. They lost the farm not long after to Fanners National bank my father quick claimed in over to the bank instead of going through forecloser proceedings.. When the property was sold to Dan there was no issues with it. Dan had it for a number of years and there was no issue with the property. Dan sold it to my Brother Neil Mahan several years ago. My brother need some money and I bought it from him for 100 dollars US gold. Article 1, Section 8 of the United States Constitution that expressly charges Congress with power to coin money and regulate the value thereof. Article 1, Section 10 of the constitution says: No State shall make any thing but gold and silver Coin a Tender in payment of Debts. I purchased this property with law full money and I am the holder in due coarse of this land. I should be able to do anything law fully I want with it. But I am told by members of your planning board that I cant do anything with this property as it is some how illegal. The Lot mentioned is approximately Four acres it was a homestead when my parents purchased it. They planned to re- build the on the property a home. The property today still has the cellar and foundation from the original house. foundation of the chicken house. The remains of the storage shed, a well and other foundations. I want to be able to use this property that I own to my best uses . That I believe would be to let me zone it for a Homestead and let me replace the building that were there.. But if the zoning commission wont let me because it somehow is illegal ????. It has changed hand a number of times with out this being a issue. My brother paid 3500 dollars if I remember and the taxes were a100 dollars a year. I paid for it and suddenly they value the property at 65000 plus and raise my taxes by 13 taxes in one year. Then tell me it illegal and I can not even fence it in or do anything with it. Something is very wrong with this situation. I would like to get the property out of it status and zoned for use. But I will not play games of selling it to a neighbor who doesn't have to sell it back so the county can charge multiple time for a simple procedure. Which is a simple change of a computer code.
