RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600020
AGAINST JANET GREEN FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Janet Green, VI #0600020, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of November, 2006, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Janet Green, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
back to the Department of Planning Services to allow adequate time for the property owner to
submit an application for a new Demolition Permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that VI#0600020 be,and hereby is, referred back to the Department of Planning
Services to allow adequate time for the property owner to submit a new Demolition Permit to bring
the subject property into compliance.

RECOMMENDATION

Dear Ms. Green:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on November 14,2006,at 10:00 a.m., to consider
the violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article Ill, Div 1 "A (Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.A "Structures for storage of equipment and agricultural products.
Converted, partially dismantled, modified, altered or refurbished Mobile Homes or
Manufactured Structures shall not be utilized as an Agriculturally Exempt Building or for the
storage of equipment or agricultural products."
Section 23-3-30.8 "Buildings for confinement or protection of Livestock, within the
limitations defined in Section 23-3-50 below. Converted, partially dismantled, modified,
altered or refurbished Mobile Homes or Manufactured Structures shall not be utilized as an
Agriculturally Exempt Building or for the storage of equipment or agricultural products."
Section 23-3-30.F "Mobile homes subject to the additional requirements of Article IV,
Division 3 of this Chapter."
To bring the property into compliance:
While I have noted that you have been making progress, I feel that an additional extension
would not be consistent with how I have dealt with similar situations. Therefore, any
additional extensions must come from the Board of County Commissioners. Staff would
support a request from you to the Board for a small time extension (90 days or less), but
the request must come from you.

This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary .
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any

Based upon our telephone conversation, it is my understanding that your brother will be
completing and submitting a building permit application in order to combine this mobile home
to another mobile home and it will all be converted into 1 (one)dwelling unit. This letter will
continue this violation for 60 days to allow adequate time for a building permit application to
be submitted to this office.

It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 60 (sixty) days from
February 27, 2006, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

explained above,the Weld County Code strictly prohibits this type of use. In fact, it has been
brought to my attention that this past fall, someone claiming to be"Janet Green"called and
had a discussion with a planner when this was initially explained.

To Weld County Commissioners:
I went into the office of the Weld County Planning Board on the 7th of Oct. and asked for
a extension on my work permit because of a injury doing the tear down of my double
wide trailer. The woman at the desk handed me a paper and told me to write a note
addressing the issue and they would call me. I wrote and gave her the note and I gave her
my home phone and cell phone and let her know I would be in Greeley at least till 1 PM.
In case someone needed me to come back in. I did not hear from the planning board until
I received a call the 1 s of Nov. informing me that I had a hearing with the county
commissioners. I asked for a letter regarding this and received the letter. Here is a copy
of the letter and also a letter from the doctor explaining the injury.
This double wide was bought by me from CDSI in Greeley. It was an office mobile. We
worked hard and put money into this for my daughter and her 5 children. When my
daughter moved on, I tried to sell the mobile but with no clear way since CDSI never
came up with the title,just the bill of sale.
When my brother in-law offered to help me make a garage out of the mobile, I figured
this would be good since he is a master carpenter and very organized. This is when the
county red tagged us. We had no idea we were doing anything wrong. This mobile has
been on my property for 15 years with all permits and regulations up to par with the
county. I was told no on garage, no on animal shelter, no on farm storage shed. I was
just told yes on tearing it done. Throwing away something I invested money and time in
is hard.
Most of the work is done. The lot will be cleared as soon as we can. This will still take
us some time. We are at least trying to clean and save the lumber.
My brother-in-law is the 72 year old man that is helping me. We are both seniors. We
have only our hammer and strength to do the work. It has been a hardship and burden on
both of us. We found out we can't move as fast as we did a few years ago.
This ordeal has cost me many sleepless nights and lots of expense that I couldn't afford.
Most of all it hurt a man that is a Good Samaritan. He made the mistake of hurrying to
try to meet the deadline on the permit.
I do hope you read this and understand the situation and grant an extension on time as
much as you can.

To bring the property into compliance:
While I have noted that you have been making progress, I feel that an additional extension
would not be consistent with how I have dealt with similar situations. Therefore, any
additional extensions must come from the Board of County Commissioners. Staff would
support a request from you to the Board for a small time extension (90 days or less), but
the request must come from you.

To Whom it may concern;
On 06/06/2006 Orville Campbell was working remodeling a home when the roof
collapsed pinning him in a seated position under the debris. Orville stated, "I was very
lucky it didn't hurt me any worse than it did, I was pinned in the seated position for
several minutes before I was able to move and free myself. My upper and mid back were
very stiff and sore, making it hard to breath and move." Orville Campbell was first
examined and treated at my office for these injuries on 07/19/2006; he was subsequently
treated a total of eight times between 07/19/2006 and present.
Diagnosis: 739.2 thoracic vertebra subluxation, 353.8 intercostal neuritis, 719.58 thoracic
spinal restriction of motion, 729.1 paravertebral myofascitis/myofibrositis,
Treatment at this office has consisted of Chiropractic treatment to include specific
manipulative correction of interosseous disrelationship with specific spinal adjustments,
specific joint mobilization, specific soft tissue mobilization, and intersegmental traction.
Prognosis: Because of a previous degenerative condition, the prognosis of Orville
Campbell is necessarily a guarded one. The injury that was sustained caused soft tissue
trauma to areas, which although not symptomatic, were not in good condition prior to the
accident. Therefore, it is my opinion that Orville Campbell, in all probability, will have a
tendency towards problems for the foreseeable future, which he would not have had if
this latest injury had not incurred. It is a common observation in cases such as this to
observe remissions and exacerbations for no apparent external reason. However, due to a
structural weakening of the thoracic spine, which was traumatically induced, Mr.
Campbell can anticipate future recurrence of pain in the thoracic spinal area from time to
