RE: RECONSIDER CONDITION OF APPROVAL FOR SUBDIVISION EXEMPTION #45 -
JAMES AND SALLY ORR ECKHARDT
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on May 16, 1977, the Board of County Commissioners approved Subdivision
Exemption#45, for property which is located in part of the S1/2 SE1/4 of Section 34, Township 5
North, Range 64 West of the 6th P.M.,Weld County,Colorado,to divide the property into parcels
estimated to be approximately 58 acres and 6 acres, respectively, and
WHEREAS,on June 1, 1977, the Board of County Commissioners approved Resolution
#770718, correcting Resolution #770719, for the above mentioned matter, and
WHEREAS,the request to the Board of County Commissioners for review of the Condition
of Approval for Subdivision Exemption#45 was submitted by James and Sally Orr Eckhardt,24205
Weld County Road 57, Kersey, Colorado 80644, and
WHEREAS,after reviewing the Planning staffs recommendations and hearing the testimony
presented,the Board determined that the Condition of Approval of Subdivision Exemption#45 shall
be deleted.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Condition of Approval for Subdivision Exemption#45,for property owned
by James and Sally Orr Eckhardt, be, and hereby is, deleted.

SUBJECT: Corrected SE-45
The applicants James and Sally Eckhardt are requesting the Board of County Commissioners
reconsider the condition of approval for corrected Subdivision Exemption #45 dated June 1,
1977 that states, "James Eckhardt and Sally Eckhardt desire to transfer 58.050 acres (Lot B of
SE-45) of said above-described track of land as a equalizer or reservoir site with the condition
that it is not to be utilized as a residential building site, as more fully set forth in Tract B
described as follows..."
