AUTHORIZING CHAIRMAN TO SIGN EASEMENT
WITH BLISS LATERAL COMPANY:
WHEREAS, the Bliss Lateral Company, a Colorado corporation, has requested
an easement and right of way to install, operate, maintain and repair the irrigation
ditch and diversion structures as now constructed in Section 4, Township 5 North
Range 65 West along County Road Number 54-A all in Weld County, Colorado, a copy of
which is attached and made a part of this resolution
WHEREAS, the Board believes it to be to the best interests of the county
to sign said permit.
BE IT RESOLVED, that the Board of County Commissioners, Weld County,
Colorado, do and hereby sign said agreement.
The above and foregoing resolution was on motion duly made and seconded,

KNOW ALL MEN BY THESE PRESENTS, that TIIE COUNTY OF WELD ACTING
BY AND THROUGH ITS BOARD OF COMMISSIONERS, herein called Grantor, hereby
grants and conveys unto THE BLISS LATERAL COMPANY, a Colorado corporation,
herein called Grantee, an easement and right of way to install, operate,
maintain and repair the irrigation ditch and diversion structures of the
grantee in, upon and along the borrow ditch of the county road and under said
road as now constructed on the east line of Section 4, Township 5 North,
Range 65 West of the 6th P.M. , in Weld County, Colorado, the line of said
right of way for said irrigation ditch being particularly described as follows:
Commencing at the northeast corner of Section 4,
Township 5 North, Range 65 West of the 6th Principal
Meridian, Weld County, Colorado; thence South along
the East line of said Section 4 a distance of 33.00
feet, more or less; thence West 30.00 feet, more or
less, to an irrigation diversion structure, said
structure being the true point of beginning; thence
South along the West borrow ditch of said County
Road a distance of 173.00 feet, more or less, to an
irrigation diversion structure; thence East across
said County Road 48.00 feet, more or less, to a point
in the East borrow ditch of said County Road; thence
South along the East borrow ditch of said County Road
a distance of 1450.00 feet, more or less, to a point
where said irrigation ditch leaves said Right-of-way,
said point being the point of termination of said
irrigation ditch's use of the borrow ditch of said •
County Road.
The right of way hereby granted is and shall always he of sufficient
width to allow proper operation, maintenance and repair of said ditch and
diversion structures.
There is attached hereto and made a part hereof by this reference a
plat prepared by Nelson, Haley, Patterson and Quirk, Engineering Consultants
of. Greeley, Colorado, dated May 16, 1964, showing the line of the right of way
hereby granted to the grantee for said irrigation ditch and structures.
This right of way is granted for the reason that in the construction
of the County Road along the east line of said Section 4 the irrigation ditch
of the grantee as the same existed along the east line of said Section 4
prior to the construction of said road by the grantor was obliterated and this
right of way is granted for the replacement of said ditch.
Dated and signed at Greeley, Colorado, this 10th day of November
1964.

Commencing at the SE corner of said Sec 4, Twn N. , Rge 65 W;

The descriptions of the two parcels required for the County Road from
Mr. Sheller and Mrs. Purdy are enclosed.
I have talked with Mr. Sheller and with Mr. Herbert Purdy about these
parcels and there seem to be no problems involved.
It should be pointed out to Mr. Sheller and Mr. Purdy that if and/or
when they desire to subdivide their land, the County will require them
to quit-claim a fifty foot right-of-way on either side of the section
line. They may decide to do this now.

On motion duly made and seconded, it was
RESOLVED, By th4 Board ofCounty Commissioners of
Weld County, Colorado that the agreement hereto attached and made
a part of this resolution.be signed by the members of the Board
on behalf of Weld County, Colorado.
The resolution was unanimously adotped and so
ordered.

AGREEMENT
THIS AGREEMENT , made at Greeley, Colorado this
.. O--day of December, A. D. 1940 by and between THE BOARD
- OF--COUNTY COMMISSIONERS-of-Weld County, Colorado, .herein-_
after called first party, and C. E. McCOY, hereinafter call-
ed second party, WITNESSETH:
WHEREAS, Weld County desires to widen the road along
the West side of the Southwest Quarter (SW ) of Section
'.!;verity-trro (' ) , in Township Six (6) , North of Range Sixty-
five (65) , West of the Sixth (6th) Principal Meridian, and
WHEREAS, The Pleasant Valley Extension Ditch Company
now has a right of way for a ditch over and along the portion
desired to be included in the road,
NOW, THEREFORE, in consideration of mutual promises
and other considerations herein expressed,
TT IS AGREED:
1. Second party will convey to Weld County a right
of way for a road over an additional strip of land 162 feet
in width, adjacent and adjoining on the East the present
road right of way.
2. First party will furnish the material and will
build, at its expense , a new fence of three wires , with
- steel posts , one :rod apart, on the East boundary line of
the new road right of way.
3. First party will then construct a new ditch,
of the capacity equal to the present ditch, upon and within
' the lands of second party as nearly as practicable along the
East boundary line of the road, and in doing so will build

a measuring flume in accordance with the direction of the
said ditch company at the North side of said quarter sec-
tion and another, Sixty (60) rods South of the North side
of' the said quarter section, and a third at the South side
of—the said--quarter- section. I _
IN WITNESS 1WIEREOF, first party has caused this
agreement to be signed, pursuant to a resolution of the
Board of County Commissioners , and second party has here-
unto signed his name as of the day and year first above
written.
