J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jenny Luna Assistant County Attorney, Cyndy Giauque Planning Department representative, Brad Mueller Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 20, 2006, and duly published October 25, 2006, in the Fort Lupton Press,a public hearing was conducted to consider the request of Eastman Kodak Company and Broe Land Acquisitions II, LLC, c/o Great Western Oil and Gas Company, LLC,for a Site Specific Development Plan and Use by Special Review Permit#1571 for an Oil and Gas Production Facility(ten (10)oil and gas wells and two(2)tank batteries) in the I-1 (Industrial) Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record. Brad Mueller, Department of Planning Services,presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the site is located within the vicinity of Kodak facility, east of the Town of Windsor. He stated portions of the site are located within the floodplain; however, no portions are located within the floodway. He further stated approximately one-third of the surrounding parcels are currently developed, and he displayed photographs of the site. Char Davis, Department of Public Health and Environment, stated the site will be required to utilize portable toilets and to provide bottled water for employees. She stated a Dust Abatement Plan is required, and within 45 days of production, an Emissions Permit application must be submitted to the Air Pollution Control Division of the Colorado Department of Public Health and Environment. Don Carroll, Department of Public Works, stated the site may be accessed from Weld County Road 66, also known as Eastman Park Drive, which has been annexed by the Town of Windsor. He stated the site may also be accessed from State Highway 257, on the eastern boundary of the property. He further stated the applicant is required to obtain the appropriate permits for overweight vehicles, which is addressed in Development Standard #14. 2006-2940 PL1859 �(' .' /3L, /7 / //L //-a�,o� HEARING CERTIFICATION-EASTMAN KODAKCOMPANYAND BROE LAND ACQUISITIONS II, LLC, C/O GREAT WESTERN OIL AND GAS COMPANY, LLC (USR #1571) PAGE 2 William G.Crews,CPL, represented the applicant, and stated this application is a part of the series of applications occurring on the Kodak property. He stated directional drilling will be completed from two pads, and two alternate tank battery facilities will be utilized for all ten wells. In response to Commissioner Masden, Mr. Crews stated three tanks will be utilized per battery,and the tanks will not be low profile due to the industrial nature of the area. He further stated vapor recovery systems will be set up on the wells and batteries, and the combusters will be utilized. In response to Commissioner Masden, Jeff Reale, represented the applicant, and stated the combusters will remain on the tank batteries as long as the wells are producing. Responding to Commissioner Jerke, Mr. Crews stated five wells is the maximum number allowed to be drilled at this time. He stated the Town of Windsor lobbied and requested the Colorado Oil and Gas Conservation Commission to not approve high density drilling. He further stated should additional wells be permitted in the future, the applicant would be allowed to conduct additional directional drilling. In response to Chair Geile, Mr. Crews stated he and the applicant have reviewed and concur with the Conditions of Approval and Development Standards as proposed. No public testimony was offered concerning this matter. Commissioner Jerke moved to approve the request of Eastman Kodak Company and Broe Land Acquisitions II, LLC,do Great Western Oil and Gas Company, LLC,for a Site Specific Development Plan and Use by Special Review Permit#1571 for an Oil and Gas Production Facility(ten (10)oil and gas wells and two (2) tank batteries) in the I-1 (Industrial) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously.
