WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-lA(3) of the Weld County Subdivision Regulations. The parcel of land on which this request has been made is described as part of the S1 NE1, Section 16, T5N, R65W of the 6th P.M. , Weld County, Colorado. This property is adjacent to the city of Greeley on the north side of 24th Street. The property contains approximately 32.735 acres of Class I, II and III irrigated soils. The request is to split the property into parcels of 3.398 acres and 29.337 acres. The owners would like to split the 3.67 acre parcel from the large parcel in order that they may sell the small parcel and residence. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be approved for the follwing reasons: 1. The request is in compliance with the policies of the Weld County Comprehensive Plan in that to minimize con- flicting land uses, residential development will be encouraged to locate adjacent to existing towns and in accordance with the comprehensive plans and stated wishes of each community. The parcel of land is located adjacent to the incorporated boundaries of the city of Greeley and is located in the Comprehensive Plan Area of Greeley. The Greeley Planning Commission has set forth no objections to this request. 2. The property is no longer a viable or large enough to be a viable farming operation and located within 2 mile of Greeley Colorado. It is the desire of the present owners and the Trust to seperate Lot "A" containing approximately 3.67 acres from the existing property. Lot "A" contains buildings and improve- ments on said property and is no longer of interest to the sellers as they have aquired a ranch in Wyoming. 2.
