HomeMy WebLinkAbout20061621.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JORGE CONTRERAS FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jorge Contreras, VI #0600100, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of May, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation,at which time this matter was continued to June 20, 2006, to allow adequate time for the property owner to relocate the business or reduce the number of animals, and WHEREAS, on the 20th day of June, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS,Jorge Contreras was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 20, 2006, to allow adequate time for the property owner to relocate, or submit a Use by Special Review application to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. April 28, 2006 New representative called and said he would be assisting Mr. Contreras through the application process. He said that he felt 60 days is a sufficient amount of time to submit his USR or possibly relocate. I understand that an extension had been requested and as I stated to Mr. Godsey, I am unable to grant that at this time. I have received several complaints throughout the last week that additional calves have been brought onto the property prior to the submittal of your application. In order to be sensitive to both sides your request will need to made to the Board of County Commissioners through a violation hearing.Should you submit your application by May 8, 2006 the hearings will be canceled and your name removed from the docket. This hearing will take place in -Hearing Room, located at 918 10th Stree reeley, Colorado. It is recommended that you or a r_r,esentative be in attendance to answer any questions the Board of County Commissioners might have about the violations. Unfortunately, at this time we are unable to grant this request. I have had several more complaints come in throughout the week that Mr. Contreras has continued to bring more calves onto the property prior to the submittal, let alone approval, of his USR application. To be sensitive to both sides your request will need to made through a violation hearing that will be held at 10:00am May 9, 2006. This hearing will take place before the Board of County Commissioners. Typically, additional time is granted by referring the case to the County Attorney's office but delaying any legal action for a period of 30 or perhaps even 60 days.
