RESOLUTION RE: ACTION OF THE BOARD CONCERNING PETITIONFOR ABATEMENT OR REFUND OF TAXES - RANDY LOFQUIST/ MEAD FARM, LLC WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners of Weld County,State of Colorado, at a duly and lawfully called regular meeting held on the 5th day of April,2006, at which meeting there were present the following members: Chair M. As we have discussed, in 2003, the property was reclassified by the Assessor's Office from Agricultural to Commercial and accordingly, Mead Farms was assessed as commercial property for tax years 2003 and 2004. We have paid such higher rate of tax. The property is also currently classified as commercial property for tax year 2005. We understand that the property was reclassified as the result of Assessor's office periodic observation of the property in 2003. Apparently, the Assessor could not observe any evidence of farming/agricultural activity on the property in 2003. P106 In 2003, we had little farming activity because of extremely dry conditions and the fact that the farming cycle was changed from a spring crop to a fall crop. However, more productive farming activity resumed on the property in 2004. Therefore, we are requesting that the property be reclassified to Agricultural for the year 2003 and 2004 and a refund of real estate taxes be issued accordingly. We are also requesting that the property be reclassified as agricultural for 2005. Please be advised that we sold the property in June of 2005 and we do not control the use following our disposition, but during our ownership of the property, we clearly operated it for agricultural purposes.
