HEARING CERTIFICATION DOCKET NO. 2006-07A RE: CHANGE OF ZONE, CZ #1104, FROM THE R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT TO THE A(AGRICULTURAL)ZONE DISTRICT-JAY AND SHERRIE WOODS A public hearing was conducted on February 15, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Brad Mueller Health Department representative, Pam Smith Public Works representative, Peter Schei The following business was transacted: I hereby certify that pursuant to a notice dated January 12, 2006, and duly published January 18, 2006, in the Fort Lupton Press, a public hearing was conducted on February 1, 2006, to consider the request of Jay and Sherrie Woods for a Change of Zone, CZ #1104, from the R-1 (Low Density Residential) Zone District to the A (Agricultural) Zone District. At said hearing, the Board deemed it advisable to continue said matter to February 15, 2006, to allow Planning Services staff additional time to post a notification sign on the subject site. On February 15, 2006, Lee Morrison,Assistant County Attorney, made this a matter of record. Brad Mueller, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site and surrounding land uses. He stated the property is currently in violation of the Weld County Zoning regulations, and the Board of Commissioners considered the matter on August 9, 2005, at which time it was deemed advisable to delay legal action and allow the applicant time to complete the necessary permitting processes. Mr. Mueller reviewed the criteria for approval, as cited in the Planning Commission Resolution of Recommendation. He stated thirteen referral agencies reviewed this proposal, and ten responded favorably or provided comments that have been addressed in the Conditions of Approval and Development Standards. Chair Geile advised Jay Woods, applicant,that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr. Woods indicated he would like to proceed today. In response to Commissioner Jerke, Mr. Mueller concurred future construction will be subject to the various fees referenced in paragraph #2.e.1; however, existing structures will not be assessed a fee. 2006-0049 PL1820 610 C P1_,/01.0, , O3-Ds'-re—, HEARING CERTIFICATION - JAY AND SHERRIE WOODS (COZ#1104) PAGE 2 Pam Smith, Department of Public Health and Environment, stated the existing house is serviced by a septic system; however, it is not documented due to its age. She stated Condition of Approval#5 requires the applicant to obtain a current septic permit,and staff remaining issues are addressed in the Conditions of Approval and Development Standards. Peter Schei, Department of Public Works,stated the site is located between two local streets,and staff is requiring the applicant close the existing access located near the three-way intersection and utilize the access on the west end of the northern property line. In response to Chair Geile, Mr.Woods stated he has reviewed and concurs with the Conditions of Approval and Development Standards,as proposed and modified. No public testimony was offered concerning this matter. Commissioner Vaad moved to approved the request of Jay and Sherrie Woods for a Change of Zone, CZ#1104,from the R-1 (Low Density Residential)Zone District to the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Comm issionerJerke,and it carried unanimously.
