HomeMy WebLinkAbout20062433 HEARING CERTIFICATION DOCKET NO. 2006-54.A RE: SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN, PF #521, FOR 19 LOTS WITH E (ESTATE) ZONE USES, ALONG WITH 15 ACRES OF OPEN SPACE, IN ADDITION TO 36 ACRES OF OPEN SPACE AND EQUESTRIAN USES LOCATED ON TRACT A - DON AND LINDA OWENS A public hearing was conducted on September 27, 2006,at 10:00 a.m.,with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jenny Luna County Attorney, Bruce Barker Planning Department representative, Kim Ogle The following business was transacted: I hereby certify that pursuant to a notice dated August 11,2006,and duly published August 16,2006, in the Fort Lupton Press, a public hearing was conducted on August 30, 2006, to consider the request of Don and Linda Owens for a Site Specific Development Plan and Planned Unit Development Final Plan, PF#521,for 19 lots with E(Estate)Zone uses,along with 15 acres of open space, in addition to 36 acres of open space and equestrian uses located on Tract A. At said hearing,the Board deemed it advisable to continue the matter to September27,2006,to allow the applicants adequate time to address various issues of concern regarding drainage, road maintenance, submittal of a letter regarding maintenance of septic systems, and status of the Annexation Agreement with the Town of Firestone. On September 27,2006, Bruce Barker,County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, stated an e-mail was received from Sean Phipps, of Pickett Engineering, the applicant's engineering firm, requesting additional time to address issues concerning stormwater runoff, an easement,and the revised Final Drainage Report. He stated a meeting will occur on October 6, 2006, and time for review will be needed by the Department of Public Works. Mr. Ogle suggested the matter be continued to November 1, 2006, at 10:00 a.m. Sean Phipps, Pickett Engineering, represented the applicant and stated he has requested a continuance to ensure that all issues are resolved prior to a hearing before the Board. He stated progress has been made with the irrigation company, and he is working to secure access and drainage easements. No public testimony was offered concerning this matter. Commissioner Vaad moved to continue the request of Don and Linda Owens for a Site Specific Development Plan and Planned Unit Development Final Plan, PF#521,for 19 lots with E(Estate) Zone uses, along with 15 acres of open space, in addition to 36 acres of open space and equestrian 2006-2433 PL1734 HEARING CERTIFICATION - DON AND LINDA OWENS (PF #521) PAGE 2 uses located on Tract A, to November 1, 2006, at 10:00 a.m. The motion was seconded by Commissioner Masden,and it carried unanimously. There being no further discussion,the hearing was completed at 10:20 a.m. This Certification was approved on the 2nd day of October 2006.
