HEARING CERTIFICATION DOCKET NO. 2006-19 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1541 FOR OIL AND GAS PRODUCTION FACILITIES IN THE I-1 (INDUSTRIAL) ZONE DISTRICT- GREAT WESTERN OIL AND GAS COMPANY A public hearing was conducted on March 29, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tern - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 10,2006,and duly published March 15,2006, in the Fort Lupton Press,a public hearing was conducted to consider the request of Great Western Oil and Gas Company for a Site Specific Development Plan and Use by Special Review Permit#1541 for Oil and Gas Production Facilities in the I-1 (Industrial)Zone District. Bruce Barker, County Attorney, made this a matter of record, and advised the applicant's representative, Bill Crews,that he has the option of continuing this matter to a date when the full Board will be present. However,if he decides to proceed today, itwill require three affirmative votes,or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr. Crews indicated he would like to proceed today. Chris Gathman,Department of Planning Services,presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site and surrounding land uses. He stated there is an existing tank battery,and the applicant is proposing to do directional drilling and place the associated equipment on the site. Mr.Gathman stated there is an existing access from Weld County Road 23, and he submitted letters from the applicant,marked Exhibits G,H,and I. He displayed photographs of the site and surrounding area,and explained Conditions of Approval#1.B,#1.C and#1.D have been addressed and can be deleted. In response to Commissioner Vaad, Mr.Gathman stated the applicant will directional drill from the existing equipment,and the proposed facilities will be located near the existing equipment. Char Davis, Department of Public Health and Environment,stated the information provided by the applicant for the Air Quality Permit appears to be adequate. She stated the applicant will provide portable toilets and bottled water during the construction phase of the project,which is addressed in Development Standards#10 and#13. Responding to Commissioner Vaad,Ms.Davis stated the Early Action Compact will need to be addressed by the applicant. 2006-1022 J PL1828 Cr r. et, itc) I9L`kEP) ©1//-/7-0V HEARING CERTIFICATION - GREAT WESTERN OIL AND GAS COMPANY (USR #1541) PAGE 2 Donald Carroll, Department of Public Works,stated there is an existing access from Weld County Road 23, and the applicant must obtain the overweight permits before moving in oil and gas rigs. William G.Crews,CPL,represented the applicant and stated the wells were scheduled to be drilled and operations commenced before the applicant realized a Use by Special Review Permit was necessary. Responding to Commissioner Vaad's earlier question, Mr.Crews stated the applicant does have the necessary Air Pollution Emissions Notice (APEN) permits. He stated there is a combustor on the site which takes the volatile organic hydrocarbons from the tank and burns them in a special piece of equipment. In response to Chair Geile, Mr.Crews stated he and the applicant have reviewed and concur with the Conditions of Approval and Development Standards as proposed and modified. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Great Western Oil and Gas Company for a Site Specific Development Plan and Use by Special Review Permit #1541 for Oil and Gas Production Facilities in the I-1 (Industrial) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Conditions of Approval #1.B,#1.C,and#1.D,and relettering as appropriate.The motion was seconded by Commissioner Masden,and it carried unanimously. There being no further discussion,the hearing was completed at 10:15 a.m. This Certification was approved on the 29th day of March 2006.
