RE: APPROVAL OF RECORDED EXEMPTION NO. 517 - IVAN AND JOAN GREIN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 30th day of September, 1981 in the Chambers of
the Board that the division into two parcels of land as shown
on the plat known as Recorded Exemption No. 517, being the
property of Ivan and Joan Grein, described as part of the
Southwest Quarter of Section 34, Township 1 North, Range 66 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described on the attached plat whidhis incorporated herein
by reference and made a part hereof, and said parcel does not
come within the purview of the definition of the terms, "subdivision"
and "subdivided land" , pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners finds that this
particular division of land is not within the purposes of the
Weld County Subdivision Regulations and the Board desires to
exempt this particular division of land from the definitions of
"subdivision" and "subdivided land" pursuant to its authority
under Colorado statutes and Section 2-lA (3) of the Weld County
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by Ivan and Joan Grein be, and hereby is, exempt from the
definition of the terms "subdivision" and "subdivided land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 30th
day of September, A.D. , 1981.

Dear Commissioners:
The attached application, plat and related items are in reference to a
recorded exemption request from Ivan and Joan Grein. The parcel of
land on which this request has been made is described as part of the
SW1, Section 34, T1N, R66W of the 6th P.M. , Weld County, Colorado.
This property is located approximately three miles east of Brighton.
The property contains approximately 160 acres of Class II, III, IV
and VI irrigated soils and Class IV and VI nonirrigated soils. The
request is to split the property into pracels of 1.0 acres and 159
acres, more or less.
The applicant wishes to dispose of a mobile home and replace with a
modular home. This home will be used by Mr. Grein's son, Kevin, who
works in the farm operation. Based on the submitted information and
policies of the County, the Department of Planning Service's staff
recommends the request be approved for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld
County Subdivision Regulations (intent clause) , Section
31.1 of the Weld County Zoning Ordinance (agricultural
district intent clause) and the Weld County Comprehensive
Plan. The requested split would not remove any land from
agricultural production;
2. The primary agricultural use will continue. There is no
apparent encroachment of incompatible uses intended for
this area;
3. The request complies with Section 9-4 A. of the Weld County
Subdivision Regulations.
