USE BY SPECIAL REVIEW(USR) QUESTIONAIRE

1.) The proposed use of the property is to allow two(2) existing, single-family residences on an agricultural
(A) zoned property. Having two, single-family residences on one legal lot is in violation of the Weld
County Code. This USR permit will bring this property into compliance.
2.) This use by special review is proposing the use of two residences on one parcel of land. The current
usage of this site for residential/Agricultural purposes is consistent with the Weld County Code,
Section 22-2-60-A.1. which outlines the conservation of agricultural lands for agricultural purposes.
The use of one lot for two existing residences will not alter the current use of the land for agriculture.
3.) This use by special review is proposing the use of two residences on one parcel of land. The current
usage of this site for residential/Agricultural purposes is NOT consistent with the Weld County Code,
Chapter 23 (Zoning), or the zone district in which it is located. The use of Two(2) single-family
dwelling units on one legal lot violates the Weld County Code(as listed below):
- Sec. 23-I-40.A. encouraging the most appropriate USE of land.
- Sec. 23-1-40 B. protect the public health, safety and welfare.
- Sec.23-3-20.A. One(1) Single-family dwelling unit ... per Legal Lot
4.) The surrounding properties are used as Residential/Agricultural sites. The proposed use will be
consistent with the surrounding uses as this property will remain a Residential/Agricultural site.
5.) a. There will be two single-family residences in use of this property. The eastern house will be
leased to a maximum of three (3) people, whereas the western house will remain the applicants
residence.
b. Not Applicable. There are no employees in use of this site as the property is not for commercial
use.
c. Not Applicable. There are no defined hours of operation as the property is not for commercial
use.
d. There are no new structures proposed at this time.
e. Not Applicable. There are no animals on the subject property.
f. Domestic vehicles will be used on a daily basis.
g. The parcel is within the Fort Lupton Fire Protection District.
h. This property uses a Well for its water source. Evidence of use is included herein.
i. This property uses an individual septic system. Evidence of use is included herein.
j. Not Applicable. There is no storage or warehousing proposed for this property; However,the
eastern house has been previously used as storage.
6.) Not applicable. This site will continue as a Residential /Agricultural site,therefore a Landscape plan
map is not required.
7.) Not applicable. This site was previously proposed as a recorded exemption (RE No. 1467-15-4
RE3636) in November 2003. Planner Chris Gathman explained the conditions of approval in a letter to
Alvin R. Brand Jr. with a hearing date of November 12, 2003 (included herein). Considering these
conditions, it is in the best interest of the client to submit an application for this Use by Special Review.
8.) Not Applicable. There are no plans for the development of storm drainage facilities.
9.) Not Applicable. There will be no new construction on the property.
10.)Not Applicable. No storage and/or stockpile of wastes will occurs on this property as it is not for
commercial use.
