AND STORAGE OF LANDSCAPE MATERIALS) IN THE A (AGRICULTURAL) ZONE
DISTRICT - SCOTT DEEMER
A public hearing was conducted on December 13, 2006,at 10:00 a.m.,with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 22, 2006, and duly published
November 29, 2006, in the Fort Lupton Press, a public hearing was conducted to consider the
request of Scott Deemer for a Site Specific Development Plan and Use by Special Review
Permit#1576 for Uses Permitted as a Use by Right,Accessory Use, or Use by Special Review in
the Commercial or Industrial Zone Districts (office and storage of landscape materials) in the
A(Agricultural)Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of
record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the
proposal, entered the favorable recommendation of the Planning Commission into the record as
written, and gave a brief description of the location of the site and surrounding land uses. She
stated the existing structure will be converted for office use, and the landscaping materials will be
screened and stored in the rear of the property. Ms. Hatch stated the site will be serviced by the Left
Hand Water District and an individual sewage disposal system. She stated the site is bordered by
the New Consolidated Lower Boulder Ditch on the east,and although the property is not within any
Intergovernmental Agreement (IGA) area, it is within the three-mile referral area for the City of
Dacono, the Towns of Erie and Frederick, and Boulder County. She stated the Town of Erie
indicated no objections,and the City of Dacono and Boulder County did not respond. However,the
Town of Frederick indicated the site is within its planning area and annexation will be required upon
contiguity. She further stated, in-lieu of annexation, the Town of Frederick is requesting the
application comply with its standards; however, there is no IGA requiring the applicant to do so.
Ms. Hatch stated the outdoor storage and parking will be screened by a six-foot wooden fence,and
staff supports the proposed Screening Plan.

Char Davis, Department of Public Health and Environment, stated the site will be serviced by the
Left Hand Water District, and the septic system for the home has been evaluated and permitted.
Don Carroll, Department of Public Works,stated the Carmacar Subdivision is located to the south,
Highland Farms is to the southwest, and the site will be accessed from State Highway 52. In
response to Commissioner Jerke, Mr. Carroll stated the site has an existing access.
Anne Best-Johnson,Todd Hodges Design, LLC,represented the applicant and complimented Weld
County staff for working with the applicant to complete many of the Conditions of Approval prior to
the hearing before the Board. She stated the applicant has also been working with referral agencies
to meet many of their concerns as well. Responding to Chair Geile, Ms. Johnson stated she and
the applicant have reviewed, and concur with, the Conditions of Approval and Development
Standards.
No public testimony was offered concerning this matter. Ms. Davis stated all of the Health
requirements prior to recording have been met.
Commissioner Long moved to approve the request of Scott Deemer for a Site Specific
Development Plan and Use by Special Review Permit#1576 for Uses Permitted as a Use by Right,
Accessory Use,or Use by Special Review in the Commercial or Industrial Zone Districts(office and
storage of landscape materials)in the A(Agricultural)Zone District,based on the recommendations
of Planning staff and the Planning Commission,with the Conditions of Approval and Development
Standards as entered into the record. The motion was seconded by Commissioner Jerke, and it
carried unanimously. There being no further discussion,the hearing was completed at 11:15 a.m.
This Certification was approved on the 18th day of December 2006.
