Primarily, the Ditch Company is concerned with the preservation of the timing, amount and quality of water to be carried in the Western Mutual Ditch. Because of its proximity to the ditch, it is essential that this development does not cause an increase or decrease in the amount of water that will flow into the ditch, alter the timing of return/storm water runoff into the Ditch, or degrade the quality of water carried in the Ditch. Based on the Site Plans you provided, the possibility that the quantity or quality of the water could be changed is very real, considering the fact this property will no longer be cultivated farm ground and it appears that more than one home site will be developed. Second, the Ditch Company is concerned with the increase in the amount of trash and debris that will be generated on the property in connection with the development of the property. If not properly controlled on the property, much of this trash could end up accumulating in the Ditch. This will place an increased cost on the shareholders of the Ditch as they may be forced to pay additional assessments to have the Ditch cleaned on a more frequent basis. In addition, it could disrupt the ability of the Company to provide water to its shareholders if the water must be shut down in order to clean the Ditch. The Ditch Company's position is that the developer should be responsible for these potential damages and increased costs associated with their proposed new uses and should attempt to mitigate them to reduce the possibility of damaging the Ditch Company and its shareholders. If this Recorded Dxemption is recorded and approved, the County should include terms which place the burden on the developer to prevent and/or mitigate these harmful effects. Nothing herein shall be deemed as a waiver of the Ditch Company's rights should any actions or inactions associated with the development and/or actions or inactions by the developers/owners/operators/visitors/agents/licensees/invitees/assigns of the development injure the Ditch Company.
