RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1551
FOR AN OIL AND GAS PRODUCTION FACILITY (EIGHT OIL AND GAS WELLS AND
ONE TANK BATTERY) IN THE I-1 (INDUSTRIAL)ZONE DISTRICT-GREAT WESTERN
OIL AND GAS COMPANY, LLC
A public hearing was conducted on July 12, 2006, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 2,2006,and duly published June 7,2006,in the
Fort Lupton Press, a public hearing was conducted on June 21, 2006, to consider the request of
Great Western Oil and Gas Company, LLC, for a Site Specific Development Plan and Use by
Special Review Permit#1551 for an Oil and Gas Production Facility(eight oil and gas wells and one
tank battery) in the I-1 (Industrial) Zone District, at which time the Board deemed it advisable to
continue the matter to July 12, 2006, to allow additional time for sign posting. On July 12, 2006,
Cyndy Giauque,Assistant County Attorney,made this a matter of record. Brad Mueller,Department
of Planning Services, presented a brief summary of the proposal, entered the favorable
recommendation of the Planning Commission into the record as written,and gave a brief description
of the location of the site within the Eastman Kodak facility. He stated eleven referral agencies
reviewed the proposal, and nine responded favorably or provided comments which have been
addressed in the Conditions of Approval and Development Standards.
Char Davis, Department of Public Health and Environment,stated the Air Pollution and Emissions
Notice (A.P.E.N.) needs to be submitted as soon as it is obtained. She stated, during the
construction phase of the project, the applicant needs to provide portable toilets, hand washing
stations, and bottled water. In response to Commissioner Vaad, Ms. Davis stated the A.P.E.N. is
particularly important in this area due to the ozone problem.
Donald Carroll, Department of Public Works, stated the site will be accessed from Weld County
Road 66, also known as Eastman Park Drive, which has been annexed by the Town of Windsor.
He stated the Department of Public Works is requesting the applicant obtain the appropriate permits
prior to moving heavy rigs and equipment.

Bill Crews,Crews and Zeren,LLC,represented the applicant and stated the Town of Windsor does
not have a formal permit process, therefore, he is allowed to submit a letter from the Colorado Oil
and Gas Conservation Commission (COGCC) as evidence that the applicant is aware of the
requirements. He further stated the application indicates a request forfive wells,or as many as may
be allowed in the future. He explained Township 6 North, Range 67 West,was exempted from the
overall COGCC order allowing eight wells per quarter section,due to complaints raised by the Town
of Windsor. Therefore, if, in the future, the COGCC approves the Township as one in which the
eight-well density is allowed,the applicant will not be required to submit an amended Use by Special
Review Permit through the County. Mr. Crews proceeded to explain the process for determining
the drilling locations within the 20-acre drill sites, and noted it will be difficult to show the drill
envelopes on the plat,since they are not certain which wellhead will be drilled first. In response to
Mr. Crews, Ms. Davis stated she understands the criteria and delay in applying and obtaining an
A.P.E.N. Mr.Crews explained an A.P.E.N.cannot be obtained until a well is drilled and completed,
therefore, including the requirement for an A.P.E.N. as a Condition prior to recording the plat is a
concern. Following discussion, Mr. Mueller suggested Condition #1.A be moved under a new
Condition of Approval#3 to state,"Within 90 days after construction of the tank battery:" In response
to Mr.Crews, Mr. Mueller proposed adding the following to the end of the Condition,"An extension
can be granted by agreement from the Departments of Planning Services and Public Health and
Environment." Responding to Chair Geile, Mr. Crews stated he and the applicant have reviewed
and concur with the Conditions of Approval and Development Standards as proposed and modified.
No public testimony was offered concerning this matter.
Commissioner Vaad moved to approve the request of Great Western Oil and Gas Company, LLC,
for a Site Specific Development Plan and Use by Special Review Permit#1551 for an Oil and Gas
Production Facility(eight oil and gas wells and one tank battery)in the I-1 (Industrial)Zone District,
with the Conditions of Approval and Development Standards as entered into the record. His motion
included the relocation of Condition of Approval#1.A under a new Condition#3 titled"Within 90 days
after construction of the tank battery:"and to add,"An extension can be granted by agreement from
the Departments of Planning Services and Public Health and Environment,"to the end of the text.
The motion was seconded by Commissioner Long, and it carried unanimously. There being no
further discussion, the hearing was completed at 10:20 a.m.
