Our concerns are as follows: 1. If the building is built on the north side of the existing building will the drainage pit(for containing run-off) be filled in or moved and how will this affect our property from flooding? 2. Will the structure be properly built to contain an accidental explosion or control the direction of the force of the explosion? To put in another metal building like the existing ones the entry access will be easy to do with the equipment that is stored on the property. Thank you. ("Excell") relating to an application that Excell has filed with Weld County for a use by special review ("Application") for nine acres of land in the NW/4 of Section 29, Township 1 North, Range 66 West in Weld County (hereinafter referred to as the "Property") and a hearing that is currently scheduled in Weld County on August 15, 2006. Anadarko Land owns all of the coal that underlies the Property. This letter constitutes a waiver by Anadarko Land as a mineral interest owner to having received timely notice of a hearing scheduled on August 15, 2006 in Weld County pursuant to Colorado Revised Statutes §§ 24-65.5-103, 30-28-133, and 31-23-215 ("Notice") under terms and circumstances set forth in this letter as follows: Anadarko Land agrees to waive timely notice pursuant to C.R.S. § 24-65.5-102(2) of the August 15, 2006 hearing. Notice is waived only to the extent that the Application applies to the Property so that Notice is not waived to the extent the Application or subsequent applications for development include property for which Anadarko Land or Anadarko E&P Company LP, a company affiliated with Anadarko Land, owns minerals other than the Property.
