SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL
REVIEW (USR) QUESTIONNAIRE
The following questions are to be answered and submitted as part of the USR application. If a question
does not pertain to your use, please respond with "not applicable", with an explanation as to why the
question is not applicable.
1. Explain, in detail, the proposed use of the property.
A 448 cubic foot portable manufactured structure and a 1920 cubic foot portable, and
immobilized semitrailer will be placed on a small portion of land currently used for storage by
the farmer/owner of the property. The portable and immobilized structures will be used for
storage of explosives, specifically fireworks.
The owner of the property will remain David Rippe, a Weld County farmer. The property under
consideration is small and not suited for planting with modern machinery due to erosion.
Grazing around the small parcel is currently possible and will not be hindered or changed by the
proposed use.
The fifty-eight (58) feet by one hundred twenty (120) feet piece of property will be the location
of an eight (8) feet by seven (7) feet by eight(8)feet Bureau of Alcohol, Tobacco, Firearms and
Explosives (ATF) approved portable (skid) Type 2 explosives storage magazine which is a
manufactured structure. The Type 2 magazine will be centered on the southern portion of the
property on an eighteen (18) feet by eight(8)feet concrete pad. The Type 4 eight (8) feet by
eight(8) feet by thirty (30) feet ATF approved immobilized semitrailer will be located on the
northeast end of the property.
A maximum one thousand two hundred (1200) pounds of fireworks can be legally stored in the
Type 4 magazine and a maximum five thousand (5000) pounds of fireworks (exclusive of bulk
salutes) can be legally stored in the larger Type 2 magazine once an ATF license is obtained.
(The ATF license is dependent on Weld County approval of the magazine site.) Both magazines
and the fireworks stored in them will be owned by and be the responsibility of Artistic Fire LLC.

Byron E. Nelson and Melba (Micki) McDanal are the owners/managers of Artistic Fire LLC.
Both are Colorado licensed Fireworks Display and Pyrotechnic Special Effects Operators and
certified Pyrotechnics Guild International (PGI) Fireworks Display Operator Safety Certification
Course instructors. Micki McDanal holds a Colorado CDL (Commercial Driver's License) with
a Hazardous Materials endorsement. She is also the secretary of the Rocky Mountain
Pyrotechnics Guild (RMPG). Byron Nelson is the president of the RMPG. The property owner,
David Rippe. is a member of RMPG.
The fireworks will be predominantly used by the RMPG, an educational and hobbyist Colorado
non-profit corporation and IRS approved 501c3 charitable organization. The fireworks are used
by RMPG in conjunction with fireworks crew, display operator, fire department personnel, and
hobbyist safety training classes. These classes are held once or twice yearly at the Homestead
Grange located near the proposed magazine location.
Artistic Fire LLC will store a small amount of articles pyrotechnic and fireworks for use in their
business specialty which is pyrotechnic special effects (proximate fireworks used indoors or
closer to audiences outdoors than normal display fireworks).
The one hundred twenty (120) feet by fifty-eight(58) feet piece of property will be fenced with 6
foot chain link and will be locked. (The chain link fence will be placed within an area already

fenced with barbed wire by the current owner/farmer.) The storage magazines will be double
locked with hooded, theft deterrent locks according to ATF regulations.
Access to the locked storage magazines will be limited to three (3) persons. They are Byron
Nelson, Micki and Steve McDanal.
Weekly checks to assure security of the magazines are required by ATF. The property
owner/farmer, David Rippe, agrees to doing these checks during normal farming duties.
Visits to the site for the purpose of delivering fireworks into storage or removing them prior to
use will occur approximately twenty (20) times per year. The most commonly used security
check and transport vehicle will be a pick up truck.
2. Explain how this proposal is consistent with the intent of the Weld County code, Chapter 22
(Comprehensive Plan).
Sec. 22-1-120. Comprehensive Plan guiding principles. (Can be interpreted as "the intent of
Weld County Code, Chapter 22 Comprehensive Plan.")
A. Private Property Rights . . . . ". . . . It is the goal of the Comprehensive Plan to express the
needs and vision of a developing county, while protecting individual property rights."
Individual property rights are protected by an agreement between the users and the
property owner that addresses respect for the property and the farming occurring on it and
by the fact that the magazines are portable structures that can be moved in order to
accommodate any changes desired in the future.
B. Respect for Agricultural Tradition . . . . "As these new land uses evolve, it is important that
the established agricultural businesses and associated infrastructures are allowed to
continue to operate without additional constraints."
The proposed use requires no changes in current farming practices. The portable
manufactured structure can be moved to allow continued agricultural business.
C. Fairness in the Land Use Change Procedure.
Not applicable as procedure is established by Weld County.
D. Recognition of the County's Diversity. . . . "Land use changes, therefore, must afford
flexibility based on the specific location and the particular circumstances encountered
within this locality."
The proposed use of this site allows the land owner to maximize the use of the land
without disrupting or changes the current and main agricultural use practices.
E. Regulations Addressing Land Use Changes.
Not applicable as regulations are established by Weld County.
F. Economic Prosperity.
The proposed use of this site allows the land owner to continue the current farming
business. It provides some extra income in the immediate area as persons attend training
sessions in the Homestead Grange Hall which is rented for this use. Some attendees and
the instruction staff purchase motel room stays, meals and gasoline from area merchants.
Fireworks are also purchased from another Weld County business.
Section 22-2-10 The way the land is presently used is one (1) of the most important
considerations in land use planning."
No changes will be made in the use of the land.
The land is now zoned as Agricultural.

The property being discussed is a small fenced portion of a section that has been used for
the storage of fencing and irrigation materials by the property owner/farmer. These
materials have been reorganized to create space for the fireworks storage magazines.
The surrounding parts of the section are planted and/or used for cattle grazing. No
changes in crop planting or cattle grazing will be made in order to place the magazines.
The magazines are portable structures (on skids) or to which wheels can be attached.
They can be removed.
Section 22-2-20 "Consideration of the impact of the various Overlay Districts shall be given to
lands under development consideration."

Not applicable as site is not located within an Airport Overlay District.

Not applicable as site is not located within a Geologic Hazard Overlay District.

Not applicable as the property is classed as Flood Plain C, minimal flooding, by the

Section 22-2-60 (Weld County Comprehensive Plan—Land Use Categories) states: "Allow
commercial and industrial uses, which are directly related to, or dependent upon agriculture, to
locate within the A (Agricultural) Zone District when the impact to surrounding properties is
minimal, and where adequate services and infrastructure are currently available or reasonably
obtainable."
Placement of explosive magazines has previously been allowed in Weld county agricultural
districts. The separation distances required from public roads and inhabited buildings preclude
magazine placements in urban settings. Fireworks businesses and hobbyists are dependent on
agricultural areas for storage magazine sites.
The impact of placing a magazine on this property is negligible for surrounding properties. No
access to surrounding properties is necessary, no waste or other materials will be stored. The
magazines are relatively small and unobtrusive. Absolutely no changes will be required in the
current agricultural practices. The magazines are portable and can be moved should conditions
change at a later date.
No additional services will be required. Weeds and other natural plant growth will be kept cut to

the ATF regulation height of twelve (12) inches or less within the fenced magazine area. No
flammable items will stored in the same area. Thomas Beach, Chief of the Prospect Valley Fire
Department has given his consent for placement of this magazine.
Weld County Sherif s Office Bomb Squad Commander Bill Spalding will inspect the completely
installed site. All of his recommendations will be followed. The proposed fence is both his
recommendation and the desire of the property owner/farmer.
The ATF will also inspect the site and make recommendations before a license is issued and any
fireworks are stored in the magazines. All of their recommendations will be implemented.
Colorado Highway 52 and Weld County Road 87 are the closest public roads to the site.
There are vehicle trails in place on the private land that allow access to the site for farm
machinery, pick up trucks and other farm vehicles. The current owner uses them in his farming
and cattle raising business. No public access to the site is necessary. Only three (3) persons will
have access to the magazines which will be fenced within the farmer's previously fenced
materials storage area. Access to the fireworks magazines will be required approximately twenty
(20) times during a years time.
Emergency vehicles can enter the property on these farm trail roads should the need arise.
No persons will be working regular or long hours at this site. However, the site can be accessed
24 hours a day. 365 days per year without disturbing adjoining property owners.
No water, sewer, electrical or telephone service is required at the site.
Section 22-2-60 of the Weld County Code states, "The County recognizes the right to farm."
Colorado Revised Statutes, Section 35-3.5-102 "provides that an agricultural operation shall not
be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with agricultural
production".
Artistic Fire LLC. the RMPG and persons with access to the site completely accept and
appreciate that the agricultural users of the land in the State of Colorado "should not be expected
to change their long-established agricultural practices to accommodate the intrusions of urban
users into a rural area.". RMPG and Artistic Fire LLC honor all water and mineral rights as
assigned. accept that emergency services can be minimal and greatly delayed, and that access on
rough, wet and/or snow covered roads may be difficult or impossible at times. Personal self-
sufficiency and protecting the farmers' rights and livelihood are accepted as a critical
responsibilities in placing these magazines in rural Weld County.
Section 22-4-10 of the Weld County Code (Environmental Resources)
A. Impacts from proposed land uses on air, water, noise and public health.
The approximately twenty (20) additional trips to the site by vehicles to pick up or deliver
materials are the only impact on air, noise and public health. No water will be used and no waste
will add to water pollution. No waste will be generated nor left at the site. Nothing that can
enter the water shed or harm the water supply will be used at this site.
3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23
(Zoning) and the zone district in which it is located.
The Zone district of the proposed use is A (Agricultural).

Sec. 23-1-40 Purpose and Intent
"The purpose of this Chapter is to provide a unified regulatory system for land USE in the
County. This Chapter is designed to promote the health, safety, convenience, morals, order and
welfare of the present and future inhabitants of the COUNTY."
The proposed placement of portable structures and the storage of fireworks will have minimal or
no impact, either positively or negatively, on the health, safety, convenience, morals, order and
welfare of the present and future inhabitants of the COUNTY.
No new streets or roads will be required. Twenty additional trips to the site via pick up truck is
the only added burden on the existing roads.
The incidence of fires at magazines is so rare that insurance companies have no statistics for
basing rates. All ATE, Weld County Sheriffs Department and Prospect Valley Fire Department
regulations and suggestions will be heeded to further decrease the chance of any incidents.
The safety of others will be protected by following all regulations and procedures to prevent
theft.
No changes in the current convenience, morals, order and welfare of COUNTY residents can be
anticipated.
Section 23-2-200 Intent and Applicability.
A. "Uses by Special Review are USES which have been determined to be more intense or to
have a potentially greater impact than the Uses Allowed By Right in a particular zone district.
Therefore, Uses by Special Review require additional consideration to ensure that they are
established and operated in a manner that is
(I) compatible with existing and
(2) planned land USES in the NEIGHBORHOOD.
The additional consideration or regulation of Uses by Special Review
(3) is designed to protect and promote the health,
(4) safety.
(5) convenience and
(6) general welfare of the present and future residents of the COUNTY."
(1) Compatibility with existing and planned land USES in the NEIGHBORHOOD
The proposed placement of two (2) portable structures is compatible with current land use. The
current property owner/farmer protects and conserves PRIME FARMLAND by choosing this
"lot". The `lot" is on land not easily worked by modern farm machinery due to erosion. The
property owner/farmer has been using the "lot" and additional area surrounding it for storage of
fencing and irrigation materials used in farming. The materials were reorganized to make room
for the structures and surrounding fence. Access to the `lot" is controlled by the owner/farmer in
order to protect the land, crops and livestock. The impact on the farm and farmer is minor. The
impact on the "neighborhood" is negligible. Access to the "lot" is across land owned by the
current owner/farmer on currently existing farm access trails. The portable structures are much
smaller and less visible than other farm out buildings in the neighborhood. Approximately
twenty (20) visits to the structure will be required yearly. Required weekly security checks will
be performed by the owner/farmer as part of normal farm duties. Extreme caution will be taken
to protect the life style and livelihood of all who live and/or work in the neighborhood and larger
area.

(2) Compatibility with planned land USES
Should the future planned land uses become incompatible with the magazines location, they can
—1 and will be removed.
(3) Protection and promotion of health
The health of neighborhood residents will continue to be protected by no changes in land use.
The use of the "lot" for fireworks storage will not generate any waste as materials will be
transported in their original packaging (boxes) into and out of the storage area. All personal
waste related to the three (3) persons having access to the "lot" will be removed from the area
and recycled or disposed of legally. Nothing will be left that can contribute to or cause any type
of pollution. The persons having access are self sufficient in matters of providing personal
drinking water_ first aid, health plan coverage, and preparations for inclement weather. The
RMPG maintains a portable toilet in the vicinity which is also used by some of the local farmers.
(4) Protection and promotion of safety
The safety of neighborhood residents is protected by controlled access to the "lot" where the
magazine is located and by ATF approved and required double and hooded locking systems on
the structures. The property owner/farmer will visit the site weekly in the course of farming
duties to look for any problems and check that the gate/s are locked and that the structures have
not been tampered with. Access to the "lot" is controlled by a six (6) foot gated and locked fence
for which only the property owner/farmer and three (3) other persons will have keys. The fence
will be placed at the suggestion of Commander Bill Spalding of the Weld County Bomb Squad.
The Type 2 explosives magazine is a nine thousand seven hundred (9700) pound, portable (skid)
manufactured structure. It can only be moved with a crane and heavy duty flat bed trailer, so
portability is not easy for theft purposes. The steel plate magazine has two (2) hooded locking
areas. The Type 4 low explosives magazine (semitrailer) will have the wheels removed and/or be
effectively immobilized with a king pin locking device or other ATF approved method. These
are part of the numerous ATF approved and required theft deterrent features. Only three (3)
persons with approved ATF background checks will have keys to the magazine. All vegetation
will be kept cut to less than a foot within the fenced area to help prevent the spread of fire.
Thomas Beach. Chief of the Prospect Valley Fire Department has given permission to locate the
magazine in his fire district.
The RMPG has sponsored thirteen (13) fireworks safety classes attended by over four hundred
(400) fireworks display operators, crew members, fire department personnel and fireworks
hobbyists. Three (3) of these classes have been taught at the Homestead Grange. Thirty-two
(32) Weld County residents and/or fire department personnel have attended a class.
The two (2) Member Managers of Artistic Fire LIR are currently the only Colorado residents
certified to teach the Pyrotechnics Guild International (PGI) Fireworks Display Operators
Course. They volunteer their time to teach this course and others under the sponsorship of
PGI and/or RMPG.
(5) Protection and promotion of convenience and general welfare
The fireworks safety classes taught at the Homestead Grange, located at the intersection of Weld
County Road 87 and Weld County Road 10 just south of Colorado Highway 52, have been and
will continue to be convenient for Weld County residents. Having a variety of citizens trained in
the safe use of fireworks decreases the likelihood of accidents. Some of those attending the full

day classes require overnight lodging, meals, gasoline and other services or items which brings
some additional funds into the community.
4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with
surrounding land uses.
The site is surrounded by land also used for agricultural purposes, specifically, cattle grazing and
crop production. The storage of fireworks is these magazines is consistent and compatible with
surrounding land uses by not actually changing any farming procedures currently in practice. nor
preventing any agricultural activity on PRIME FARMLAND. It will not require the use of any
natural resources, create any waste, nor be unsightly. No access to property not owned by the
current owner/farmer will be necessary nor is it contemplated.
5. Describe, in detail, the following:
a. How many people will use this site?
Only three (3) persons will be able to access the portable structures (explosives
magazines). The property owner/farmer will have access to the fenced area for the
purpose of security inspection.
b. How many employees are proposed to be employed at this site?
The three persons who have access to the magazine for the purpose of delivery and pick
up of fireworks are the member/managers of Artistic Fire LLC, and the husband of a
member/manager. No one will be employed at this site on a regular basis. The land
owner/farmer is considered a landlord, not an employee. Boxes containing fireworks will
arrive on site in a pick up truck and be placed in a magazine for storage. The same boxes
will be removed from a magazine prior to a permitted class or display. The amount of
time spent at the magazine will be limited to unloading boxes from a truck into a
magazine, taking required inventories, and/or removing boxes from the magazine to load
into a truck for transport to a permitted class or display site. The magazines will be used
for fireworks storage only. Access to the storage magazine for the purpose of delivering
or picking up fireworks will be allowed by only three (3) persons. Approximately twenty
(20) deliveries or pick ups will be required yearly.
c. What are the hours of operation?
The normally scheduled hours of operation for this site are between 9 am and 6 pm
Monday through Friday, and on special occasions or holidays (e.g. the 4'h of July or New
Years Eve). Federal law requires display fireworks be stored within an ATF approved
magazine, not left in unattended trucks. Therefore, there may' be occasions when
fireworks will need to be returned to the magazines after a permitted display or late at
night.
Artistic Fire LLC operates from 9 am to 4 pm on week days. Emergency response
numbers (24 hour) for Artistic Fire LLC will be available to the property owner, Weld
County Sheriff and Prospect Valley Fire Department.
d. What type and how many structures will be erected (built) on this site?

Two (2) portable structures will be placed on this site. One is a commercially
manufactured ATF approved Type 2 portable skid explosives magazine. It measures
seven (7) feet by eight (8) feet by eight (8) feet high and weighs over 9700 pounds. It
will be placed on a concrete slab measuring eight (8) feet by eighteen (18) feet. The
second structure is a portable Type 4 magazine which is a semi-trailer that will have the
wheels removed or be immobilized by a kingpin locking device as approved by the ATF.
A fence measuring fifty-eight (58) feet by one hundred twenty (120) feet by six (6) feet in
height will surround the storage magazines.
e. What type and how many animals, if any, will be on this site? No animals will be in the
fenced storage site. Cattle do and will continue to graze outside the fenced site.
f. What kind (type. size, weight) of vehicles will access this site and how often? Pick up trucks
up to one (1) ton in size with a Gross Vehicle Weight Rating of approximately 9000
pounds will access this site approximately twenty (20) times per year. A security check is
required weekly by ATE, and approximately 20 visits for delivering and retrieving
materials are expected.
g. Who will provide fire protection to the site? Prospect Valley Fire Department
h. What is the water source on the property?
Exiting: No source of water exists on the magazine site.
Proposed: None, as no water is required for fireworks storage.
i. What is the sewage disposal system on the property?
Existing: None on this portion of the property.
Proposed: None, as none will be required. A portable toilet is maintained by RMPG in
the vicinity of the property. The property owners home bathroom will also
available.
j. If storage or warehousing is proposed, what type of items will be stored?
A maximum of 1200 pounds of 1.3g, 1.4g and/or 1.4s fireworks will be stored in the
Type 2 magazine.
A maximum of 5000 pounds of 1.3g, 1.4g and/or 1.4s will be stored in the Type 4
magazine.
6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a
landscape plan map as part of the application submittal.
No landscaping is proposed with the exception of keeping the naturally occurring vegetation cut
short (one foot or less in height) within the fenced area as a fire prevention requirement. As
grazing is currently a part of the surrounding area, it is imperative that this site remain
compatible with that use.
7. Explain any proposed reclamation procedures when termination of the Use by Special Review
activity occurs.
The storage magazines will be removed. The fence and concrete slab will be given to the

property owner/farmer for his/her use.
8. How will storm water drainage be handled on the site?
As the land surrounding the magazines. concrete pad and fence will remain in a natural state that
allows convenient, safe and environmentally neutral drainage, no additional or special drainage
method will be necessary.
9. Explain how long it will take to construct this site and when construction and landscaping is
scheduled to begin?
The proposed construction can be completed within 4 weeks, dependent on weather and on
availability and transportation of necessary materials. Fence construction is scheduled to begin
as soon as approval is received and weather permits.
10. Explain where storage and/or stockpile of wastes will occur on this site.
No storage and/or stockpile of wastes will occur on this site. Department of Transportation
regulations require that Fireworks be transported in their original shipping containers. Therefore,
all materials will leave the storage site as they entered, generating no waste. Any incidental
waste (tissues, water bottles, etc.) generated by the allowed persons will be transported off site to
be recycled or legally disposed of.
