FOR A ROPING/RODEO ARENA AND A PUBLIC AND QUASI-PUBLIC BUILDING,
INCLUDING A CHURCH, IN THE A (AGRICULTURAL) ZONE DISTRICT - CHURCH
BARN, LLC
A public hearing was conducted on June 14, 2006, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated May 25, 2006,and duly published May 31,2006, in
the Fort Lupton Press, a public hearing was conducted to consider the request of Church Barn,
LLC, for a Site Specific Development Plan and Use by Special Review Permit #1540 for a
Roping/Rodeo Arena and a Public and Quasi-Public Building, including a Church, in the
A(Agricultural)Zone District. Bruce Barker, County Attorney, made this a matter of record. Brad
Mueller, Department of Planning Services, presented a brief summary of the proposal,entered the
favorable recommendation of the Planning Commission into the record as written,and gave a brief
description of the location of the site and surrounding land uses. He stated eleven referral agencies
reviewed the proposal and responded favorably or provided comments that have been addressed
in the Conditions of Approval and Development Standards. Responding to Chair Geile, Mr.Mueller
stated the applicant has completed a Recorded Exemption,which is contingent upon approval of
this application. He further stated the Recorded Exemption did adjust the lot line to add two acres
to ensure the entire arena building is contained within the Use by Special Review Permit boundary.
Char Davis, Department of Public Health and Environment, stated the site will be serviced by the
North Weld County Water District and a septic system,which will be engineer-designed to handle
the hydraulic load for a congregation of 350 people.
Peter Schei, Department of Public Works, stated the site will be accessed from Weld County
Road 33,which is a paved, collector status road. He stated the site is also north of, and adjacent
to, Weld County Road 70. He further stated the Department of Public Works is working with the
applicant to complete a Stormwater Drainage Report, and they have already addressed the initial
traffic concerns. Mr.Schei stated an Off-Site Improvements Agreement is not required; however,
the applicant will be required to pave the entrance leading into the site parking lot, which will be

surfaced with recycled material. He further stated there will be sufficient parking, and staging of
vehicles will not be allowed on the County roads.
Robb Casseday, Casseday Creative Designs, LLC, represented the applicant and stated the
applicant hosted a bible study at his home, which grew and expanded into the arena, and later
expanded further into a church. He stated the property owner, Richard Montera, is very active in
rodeo and roping events, the arena is used for his private practice, and the church does have a
full-time pastor on staff. He further stated the use is situated entirely on Lot B of Recorded
Exemption #3961, and the parking will be used by church members and attendees of the twelve
special events allowed each year. Mr. Casseday explained the special events may include fund-
raising events, which will be permitted and catered by an outside vendor. In response to Chair
Geile, Mr.Casseday stated he understands that the applicant will be required to obtain a Temporary
Events Permit from Weld County for each of the twelve events if they exceed 350 people. He further
stated he and the applicant have reviewed and concur with the Conditions of Approval and
Development Standards. Mr. Casseday stated a dual septic system will be designed to
accommodate the number of people using facilities at the site and remain below the State level. He
stated future expansion may need to be completed as a separate structure in order to meet the
State standard for the septic design requirements. Pam Smith, Department of Public Health and
Environment,stated in order to avoid the Site Approval process through the Colorado Department
of Public Health and Environment, the site must meet various requirements. She explained the
State regulations indicate a separate roof requires a separate septic system,and she has advised
the applicant to connect the buildings with a breezeway,which would meet the State requirements,
while allowing the applicant to proceed with the system as designed. Mr. Mueller requested
Condition of Approval#1.A be moved from the stricken portion of the Draft Resolution and inserted
as a new Condition of Approval #1.D, which must be completed prior to recording the plat.
No public testimony was offered concerning this matter.
Commissioner Jerke moved to approve the request of Church Barn, LLC, for a Site Specific
Development Plan and Use by Special Review Permit#1540 fora Roping/Rodeo Arena and a Public
and Quasi-Public Building, including a Church, in the A(Agricultural)Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. His motion also included
removing Condition of Approval#1.Afrom the stricken portion of the Draft Resolution and inserting
it as a new Condition of Approval#1.D. The motion was seconded by Commissioner Long, and it
carried unanimously. There being no further discussion,the hearing was completed at 11:40 a.m.
