This project provides for a recorded exemption within the rural area of Weld County
School District Re-3J. Although recorded exemptions, individually, represent a small
increment of the total housing stock, the cumulative effect of several such approvals is
exerting a considerable negative effect upon the school district's ability to provide adequate
educational opportunities for the resulting students. Additionally,the substantial separation
of these units from other more densely populated areas increases school transportation
costs, further eroding the amount of funds that can be applied in the classroom toward
educating the students. The school district's Board of Education is opposed to approval of
additional new housing without adequate mitigation of land costs. However, in the event
that the County Commissioners decide to approve this application, Weld County School
District Re-3J respectfully requests that these exemptions be required to mitigate the costs
of providing land for school sites as explained below.
Site Issues
Based upon the district's school capacities and site size standards,the proposed exemption
would generate the need for less than one acre of land; the cash equivalent would
approximate$1,287 per single-family housing unit(see Table 1). If approved, it is
requested that this amount be paid to the school district as a cash-in-lieu of land dedication
for each new unit allowed.
Recommendations
The Board of Education iemainc very concerned about the recent trend toward accelerated
residential activity throughout the district and the ensuing enrollment that will follow, as
well as the district's physical and financial ability to serve that growth. Approval of
additional residential development without a ready and identified means of providing
appropriate infrastructure would not demonstrate good stewardship of the public trust.
As stated before, cash-in-lieu of land of S1,287 is requested for each single-family housing
unit. Without such mitigation, the district will recommend that the application be denied.

The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by
Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 77 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
'-"EQUIREMENTS:
Access: The applicant is proposing to use the existing shared access with the oil and gas company located
approximately in the middle of the proposed USR for access to the residences and airstrip. Utilize this access
point.
Primary Runway: The applicant is indicating that approximately 2500 feet of hard surface would be installed
with the remaining total of 2432 feet being installed at a later date.
Crosswind-Secondary Runways: These runways are being identified as sod runways. The off-set of all
runways is shown on the plat drawing as 100 feet from property lines.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

1. Building permits shall be obtained prior to the construction of any building including the Aircraft hanger.
2. A plan review is required for each building for which a building permit is required. Two complete sets of plans
are required when applying for each permit. Drawings for the hanger shall bear the wet stamp of a registered
architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2003 International Residential Code; 2003 International
Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code;2003 International
Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction and
to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building
height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine
compliance with offset and setback requirements. Offset and setback requirements are measured to the
farthest projection from the building.
7. Provide letter of approval from SE Weld Fire Protection District prior to new building construction.

Environmental Health Services has reviewed this proposal for a private airstrip. We
have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health and
the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed residence and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided.
8. Sewage disposal shall be by Septic System. Any septic system located on the
property must comply with all provisions of the Weld County Code, pertaining to
Individual Sewage Disposal Systems.

9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Location: Conducted at Crop Air Inc. Landing Strip, r/2 mile east of WCR 43 at WCR 72.

This study was conducted to support a USR application by William and Linda Snyder.
All sound measurements were determined using a Quest 2100 Sound Level Meter the calibration
of which was confirmed prior the determinations of the sound levels using a Quest Sound
Calibrator, Model CA-12B. The calibrator is 110 dB(A). The instrument recorded a reading of

110.4 with this calibrator.
Meteorological conditions during the measurements: 1). winds less than 5 miles/hour from the
East, and less than 5 miles/hour from the West-Northwest; 2). sky was clear with sparse high
level clouds; 3). neither rain nor snow falling at the time of the readings.
The noise levels and conditions of measurements are tabulated below:

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information
and provide comments. The comments do not address the adequacy of the water supply plan
for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a
viable water supply plan or infrastructure, the issuance of a well permit, or physical
availability of water.
The submitted proposal mentions the possibility of adjoining lots having access to the
proposed airstrip. If these lots will be a result of subdividing the subject 70.98 acres, then we
would welcome the opportunity to comment on that portion of the development. Once that
information is provided we can properly review the referral information. Please contact Eric
