RE: APPROVAL OE RECORDED EXEMPTION NO. 510 - SADIE MEYER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 2nd day of September, 1981, in the Chambers of
the Board of County Commissioners, that the division into two
i parcels of land, as shown on the plat known as Recorded Exemption
No. 510, being the property of Sadie Meyer, described as part
of the SW4, Section 30 , Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described as follows:
A tract of land being a part of Lot 4, of the
Northwest Quarter of the Southwest Quarter of
Section 30 , Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado according
to the subdivision of lands made by the St.
Louis Western Colony, said tract being
previously described in Book 1210, Page 553 ,
Weld County Records and being more particularly
described as follows:
Beginning at the West Quarter Corner of said Section 30
and considering the West line of the Southwest
Quarter of said Section 30 to bear North 00°09 '
42" East and with all other bearings contained
herein relative thereto:
Thence South 88°38 ' 51" East along the North line
of the Southwest Quarter of said Section 30 , 326 . 00
feet;
Thence South 00°09 ' 42" West, 296 . 00 feet;
Thence North 88°38 ' 48" West, 326. 00 feet to a
point on the West line of the Southwest Quarter
of said Section 30;
Thence North 00°09 ' 42" East along said West line,
296. 00 feet to the point of beginning.
Said tract of land contains 2 . 215 acres more or
less and is subject to any rights-of-way or other
easements as granted or reserved by instruments of
record or as now existing on said tract of land.

under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners finds that
this particular division of land is not within the purposes

of the Weld County Subdivision Regulations and the Board
desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant
to its authority under Colorado statutes and Section 2-1A(3)
of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
described parcel of land owned by Sadie Meyer be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" .
BE IT FURTHER RESOLVED that the Board did waive the one
acre minimum lot size on the . 79 acre Lot A, and
BE IT FURTHER RESOLVED that the Board did reserve an
additional ten feet for urban arterial needs along the north
and west sides of the property.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 2nd
day of September, A.D. , 1981.

Re: Recorded Exemption #510
Dear Commissioners:
The attached application, plat and related items are in reference to a
request by June Paul and Sadie Meyer for a recorded exemption. The
parcel of land is described as part of the SW4, Section 30, T5N, R65W
of the 6th P.M. , Weld County, Colorado. This property is located one
half mile west of the town of Evans, west of U. S. Highwy 85. The
property contains approximately two acres of land in the Agricultural
Zone District. The request is to split the property into parcels of
.79 acres and 1.4 acres.
The property was originally purchased together; however, was not described
as separate parcels. There appears to be four homes on the property at
present.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Service's staff recommends the
request be approved for the following reasons:
1. The request is in compliance with the policies of the Weld
County Comprehensive Plan in that to minimize conflicting
land uses, residential development will be encouraged to
locate adjacent to existing towns and in accordance with
the comprehensive plans and stated wishes of each community.
This parcel of land is located within the comprehensive plan
of the city of Evans. The city of Evans has no objections
to this request.
2. The request is in compliance with the agricultural policies
of the Weld County Comprehensive Plan in that developments
that utilize nonproductive agricultural land will be encouraged.
Soils on this parcel are Class IV and VI nonirrigated soils
and have a low utility for agricultural production.

3. For the reasons discussed above, the request is in compliance
with the intent clause of the recorded exemption procedure
(Section 9-2 of the Weld County Subdivision Regulations) .
Said clause states:
"The intent in establishing the recorded exemption
procedure is to provide, in accordance with the
Weld County Comprehensive Plan, a means whereby
nonproductive agricultural lands may be developed
for higher and more productive uses insofar as such
uses are compatible with surrounding agricultural
uses in areas where land divisions are proposed
(Rev. 4-17-74) ."
The residential use of this parcel is in compliance with the
intent clause of the recorded exemption procedure because
said parcel does not contain prime agricultural land and is
located within the comprehensive plan area of the City of
Evans. The residential use would appear to be compatible
with the surrounding agricultural uses.
The proposed Lot A of the recorded exemption does not meet the minimimum
lot size of one acre required under the Subdivision Regulaitons. The
Department of Planning Service's staff feels that because improvements
are already located on the property, the .79 acre Lot A is acceptable
and the Board can waive the one acre minimum. Also, the city of Evans
suggest right-of way considerations be made for the future extensions
of 23rd Avenue and 42nd Street as arterials. An additional ten feet
should be reserved for urban arterial needs along the north and west
sides of the property.
