428 RESOLUTION RE: ACTION OF THE BOARD CONCERNING PETITION AND VACATION OF A PORTION OF ROADWAYBETWEEN EAST 18TH STREET AND FERN AVENUE(WELD COUNTY ROAD 45) -ANTONIO AND ROSALIA CORRALES WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Antonio and Rosalia Corrales, 2560 East 18th Street, Greeley, Colorado 80631, a copy of said petition being attached hereto and included by reference, requesting vacation of a portion of Roadway between East 18th Street and Fern Avenue(Weld County Road 45), being more fully described as follows: Part of the SE1/4 SE1/4 of Section 10, Township 5 North, Range 65 West of the 6th P.M.,Weld County, Colorado. WHEREAS, the County Attorney's Office and Department of Public Works have recommended approval of said request since that portion of Weld County road right-of-way is not needed for the safety and welfare of the traveling public, due to the donation of other right-of-way from the petitioners to create a new alignment at the intersection, and WHEREAS,the petitioners, being the adjacent property owners on both sides of the road right-of-way, have waived written notice of this hearing, and WHEREAS,the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the Board of County Commissioners deems it advisable to deny the vacation of said portion of road right-of-way,due to concerns regarding the health, safety,and welfare of the traveling public. The roadway acts as an extension of East 18th Street. A copy of the Weld County Assessor's map which shows the roadway high lighted in yellow is enclosed. The request for the vacation has been made by Antonio and Rosalia Corrales. You may recall that the Board of County Commissioners considered a similar request from the Coralleses in July, 1998. At that time, the Board denied the request. A copy of the Board's Resolution dated July 27, 1998, denying the request and the minutes of such action are enclosed. This time the Corrales are offering to the County some property to create a better turn from Fern Avenue onto East 18th Street. A copy of a sketch showing the proposed turn is also enclosed. The Board of County Commissioners will consider the vacation at its regularly scheduled meeting at 9:00 a.m. on September 6, 2006, in the Board's First Floor Meeting Room, Weld Centennial Center Complex, 915 Tenth Street, Greeley, Colorado.
