SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL
REVIEW(USR) QUESTIONNAIRE (ANSWERS)
1. a) Raise game birds for the purpose of providing birds to hunt clubs and off site hunting events.
b)Store equipment, (trucks, trailers, skid loader, form material and diesel fuel)associated with
a concrete forming business.
2. Water:Water runoff is prevented by the perimeter fence design. Corrugated galvanized steel
buried approximately one foot in the ground will prevent water runoff to adjacent properties and
canal.
Air: Dust is minimized by the perimeter fence design. Corrugated galvanized steel approximately
four feet above the natural ground will minimize horizontal winds from discharging dust to
adjacent properties. There is smooth brome grass as a ground cover in the pen.
Noise: The greatest noise contributor is normal vehicle traffic which is normally between the
hours of 6:00 A.M. and 6:00 P.M.
Waste: Brood shed waste is removed from the property at the end of each brooding. Bird
manure from areas around feeders and waters is removed from the property. This waste
includes hay, straw and bird manure which is spread on acreage in grass owned by the
applicant.
Dead bird disposal: Dead birds are bagged and removed from the site on a daily basis or as
necessary. On a weekly basis or as necessary, these dead birds are disposed of by a
commercial service.
Wildlife: The types of birds raised in this operation are restricted by the State of Colorado
Department of Natural Resources Division of Wildlife. Any birds which may escape this
operation are compatible with species normally found in the area, see 5. e) below.
Rodents: D-Con is provided in the feed storage area as a means of rodent control.
3. The area being requested for Use by Special Review is rural therefore the relatively small game
bird operation should meet the intent of the zone district in which it is located.
4. The site is surrounded by residences, vacant land with oil well, helicopter port and irrigation ditch.
This is a rural area and therefore the relatively small game bird operation should be consistent
and compatible with surrounding land uses.
5. a) Game birds, normally 2 persons to feed, water and clean.
Equipment storage, normally 2 persons to pickup and drop off equipment.
b) None, The game birds is a father/daughter operation.
The concrete forming business employees(equipment storage)are not employed at this site.
c) Game birds and equipment storage, 6:00 A.M. to 6:00 P.M.
d) Game Birds: 2 structures, brood shed approximately 120 ft. by 11 ft. with concrete floor, 4 ft.
concrete walls with 4 ft. framed wall and sloped roof. Enclosed pen, 30 ft. by 19 ft. attached to the
East 30 ft. of the brood shed, with dirt floor, 4 ft. concrete walls with 4 ft. framed wall above
enclosed with chicken wire and sloped roof enclosed with chicken wire. Feed storage, 12 ft. by
21.5 ft frame construction set on concrete slab. Bird containment fence approximately 237 ft. by
130 ft by 120 ft. frame construction with 4 ft. Strong barn siding buried approximately 1 ft. in the
ground with 4 ft. chicken wire above and covered with bird netting. Galvanized steel Strong barn
is the preferred enclosure, by game bird hatchers and raisers, to prevent predator invasion.
Equipment Storage: concrete slab for form material.
Diesel fuel storage: lea. 500 gallon fuel tank in 10 ft. by 10 ft. by 2 ft. concrete fuel
containment wall on concrete slab, see drawing attached.

e)Game birds as authorized by Commercial Wildlife Park License 05CP888A1, attached, which
are limited to Ring-Necked Pheasant, Gambel's Quail, Scaled Quail, Bobwhite Quail, Gray
Partridge and Chukar.
Up to 4000 game birds may be kept at any given time at this site.
f)Game birds, 1 ea. Pickup or automobile two times per day to feed and water and 1 ea. trailer
mounted 500 gallon water tank normally filled on a weekly basis.
Equipment storage, up to 6 ea. tandem axel 10,000 lb. GVW trailers, (flatbed form trailers and
enclosed equipment, tool, trailers). lea. single axel 26,000 lb GVW form truck with triple axel
20,000 lb. GVW form trailer. 1 ea. skid loader with attachments, approximate weight, 7000 lb.
The above equipment is parked at this site when not in use at a job site.
g) Fire protection is provided by Fredrick Fire Protection District.
h)Water Source: Central Weld County Water District in attached letter dated June 29, 2005 can
provide up to an additional 60 gallons of water per day from the home site, Block 3, water tap for
the purpose of raising game birds and may be transported to the bird facility by water tank.
A second source of water for the game birds is a domestic well located at the home site, Block 3.
See attached well permit number 35313 issued Sept. 17, 1968.
i) Sewage Disposal: Restroom facilities are provided at the home site, Block 3,which is served
by a septic system. See attached septic permit dated August 7, 1974.
j) Game birds, feed storage as described in d) above.
Equipment storage, 500 gallon fuel tank as described in d)above.
Equipment storage, form material, truck, trailers and skid loader as described in f)above.
6. Landscaping: There is no landscaping proposed for this site. The natural lay of the land falls
approximately 18"from Northeast to Southwest.
7. Reclamation: Structures removed and seeded to grass.
8. There is no planned storm water drainage. All storm water is colhtained on site as explained in 2.
Water above.
9. Construction is complete and no landscaping is proposed for this site.
10. Waste is not stored at this site, see 2. above, Waste: and Dead bird disposal:.

I think you mean wildlife-exotic animal. Actually,they are either a household pet or livestock since all birds(Class
Avp)except poulh(which are livestock),and except raptors(order falcones)which are exotic animals,are
considered household pets. Summarized-Birds axe household pets unless they are poultry or raptors.
As 1 told you March 17,2003,
"Poultry are domestic fowl raised for feathers flesh or eggs which would include guinea fowl and
peacocks but would not include birds that are not domesticated such as pheasants"
Therefore chukars and pheasants are covered by the kennel provisions. The kennel provision would allow a larger
ntmlbcr if inspected but I think any inspection would he by COW not Ag.
Lastly,why is this even an issue?

We are divided in our office over the interpretation of a section of code. Your interpretation is the deciding
factor.
Can an applicant apply for a Use by Special Review for a commercial or industrial use in a subdivision that was
created prior to zoning regulations.
The section states-
Any use permitted as a Use by Right, an ACCESSORY USE, or a Use by Special Review in the
COMMERCIAL or industrial zone districts, provided that the property is not a Lot in an approved or
recorded
subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling
subdivisions.
PUD development proposals shall not be permitted to use the special review permit process to
develop.
