SB 125, concerning mobile home registration and taxation
Representative John McElderry, Jefferson County, spearheaded
the drive to get the 20% provision placed back in the Bill . The
Bill , with the 20% provision, passed third reading in the House
on Friday. Colorado Counties, Inc . and the Assessors Association
will be working to get the 20% deleted out of the Bill in the
Concurrence Committee or, if that is not possible, to get the
Bill killed.
SB 95, concerning the deregulation of commercial trash haulers and
placement of the authority of regulation with the boards of
county commissioners
This Bill was scheduled for Concurrence Committee on Monday,
March 24. The Bill has passed both houses. Under the provisions
of SB 95, the counties would have to give contractors six months
formal notice if they would decide to regulate hauling. Regulation
of hauling of fly ash, sludge and hazardous waste will remain under
the direction of the PUC.
SB 55, concerning hazardous waste incidents
As written, this Bill assigns the responsibility for emergency
response to a hazardous waste incident , e. g. the gas spill last
month in Larimer County, to the city or , in an unincorporated area,
to the fire protection district. If the area is not covered by a
fire protection district , the responsibility falls to the Sheriff.
All costs incurred by a fire protection district would be reimbursed
by the board of county commissioners. The commissioners would then
be in the position of trying to collect from .the owner of the
company responsible for the spill or owning the hazardous material
involved, all the costs incurred. Colorado Counties, Inc was able
to get Representative DeFilippo, Jefferson County, to agree to
carry an amendment which would delete the provision requiring the
county to reimburse the fire districts and then collect from the
materials owner and make it the responsibility of the fire protection
district to collect directly from the owner/operator.
County Rent Reimbursement for Social Services Buildings
Colorado Counties, Inc. staff has informed the Commissioners
that one of the Joint Budget Committee staff members has recommended
that the JBC reduce the amount paid to counties for office space
costs. This would affect counties such as Weld who presently lease
office space to house their Social Services programs. Todate,
the JBC has not acted on its staff ' s recommendations, but the
possibility exists that. the JBC and the Legislature could decide
to include the recommendation in the final version of the Long Bill .
