Dear Kim:
We represent Duke Energy Field Services, LP ("DEFS") with respect to its operations at the Lucerne
processing facility in Weld County. As you are aware, DEFS has recently determined that it is necessary to
expand the footprint of the plant. Therefore, DEFS is taking the facility through the amended USR process.
Details concerning the expansion have been previously submitted to the County in connection with such
application.
DEFS respectfully requests that you allow an early release of building permits for this site. DEFS
acknowledges that it may need to alter or modify its plans in the event the Board of Commissioners
determines any changes are necessary, and all construction is at its own risk, including the risk of substantial
economic loss. However, it is critical that the permits be released as soon as possible to allow DEFS to
timely complete the project. Over the past five years. I believe DEFS has consistently fulfilled each
commitment it has made to the County. Thank you again for your careful consideration, and I look forward
to hearing from you.

Duke Energy Field Services ("DEFS")formally requests that you authorize release of the Lucerne building permits as
soon as possible. DEFS acknowledges that in the course of obtaining approval of its Amended Use by Special Review
Permit for the site,modifications to the proposed improvements might be mandated. DEFS understands and agrees that
it bears the risks associated with commencement of construction prior to receipt of the final approval.
I appreciate the Planning Staff's prompt review of the application and its willingness to work with DEFS on this issue.
DEFS will continue to cooperate with the Planning Staff's requirements and recommendations throughout the review of
the Lucerne application.
