A Site Specific Development Plan and Special Review Permit for a home business (animal crematory) in the
agricultural zone district.
1. A building permit shall be obtained prior to the construction of any new building.A building permit is also required
for any change in use of an existing building.
A plan review is required for each building for which a building permit is required. Plans shall include a floor plan.
Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are
required when applying for each permit. Include a Code Analysis Data sheet provided by the Weld County Building
Department with each Building permit application.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The new building will probably be classified as B occupancy. If an existing building is convertered to an office ,
building permits will be required for the change of use of that building. Fire resistance of walls and openings,
construction requirements, maximum building height and allowable areas will be reviewed at the plan review.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and
setback requirements. Offset and setback requirements are measured to the farthest projection from the building.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards,Weld County Code, Chapter 23,Article II, Division 4, Section 23.
Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 34 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-
of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County
Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
Section Line Access: (right-of-way) (WCR 11)
r<EQUIREMENTS:
Utilize the existing access to the proposed USR. Additional parking and curb stops are being shown on the plat
drawing adjacent the barn/office structure.
Off-Street Parking: Utilize the designated parking area. The parking area including the access drive shall be
surfaced with gravel or the equivalent and shall be graded to prevent drainage problems.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably
preserve the natural character of the area and prevent property damage of the type generally attributed to run-off
rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Plat Drawing: The applicant needs to indicate on the plat drawing the section corner and identify the section line
where WCR 11 would be. In researching right-of-way for WCR 11, there is only a 30-foot right-of-way in Section 14
for approximately 1/2 mile at this location.
A Nonexclusive License Agreement is required for this USR process.

Environmental Health Services has reviewed this proposal for an animal/pet crematory.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for patrons of the
facility. Patrons shall be allowed to use the bathroom facilities located in the
residence.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the existing public water supply.(Little Thomson Water
District)
10.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

I have reviewed the submitted material pertaining to Special Review Permit for an animal/pet
crematory proposed for a home business in a private garage at 4998 Weld County Road 34 in
Weld County (Case Name: Myers, Case Number: USR-1547). The property named is within the
boundaries of the Mountain View Fire Protection District and receives service from the District.
The Fire District does not object to the request. A final inspection of the use will need to be
completed by the Fire District prior to final approval of the special review permit.
If not already provided, approved address numbers shall be placed on the property in such a
position to be plainly visible and legible from the street fronting the property. Address numbers
or letters shall contrast with their background.
