The covenants look OK, except for the following:
Although there is reference to the "master" property (Exhibit A), there is no reference to the properties subdivided
through the minor subdivision and leaving blanks for the recording information (reception number and date of
recordation).
There is no reference to whether the Colorado Common Interest Ownership Act applies, if at all.
The acknowledgement for Haung's signature is incomplete. It should say " . . . by Walter W. Huang, Manager,
Gold Stone Center, LLC, a Colorado limited liability company, Declarant."

The Department has reviewed this Final Plat application. The Department finds that the application
lacks the following information:
1. There are no plat notes on the Final Plat documents;
2. There are no primary and secondary septic envelopes on the Final Plat;
3. There are no covenants to review.
Brad forwarded me the covenants for review and has also forwarded me a copy of the Final Master
Utility Plan which has one large septic area equaling approximately 3150 square feet. There is also a
note on this Plan that the septic envelopes are conceptual only and that specific site locations will be
determined at building permit application. I advised Mr. Honn in an email dated December 22, 2005
that septic envelopes which are recorded on the final plat become legally designated easement areas
for placement of a septic system in the future. If, after the results of the percolation test the envelope
is not large enough, or if an envelope is being moved, the applicant must provide our office with an
Affidavit of Correction that has been recorded with the Weld County Clerk and Recorders office. An
envelope cannot arbitrarily be moved.
Therefore:
• The note on the Landscape Plan is misleading and should be corrected or removed altogether
• The Department recommends that the septic envelope locations on the Preliminary Plat Design
Adjustment (dated October 17, 2005) that were reviewed and approved by this Department be
the final septic locations.
• This same language preserving and/or protecting the absorption field envelopes is not found in
the development covenants.

The Sheriffs Office recommends the following improvements for this housing sub-division:
1. The Sheriffs Office requests that builders and developers designate an area by the entrance of
the sub-division in which to place a shelter for school children awaiting the school bus. This
area should also include a pull off for the school bus which enables it to safely load and unload
children out of the roadway.
2. Either mail distribution within the sub-division or a central drop off location within the sub-division
should be developed so that residents do not have to cross a county road to obtain their mail.
3. A permanent sign should be placed at the entrance to the subdivision detailing the name of the
sub-division, address, and a graphical presentation of the roadways within the subdivision.
There should be a plan developed to maintain this sign.
4. If the roadways within this sub-division are not maintained or adopted by the county, individuals
purchasing property in this sub-division should be notified that the Sheriffs Office will have
limited traffic enforcement powers.
5. A plan should be developed to maintain roadways within the sub-division especially during
inclement weather conditions for emergency vehicles.
6. The Sheriffs Office is very supportive of homeowner funded homeowner's associations. These
associations provide a contact for the Sheriffs Office and a means of maintaining common
areas.
7. If there are oil or gas production facilities within this sub-division,they need to be fenced off in
order to mitigate the potential for tampering. These facilities are known to create an attractive
nuisance for young people. Tampering not only creates a significant danger to safety but also of
environmental damage with extensive mitigation and clean-up costs.
8. The names of all streets within the sub-division should be presented to the Sheriffs Office for
approval. This will eliminate duplication of street names within the county.
9. The Sheriffs Office encourages Law Enforcement Authorities to provide additional funding for
law enforcement requirements in the future.
The Sheriffs Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as

indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Weld County Public Works Department has reviewed final plan materials and has the following development referral

Comments
❑ The Final Plat of Gold Stone Creek Minor Subdivision, by Intermill Land surveying, Inc., and Final Utility Plans - Gold Stone
Creek Minor Subdivision by Shear Engineering, submitted by the applicant are generally acceptable to Public Works.
o Public Works does not accept the interior roadway name of"Weld County Road 92.75." The interior subdivision
roadway shall not be labeled as a "County Road". The applicant shall re-label the interior roadway for the
subdivision on all final plat and engineering plan drawings.
o Sheet 5, Final Grading Plan, shall describe the abbreviation "TOW". If "TOW" relates to "FG", a consistent
abbreviation should be used to avoid confusion during construction.

Dear Mr. Schei,
This is a response to the most recent Weld County Public Works Department review comments
concerning Gold Stone Creek Minor Subdivision noted in a memorandum from you to Chris
Gathman dated July 29, 2005 prior to the reconfiguration of the proposed lots and Weld County
rights-of-way.
External Roadways:
o This development will introduce additional vehicle trips to the roadway system from the 9
proposed additional lots (approximately 85 vehicle trips to the roadway system). According
to the Gold Stone Creek Traffic Analysis (File: 0515ME01) by Matt Delich (PE 15263)
dated March 18, 2005, from Traffic & Transportation Engineering, "with the Gold Stone
Creek Development, the future average daily traffic will be well below the minimum
threshold of 200 VPD to require paving or treatment of WCR29. " Public Works is in
agreement with the findings of the report and no off-site improvements are required
R. Acknowledged
o CR 29 is classified by the County (Weld County Roadway Classification Plan June 2002) as
a local gravel road (adjacent to the proposed development) and requires a 60 foot right-of-
way. The applicant has verified the existing right-of-way and the documents creating the
right-of-way have been noted on the change of zone plat. CR 29 is under the jurisdiction and
maintenance of Weld County.
R Acknowledged
o CR 94 does not exist adjacent to this development on the section line. The applicant has
submitted evidence of vacation of right-of-way recorded with the Weld County Clerk &
Recorder.

Internal Roadways:
o The applicant shall provide a pavement design prepared by a professional engineer along
with the final plan submittal.

by Terracon, dated February 7, 2006.

❑ Public Works has reviewed the revised cul-de-sac design and deemed it acceptable with
regards projected floodways and drainage.
R Acknowledged. As requested, the lots and County rights-of-way have been relocated
outside projected floodways.
❑ The Joint Access, Utility and Drainage Easement Typical Section (Lots 5 and 6) shown on
Sheet 2 of 2 of the Intermill Land Surveying, Inc drawings and Sheet 9 of 10 on the Shear
Engineering Corporation drawings must be classified as internal roadway right-of-way and
dedicate to the public.
o The internal roadway right-of-way shall be 60 feet in width and dedicated to the public.
o The typical cross-section of interior road shall be two 13 foot gravel lanes shown on the
change of zone plat.
o The HOA covenants shall be responsible for maintenance of this segment of the internal
roadway.
R. We no longer propose the Joint Access, Utility and Drainage Easement due to the
relocation of the lots and County rights-of-way outside projected floodways.
❑ Stop signs and street name sign locations to he shown on the final roadway construction
plans have been included and duly noted with zone change submittal.

❑ Easements to be shown on the final plat (in accordance with the County standards (Sec.24-7-
60) and / or Utility Board recommendations) have been shown and duly noted with zone
change submittal.

❑ Intersection sight distance triangles at the development entrance will be required. All
landscaping within the triangles must he less than 3%2 feet in height at maturity, and noted on
the final roadway plans.
o Sight triangles should be shown in reference to lanes of on-coming traffic (see
northbound lane of WCR 29). The applicant will he required to follow AASHTO — A
Policy on Geometric Design of Highways and Streets 2004, labeling site triangle
geometry on the roadway plans.
R. Acknowledged. Sight distance triangle is shown on the plans (please refer to Sheet 2).
We used the design speed of 55 (MPH) with a line of sight distance of 1240ft.
❑ The applicant shall submit to Public Works stamped, signed and dated final plat drawings
and roadway / construction & grading plan drawings for review (with the final plan
application) and approval Construction details to be shown on final plat submittal have
been included and duly noted with zone change submittal package.

Minor Subdivision, dated June 2005, by Brian Shear, P.E. (Colorado PE#20262) with Shear
Engineering Corporation (Project No: 2136-01-04) is satisfactory.
o The report notes a flood zone (Spring Creek drainage) passing through the proposed
development site.
o The report shows calculated drainage and channel cross-sections using HEC-RAS
models.
o The report outlines design alternatives and analysis concluding on a levee system
solution.
R. Acknowledged.
o The applicant shall address building envelope locations (for Lot #4, Lot #5, Lot #7, and Lot
#6) with the final plan application materials. "In no case shall a one-hundred-year design
storm frequency cause inundation to any structure or pose a hazard "It is the Public Works
recommendation to locate all building structures out of the known flood zone. Any structures
located in close proximity to a flood zone may consider standard flood protection measures,
which may include raising the main floor elevation.
o Proposed building footprint locations have been shown to be compliant; however
minimum building envelope locations should also be included on final plat submittal.
R Acknowledged. We have relocated the proposed lots and County rights-of-way outside
projected floodways.
o The applicant shall amend the required dimensions for the box culvert under the interior
gravel roadway.
R We no longer propose the Joint Access (interior gravel roadway) due to the relocation of
the proposed lots outside projected floodways.
o A final drainage report stamped, signed and dated by a professional engineer licensed in the
State of Colorado shall he submitted with the final plan application, since a flood zone is
noted as passing through the proposed site.

o The final drainage report shall include a flood hazard review documenting any FEMA
defined floodplains or floodways. The engineer shall reference the specific map panel
number, including date. The development site shall be located on the copy of the FEMA
map.

and Water Quality Report.
o Stormwater runoff shall not adversely impact downstream storm drainage facilities.
R. Acknowledged.
o The report must include discussion of the flood zone and the impacts/implications with-
respect-to the proposed development, building structures, roadway, developed
stormwater drainage, and HOA covenants/restrictions for a major drainage way.
R. Acknowledged.
❑ The applicant shall prepare a construction detail for typical lot grading with respect to
drainage for the final plan application. Front, rear and side slopes around building
envelopes must be addressed In addition, drainage for rear and side lot line swales shall be
considered. Building envelopes must be planned to avoid storm water flows, while taking into
account adjacent drainage mitigation.
R Acknowledged. Please reference Typical Lot Grading Detail on Sheet 5, the Final
Grading Plan.
❑ Final drainage construction and erosion control plans (conforming to the drainage report)
stamped, signed and dated by a professional engineer licensed in the State of Colorado shall
be submitted with each final plan (phase) application. These plans (stormwater management
plans) may be based on Urban Drainage methodology.

1. Building permits shall be obtained prior to the construction of any building. Building permits are
required for the principle dwelling and for buildings accessory to the principle dwelling.
2. A plan review is required for each building. Two complete sets of plans are required when applying
for each permit. Each building may be required to be designed by a Colorado registered engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of
permit application. Current adopted codes include the 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code;
2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined
by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.

Dear Mr. Mueller:
The above referenced referral, concerning a nine lot residential development, was received for review and
comment by the Colorado Division of Wildlife (CDOW). The packet was reviewed and a site visit
conducted by Larry Rogstad, on behalf of the CDOW. The CDOW comments in this letter are based on
Rogstad's review, and are as follows:
I. A plan for establishing vegetative cover for the site, including abatement of noxious weeds and
roles and responsibility, should be prepared and included as part of the subdivision covenants, or
other appropriate method of notification to prospective purchasers of lots in this subdivision.
2. Until adequate vegetative cover is established for this site livestock should be maintained in
corrals, pens or paddocks, and not allowed unrestricted access to entire lots.
3. Through subdivision covenants or other appropriate means prospective residents of this
subdivision should be informed that they will be responsible for abatement or routine nuisance
wildlife issues, including but not limited to: prairie dogs, raccoon, skunks, coyote, red fox, swift
fox, miscellaneous rodents and raptors within legal guidelines established by the State of Colorado
and the United States Fish and Wildlife Service.
4. The CDOW would recommend underground routing of electrical lines to the individual lots.
Should it be necessary to route utility lines on poles, adequate steps should be taken in spacing
lines and insulating transformers and associated equipment in a manner that will preclude the
danger of electrocution for raptors and other wildlife.
5. Pet dogs should be maintained within fenced enclosures or maintained on leads as stipulated by
Weld County ordinance.
Ground cover on site currently is predominated by weedy annuals with less than 5% coverage by
perennial grasses. Soils are light and the parcel contains many rodent burrows. Songbirds including
Horned lark, Western meadowlark and Lark Bunting(the State Bird)were seen using the site and
adjacent lands. Because of abundant rodent and songbird use of pastures, CRP and dryland farms along
Spring Creek Basin, the area enjoys significant use by raptors. During Rogstad's visit he observed two
Swainson's Hawks and a pair of Northern Harriers hunting Mr. Huang's property. There is an unused
raptor nest in the single tree found on this property. A Black-tailed prairie dog colony is located on

adjacent property immediately north of Mr. Huang's parcel, but is not currently located on the parcel
under consideration.
Without adequately established ground cover, increased use of the site resulting from development and
pasturing animals in an unrestricted manner will lead to loss of cover leaving exposed soils. Long term
result would be loss of use by songbirds, rodents and raptors in the area. Exposed soils blowing onto
adjacent lands would result in loss of vegetative cover on neighboring properties which would decrease
their value and use by wildlife. Blowing sands from exposed soils would also adversely impact
neighboring landowners.
Establishing adequate ground cover on fragile soils of Northern Weld County is a time consuming
endeavor with inherent costs. By adopting a management plan for establishing ground cover, prospective
residents of the subdivision would be able to work together in accomplishing this task and would be fully
informed of their obligations and the potential costs to them. Since many people moving into rural
acreages have limited experience in managing rural landscapes, the goal should be to fully inform them of
their obligations so that they can budget for the commitment they will be taking on.

Dear Mr. Mueller:
We have reviewed the above referenced proposal to subdivide a 74.11-acre parcel into
nine single-family residential lots ranging in size from 3.9 acres to 11.5 acres. Our records
show that the State Engineer's Office previously commented on this subdivision proposal by our
letters dated July 28, 2005 and October 4, 2005.
Information from this submittal indicates that this is the Final Plat for this subdivision.
The proposed water supply is still listed as the North Weld County Water District (District),
which will provide nine taps. The District has agreed to serve the proposed site and information
from a previous referral indicates that water requirements are conditionally met.
Since no changes in the water supply for the Gold Stone Creek minor subdivision
were identified in this new submittal, the comments from our letters dated July 28, 2005 and
October 4, 2005 still apply.
