A PROFESSIONAL SERVICE COMPANY 250 ARAPAHOE AVENUE,SUITE 301 BOULDER,COLORADO 80302 TELEPHONE(303)938-1231 FACSIMILE(303)938-1526 October 18, 2005 Weld County Planning Commission 918 10th Street Greeley, CO 80631 Re: David and Beverly Heussmann USR-1523—Site Specific Development Plan/Use by Special Review Dear Commissioners: I am legal counsel to Applicants, David and Beverly Heussmann, who have applied for a Site Specific Development Plan and Use by Special Review respecting an enclosed wild game bird feeding and roosting habitat and the temporary storage of concrete forming equipment on their property, being Block 3 and part of Blocks 2 and 25 in Dream Acres subdivision, immediately west of WCR 13 between County Roads 18 and 16.75, outside the Town of Firestone. The South Platte Canal separates the property, with Blocks 2 and 3 to the north, where the family residence is located, and Block 25 to the south where the game enclosure is set and where the forming equipment is stored. Page 1 of the "Map" section included in the application materials previously submitted by Applicants presents an overview of the property configuration, and page 2 thereof is a reproduction of the plat of Dream Acres. The subdivision comprises essentially the NW/o of Section 25, Township 2 North, Range 68 West of the 6`h P.M., in unincorporated Weld County. WCR 18 is to the north, Road 11 to the west, and Road 16.75 runs east-west through the middle of the subdivision. Attached are photographs showing land use conditions on the subject property, including the game bird habitat area and the equipment storage, as well as conditions on surrounding properties in the subdivision, which include apparent contractor's shops, livestock confinement operations, and an airstrip (heliport). Applicants acquired their property by land contact, which closed in 1971. They began farming the land (raising crops) in 1967, and continue to do so today. They completed construction and moved into their residence in 1975. In 1981, the Applicants' son started a Home Business in the residence, and in 1984 that business was converted into the current concrete forming specialist operations. Applicants have at all times been active in this Home Business. EXHIBIT 2006-0645 1 S 3-- LICENSED IN COLORADO &ILLINOIS Weld County Planning Commission Heussmann—USA 1523 October 18,2005 Page 2 In 2004, the son obtained a Colorado Department of Wildlife permit and opened a Commercial Wildlife Park to raise, sell and release wild game birds. Copies of the 2004 and 2005 State permits are enclosed in the application materials. In 2004, the Applicants also conferred with the Weld County Building Department and were informed that the structures to be completed for this project, a mesh enclosed pen and a three-sided, roofed roosting barn were Agricultural Exempt Buildings, and did not require a building permit to erect. Applicants did obtain an electrical permit to run power to the roost. In May 2005, the Weld County Department of Planning Services, Compliance Division, informed Applicants that it had been advised by counsel that the game bird rearing operations involve "household pets," for which only 12 total are allowed on Applicants' three lots, and that a complaint had been made about the on-site equipment storage. A notice of zoning violation was issued, which Applicants are attempting to correct through these proceedings. Applicants filed the subject application on July 8, 2005. Weld County Planner Jacqueline Hatch has been assigned to this matter, and has been invaluably helpful to my clients in their collection and presentation of the materials in the application. Regrettably, I was not retained until last Friday, October 14, 2005, and have had only a brief opportunity to speak with Ms. Hatch. I recognize that under less exigent circumstances, the majority of issues I will address herein could have been addressed prior to a hearing before your honorable committee. Ms. Hatch has reviewed the application and preliminarily identified a deficiency in its compliance with Section 23-2-220 of the Weld County Zoning Ordinance (respecting Uses by Special Review) because the storage of the concrete forming equipment is a commercial activity that cannot be authorized —under any circumstances— in a platted subdivision in the agricultural zone district. Ms. Hatch also agrees with the County Attorney that the game bird habitat is a "kennel" which must be approved by special use review—which she does recommend approving subject to conditions. But for the exceptions discussed below, Applicants are generally in agreement with the fmdings of Ms. Hatch, and her proposed conditions of approval. Applicants have demonstrated compliance with the standards and conditions Sections 23-2-220A, 23-2-240, and 23-2-250 of the Zoning Ordinance and are entitled to the permit requested in their application. The following are comments to be made for the record: Weld County Planning Commission Heussmann—USR 1523 October 18,2005 Page 3 Concrete Forming Business First, and most significantly, upon reviewing the facts with my clients this past weekend, it is evident that the concrete forming business is "Home Business" under the County's zoning ordinance. Briefly, in 1981, Applicants' son started a custom furniture manufacturing operation in the family residence. In 1984, the family members formed an informal business organization converting the wood working operations into a specialty concrete forming business. Applicants (the parents) invested significantly in initial equipment purchases, and personally participated extensively, working out of the family residence, in scheduling/coordinating concrete forming work and delivery of concrete to job sites. In 1994, the business was formally incorporated and Applicants became officers and directors in the corporation. The corporation was recently converted to a limited liability company in June 2004, and the parents elected to not become members or managers therein. However,they are still actively, and significantly invested in the business. Throughout the company's history, the Applicants have been variously and gainfully employed by the company, performing administrative functions as well as limited operational duties and maintenance of company equipment. These activities have been conducted primarily in the family residence. The intermittent storage of company equipment (stored temporarily on-site between job sites) consists of concrete form panels stacked on one or more trailers and/or trucks, diesel fuel (utilized to coat the forms so concrete does not adhere thereto), and miscellaneous tools and curing blankets. This activity has always and consistently occurred on the property. Such a "Home Business" is specifically authorized as a use permitted by special review in the agricultural zoning district. (Weld County Code §§ 23-1-90 (definitions), and 23-3-40(O)). Respectfully, the Planning Department misplaces reliance on Subsection 23-3-40(R) of the Code to deny all commercial or industrial activity in any platted property in agricultural zone district. Such a sweeping prohibition would not be buried in an otherwise obscure subsection of the zoning code. Rather, if indeed such clause were applicable to all uses by special review in the agricultural zone, of which there are approximately 50 listed in Section 23-3-40 (all of which are essentially commercial), then clearly the "unless platted" prohibition would have proceeded the listing, or would have been otherwise incorporated into the opening grant of permission. Weld County Planning Commission Heussmann—USR 1523 October 18,2005 Page 4 Respectfully, the more reasonable interpretation of subsection(R) is that it permits other, non-listed commercial and industrial uses by right, if the agricultural property in question is not otherwise platted. Here, albeit the property is part of the Dream Acres subdivision, the use, being a Home Business, is specifically allowed by special use review - and is not one for which Applicants are seeking reliance upon the "other"clause in subsection 23-3-40(R). Furthermore, subsection 23-3-40(V) allows for uses that are "similar" to listed special review uses, as long as the use complies with the general intent of the agricultural zone district. Section 23-3-40(D) allows for equipment storage and storage tanks associated with public utilities. Respectfully, the storage of vehicles and trailers containing tools and equipment for a water, sewer, or power utility is not at all dissimilar to the storage of concrete forming equipment which has taken place on the property for over 20 years. Additionally, as noted above, this Home Business was initiated prior to the adoption of the County's zoning ordinance (on 8/25/81), and technically would qualify as a Nonconforming Use, which may be expanded or extended under the use by special review provisions of the Agriculture (A) Zone District. See, Section 23-3-40(N). Applicants are not seeking to expand or extend the use to the extent it qualifies as a Nonconforming Use, and thus, arguably, no permit is required. Again, the Applicants have reviewed and agree, in material respects, with the conditions of approval proposed by Ms. Hatch, as such conditions are applied to the Home Business equipment storage use. However, Applicants do not agree with Ms. Hatch's findings regarding compliance with Section 23-2-220.A.4 (future development), and specifically with her determination that Applicants must annex into the Town of Frederick, "if and when a future application is submitted." Annexation into Frederick is not desired by Applicants, nor should it be made a condition of their availing themselves of the rights and duties of Weld County Zoning Ordinance. Applicants will vigorously defend against any coercion requiring them to annex their property into the Town of Frederick. Game Bird Habitat Also respectfully, Applicants do not agree with the basis of fmding that the game bird rearing operation is characterized as a "kennel" use: these animals are not domesticated, and are specifically raised in a manner seeking to maintain their inherent wild character — by ensuring minimal human contact. Weld County Planning Commission Heussmann—USR 1523 October 18,2005 Page 5 A significant aspect of these operations which possibly escaped complete description in the application materials, and/or in discussions with the Planning Department, is that the clutches are brought to the property as one day-old chicks. The birds are raised to maturity, which is between 15 to 20 weeks depending upon species, and are then sold or released to the wild. The brood season is between March and August, and no birds are to remain on site beyond six months. Fully understood, the game bird operations would appear better described as "Livestock Confinement Operations" (or "LCO") with the birds characterized as "poultry" (see, Section 23- 1-90, definitions). Alternatively, because the birds are under six-months old, they might also be characterized as "Exotic Animals" rather than "Household Pets," the latter of which contains an over six month old age requirement (id.). Regardless, whether a kennel, LCO, or the keeping, raising and boarding exotic animals, all such characterizations may be authorized by special use review in the agriculture zone district. Again, Applicants have reviewed and are in material agreement with Ms. Hatch's proposed conditions of approval; however, they would propose that the use be approved under the more proper classification as an LCO. And finally, Applicants point out that their property is NOT located in the geological hazard overlay. Thank you for your consideration of the e matters. V ly yours Ju son C.
