HOGUE WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners held a public hearing on the 15th day of May, 2006, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of John and Antonette Schiestel, 5605 Pawnee Lane, Greeley, Colorado 80634, and Tracy C. and Tracy L. Hogue, 5627 Pawnee Lane, Greeley, Colorado 80634, for Resubdivision, RS #1115, for a Lot Line Adjustment in Arrowhead Subdivision, on the following described real estate, to-wit: Lots 7 and 8, Block 11 of Arrowhead Subdivision, Fourth Filing; being part of the NW1/4 of Section 27, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS,the applicants were present at said hearing, and WHEREAS,Section 24-5-30 of the Weld County Code provides standards for review of said Resubdivision, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-30.C.3 of the Weld County Code, as follows: a. The lot line revision complies with the approved recorded final plat. The purpose of this application is to move a lot line so that an existing driveway will be cited on the lot in which it services. The Conditions of Approval ensure that the existing buildings will meet all setbacks prior to recording the plat. Easements are not affected by this application. b. The application complies with the adopted rules, regulations, and ordinances currently in force and affecting the subdivision. Hogue for Resubdivision, RS#1115,for a Lot Line Adjustment,on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to Recording the Resubdivision Plat: A. The plat shall be labeled RS-1115, Resubdivision of Arrowhead Subdivision. B. The minimum offset requirements in the A(Agricultural)Zone District is three (3)feet, or one(1)foot for each three(3)feet of building height,whichever is greater. The surveyor shall verify, on the plat, that all structures meet the minimum offset requirement prior to recording the plat. C. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. D. The applicant shall submit an digital file of all drawings associated with the Resubdivision application. Acceptable CAD formats are.dwg, .dxf,and.dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Exportfiles format type is.e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). 2. Upon completion of Condition of Approval#1,the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-4-40.D.6 through D.11 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 3. The Department of Planning Services' Staff recommendation for approval is conditional upon the following: 1. Prior to Recording the Resubdivision Plat: A. The plat shall be labeled RS-1115,Resubdivision of Arrowhead Subdivision.(Department of Planning Services) B. The minimum offset requirements in the A (Agricultural)Zone District is 3 feet, or 1 foot for each 3 feet of building height, whichever is greater. Inspections of the site indicate that a business is being operated from Lot 7. The applicants shall submit an application to permit the business or remove it from the site. When the residence next door, 5627 Pawnee Ln., Greeley, CO 80634, was sold in November, 2005 the new owner had a survey done on his property because he was planning to fence his property. The results of that survey showed that his property line was about I4 feet into our already existing driveway, which the previous owner had told us originally was the property line. So, we have come up with an agreement with Tracy and Tracy Hogue the new neighbors to do a lot line change to exchange property with them in the back of our property to allow us to keep our driveway on the front of our property. We have enclosed our measurements to allow for that lot line change and would like to proceed as soon as possible.
