Reference is made to Resolution dated August 25, 1965
relative to the abandonment of a portion of County Road 108.
Please be advised that this Department is not in agree-
ment with same as the portion of the County Road mentioned in
the Resolution is a part of the right of way for-Project
F 006-1(31), Eaton-Ault, which is needed for the construction
of a County road approach and frontage road.
Therefore, we request that the Resolution be rescinded.

In the event it is necessary to remove any right-of-way fence, that the posts on
either side of the entrance be securely braced before the fence is cut to prevent any slacking
of the remaining fence. That all posts and wire removed be turned over to the maintenceman of
the State Highway Department. That you or any future owner of the property will never request
the State Highway Department to erect another fence at this particular location.
That you install an g 9 in diameter by <,: ° in length, either new corrugated
metal or concrete lock joint culvert on the present grade line of the borrow pit. Said entrance
to be constructed of soil or gravel, and in such a manner that it will permit all water falling
on the adjoining highway surface to drain away from the highway and into the existing right-of-way
limits. That you keep the drainage functioning properly at all times. No soil to be taken from
the State right-of-way limits, and that this entrance be graveled immediately upon completion.
That all labor and material be furnished by you with no expense to the State Highway
Department, and that this work be completed within 30 days from the above date. If it is not,
this perm:;.t will be void. No work allowed on Saturday afternoons or Sundays, That the traveling
public be protected during this installation with the proper warning signs and signals, both day
and night, and that you assume full responsibility for all damages that may result from same.
That you agree to remove from this entrance any ridge of snow that may be necessary
for the State Highway Department, in its snow removal operations, to leave along the edge of the
roadway section. That in the event any changes are made to this highway in the future that would
necessitate the removal of this installation, you will do so at your own expense upon written
request from the Highway Department. The State Highway Department will not be responsible for
any damage they may cause in the maintenance of the highway to installations placed inside the
State right—of—way.
That no business be conducted in the State right-of-way and that no advertising signs
be erected in the State right-of-way limits.

By the Commission:
- --On August 7, 1951, -Weld- County; Colorado;- by its County Attorney,-
Robert G. Smith, ,Esq., filed an application with the Commission seeking
authority to relocate and reconstruct a county road crossing over the track
and right-ofmwey of the Union Pacific Railroad Company about one mile north
of Eaton, Colorado.
The.matter was set for hearing on August 21, 1951, at ten o'clock
A. M., in the Comad.ssion's Hearing Room, 330 State Office Building, Denver,
Colorado, and, after appropriate notice to all interested parties, including
the owners of adjacent property, was there heard by the Commission, and
taken under advisement.
At the hearing, testimony of Mr. Carl Magnuson, Chairman of the
Board of-County C67missioners, disolbsed that the crossing in—question is on
a county road and is particularly hazardous because of limited vision and
steep approach evade from the south. The county road was constructed along

the noP.thsouth section line between Sac. 30, T. 7 N., R. 65 N., and Sec. 25,
T. 7 N., R. 66 U. The math line of the Union Pacific Railroad Company be-
tween Denver and Cheyenne, 'Warning, crosses the County road in a northwest-
erly direction, and the road crossing is therefore on a long diagonal.
Attached to the instant application and accepted at the hearing
as &hibit No. 1 is a nap kith. profile sections to show the situation at
the crossing.
To overcome the inherent hazards of the present crossing, it
the proposal of Weld County to construct a new crossing a sufficient dis- •
tance northwesterly to secure a location that affords better vision, elimi-
nates the steep grade and will allow the crossing over the tracks and en-
trance to the adjacent highway to \be made at a right angle rather than in
the existing angular manner. A proposed crossing location is also shown on
the above mentioned &hibit No. 1. •
According to the instant application and furthertsstimony at the
hearing, the daily rail traffic over this crossing consists of nine scheduled
trains and various extra or unscheduled trains that may travel between 20 and
60 miles per hour. Vehicular usage consists of passenger cars, and a heavy
volume of truck traffic during the sugar beet and potato shipping seasons.
During the school term, this crossing is also used for school bus travel.
. The files of the Commission indicate that the adjacent property
owner, Mr. Don Anderson, has given his consent to the proposed work. Letters
from The Mountain States Telephone and Telegraph Company and the Home Light &
Power Company indicate the consent of these utilities and a willingness to
co-operate in any plant rearrangements that may be required.
At the time of the hearing, it was shown that the Railroad Company
had no objection to the proposed work, but, in the absence of any contract or
agreement with the County, no positive commitments could be made relative to
_ _ the_expense_involved_in raising telegraph wires, changing fence line and
cattle guards, and necessary grading and drainage on the railroad right-of-

work. agreement s:as offered by Counsel for the Railroad Compesy.
Othdr testimony by Mr. C. D. Voris, Division Engineer in this
territory for the Railroad Company, indicated.that the geneval crossing re-
location as proposed as quite feasible. It would be possible to provide a
greater degree of safety to both railroad passengers and the motoring public
by the !Improvement of sight distances and elimination of the steep approach
grade. Also; in view of a limited accident history at this crossing, it was
established that 'the present protection of crossbucks and advance warning
signs would be adequate at the more advantageous location as proposed in
this application.
The files of the Commission further indicate that, as a result of
on the site conferences between Mr. Magnuson and Mr. Voris, there has been
negotiated a working agreement relative to the details that were incomplete
• at the time of the hearing. In a letter to the Comission by Mr. E. G.
Knowles and dated October 30, 1951, the general provisions of this agreement
are outlined as follows: .
Veld County will, (a) Do all the grading,
(b) Furnish and install a proper
culvert pipe,
(c) Bear one-half of the expense of •
raising the two wire lines. _ - -
Union Pacific will,' (a) . Relocate the cattle guards and
crossing structure,
(b) Do all the fence work,
(c) Bear one-half of the expense of
raising the two wire lines.
Upon further inquiry by the Commission's Staff; it was ascertained
from Mr. Voris that the Engineering Department of the Union Pacific would
survey and lay out the 'proposed crossing site as follows: The center line
of the new crossing -to be approatmately 470 feet northwesterly along the
Union Pacific tracks from the center line of the present crossing. The
Crossing will be staked for 24 feet of width and will be asphalt surfaced
_ `betkeea the ₹°ails-and-to the-ends-of the-ties.--Railroad -forces will also -- - - - - - -
relocate the_crossbucks and provide flagging protection for_.the grading _ _
operations adjacent to the trackage.

No adj€:cent pro_oerty owners appeared at the hearing, and the
files of the Commission do not show any objections to the proposed con—
struction. •
FINDINGS
THE COMMISSION FINDS:
1. That the above Statement and /Ekhibit No. 1 be made a part
hereof'by reference.
2. That public convenience and necessity require that the
authority sought should be granted.
ORDER
THE COMMISSION ORDERS:
That Weld County be, and it is hereby authorized, to close an
existing highway-rail crossing as located on the north-south section line
between Sec. 30, T. 7 N., R. 65 W. and Sec. 25, T. 7 N., R. 66 F7., approxi-
mately one mile north of Eaton, Colorado.
That, in lieu thereof, a new crossing be constructed, the center
line of which shall be located approximately 470 feet northwesterly along
the railroad track from the center line of the present crossing.
That the distribution_of expense and- the work-to be done ahnll be
as outlined in the previous Statement and working agreement.
That Weld County provide and install standard reflectorized rail—
road advance warning signs and a STOP sign at the entrance to U. S. Highway
No. 85.
That all protection devices, including reflectorized crossbucks,
shall be installed in conformance with the Bulletin of the Association of
American Railroads' Joint Committee on Grade Crossing Protection.
That continuing maintenance of the crossing and crossbucks shall
be by the Union Pacific Railroad Company.
