HomeMy WebLinkAbout20061332.tiff HEARING CERTIFICATION DOCKET NO. 2006-30 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1545 FOR AN OIL AND GAS PRODUCTION FACILITY(SEVEN OIL WELLS AND ONE TANK BATTERY) IN THE I-1 (INDUSTRIAL) ZONE DISTRICT - GREAT WESTERN OIL AND GAS COMPANY A public hearing was conducted on May 3, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Cyndy Giauque Planning Department representative, Sheri Lockman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated April 14,2006,and duly published April 19,2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Great Western Oil and Gas Company for a Site Specific Development Plan and Use by Special Review Permit #1545 for an Oil and Gas Production Facility (seven oil wells and one tank battery) in the I-1 (Industrial)Zone District. Cyndy Giauque,Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She gave a brief description of the location of the site and surrounding land uses. She stated 11 referral agencies reviewed the proposal,ten responded favorably or provided comments that have been addressed in the Conditions of Approval and Development Standards,and staff has received no correspondence from the surrounding property owners. Ms. Lockman submitted correspondence from Health staff, marked Exhibit E, regarding the Emissions Permit application, and stated Condition of Approval #1.A can be deleted. Char Davis,Department of Public Health and Environment,stated there will be no employees at the site,other than the crews initially required for drilling,during which time the applicant will be required to provide bottled water and portable toilets. In response to Chair Geile,Ms.Davis stated Condition of Approval#1.A has been met. She explained the State does not require an Emissions Permit until production starts. Donald Carroll, Department of Public Works, stated the site will be accessed from Weld County Road 66, also known as Eastman Park Drive, which has been annexed by the Town of Windsor. He further stated the access goes through the Eastman Kodak property, adjacent to the site. 2006-1332 P Oh PL, PW/ L/ ©55/37 /T[- OL HEARING CERTIFICATION - GREAT WESTERN OIL AND GAS COMPANY(USR#1545) PAGE 2 Bill Crews,Crews and Zeren,LLC,represented the applicant and stated Condition of Approval#1.A has been addressed, and regarding Condition of Approval #1.B, the Windsor-Severance Fire Protection District does not have permit requirements. Ms. Lockman stated Condition of Approval #1.6 can be deleted if the Board feels the applicants testimony is sufficient evidence. Responding to ChairGeile,Mr.Crews stated he and the applicant have reviewed and concur with the Conditions of Approval and Development Standards,as proposed and modified. In response to Commissioner Jerke, Mr. Crews stated six of the seven wells will be directionally drilled. Responding to Commissioner Masden, Mr. Crews stated the wells will be on regular 40-acre drilling sites. No public testimony was offered concerning this matter. Commissioner Jerke moved to delete Conditions of Approval#1.A and #1.B. Commissioner Long seconded the motion,which carried unanimously. Commissioner Jerke moved to approve the request of Great Western Oil and Gas Company for a Site Specific Development Plan and Use by Special Review Permit #1545 for an Oil and Gas Production Facility(seven oil wells and one tank battery)in the I-1 (Industrial)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. His motion included the deletion of Conditions of Approval #1.A and #1.6. The motion was seconded by Commissioner Long, and it carried unanimously.
