HomeMy WebLinkAbout20063005.tiff HEARING CERTIFICATION DOCKET NO. 2006-74 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1570 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING OIL AND GAS SUPPORT SERVICES AND A PRE-MANUFACTURED OFFICE BUILDING, IN THE A (AGRICULTURAL) ZONE DISTRICT - PETRO-CANADA RESOURCES (USA) INC. A public hearing was conducted on November 15, 2006, at 10:00 a.m.,with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jenny Luna Assistant County Attorney, Cyndy Giauque Planning Department representative, Kim Ogle Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 27, 2006, and duly published November 1, 2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Petro-Canada Resources (USA) Inc., for a Site Specific Development Plan and Use by Special Review Permit#1570 for a Mineral Resource Development Facility,including Oil and Gas Support Services and a Pre-Manufactured Office Building, in the A (Agricultural) Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record, and advised the applicant's representative,Todd Hodges,Todd Hodges Design, LLC,that he has the option of continuing this matter to a date when the full Board will be present. However,if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr. Hodges indicated he would like to proceed today. Kim Ogle, Department of Planning Services,presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the site is approximately 105 acres in size,and is located south of Weld County Road 46,and east of Weld County Road 49. He stated the surrounding properties are agricultural in nature, and several Use by Special Review Permits for oil and gas operations exist within the immediate vicinity of the site. He further stated the site does not lay within the three-mile referral area for any municipality,the Central Weld County Water District provides water service to the site,and the site will be serviced by Individual Sewage Disposal Systems. Mr.Ogle stated the primary access is on Weld County Road 46, which is a gravel road, and the interior roads will be gravel. He stated two telephone inquiries were received regarding the matter;however,no objections have been received from surrounding property owners. 2006-3005 PL1862 (1 : GL /%0/ /it //-a 7—O HEARING CERTIFICATION - PETRO-CANADA RESOURCES (USA) INC. (USR#1570) PAGE 2 Char Davis, Department of Public Health and Environment, stated the site will be serviced by a water tap from the Central Weld County Water District, and installation of an engineer designed septic system will be required for the pre-manufactured office building. She requested the deletion of Condition of Approval#1.D, since the requirement has been satisfied. She also requested the deletion of Development Standard #27, since it is a duplicate of Development Standard #12. Don Carroll, Department of Public Works, stated Weld County Road 49 borders the western edge of the property,and access is from Weld County Road 46,along the northern portion of the property. He stated an existing pre-manufactured home will be relocated to the facility, and the facility will require an additional 80 vehicle trips per day;therefore,the applicant must complete dust abatement procedures. In response to Chair Geile, Mr. Carroll stated a Condition of Approval addresses the Dust Abatement requirements. In response to Commissioner Vaad, Ms. Davis stated all commercial septic systems must be designed by an engineer,and a residential septic system would require an engineered system if the soils test indicated for poor percolation rates. Mr. Hodges stated it has been a pleasure working with staff, and the process has gone very smoothly. In response to Chair Geile, he stated he and the applicant have reviewed, and concur with, the Conditions of Approval and Development Standards as proposed and modified. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Petro-Canada Resources(USA)Inc., for a Site Specific Development Plan and Use by Special Review Permit#1570 for a Mineral Resource Development Facility, including Oil and Gas Support Services and a Pre-manufactured Office Building, in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included the deletion of Condition of Approval #1.D and Development Standard#27. The motion was seconded by Commissioner Masden,and it carried unanimously.
