Section 29-1-301 and 29-1-302 have been amended to prohibit the levying of a
greater amount of property tax revenue than was levied in the preceding year plus
seven (7) percent without approval from the Division of Local Government or by the
electorate of the taxing district. Section 29-1-302 restricts increases due to
reappraisal and exempts assessed valuations attributable to annexations, inclusions,
improvements or new construction.
Copy of your budget must be rendered to, and accepted by the Division of Local
Governmane before we can extend your levy for the current year's tax roll.

Re-4 at a special meeting on November 8, 1982, passed the following resolution
per State Statute 22-50-198:
"Shall the board of education of Weld County School District Re-4 be granted
authority to increase the authorized revenue base per pupil of attendance entitle-
ment from the amount of $2,546.99, which is the maximum allowable without
approval of the registered electors, to $2,679.21. If the increase is approved

Dear Mr. Sandau:
I am pleased to inform you that the Division of Local Government will
approve your request to exceed the statutory property tax revenue limit
for 1982. This is a reversal of our previous denial of your request, as
stated in my letter of October 14, 1982.
An excess levy of 3.288 mills can be certified for this year only. This
will earn your jurisdiction an excess revenue of $48,482 and a total of
$106,369 in property tax revenue, based upon your current assessed valuation.
$40,400 of this excess dollar amount can be certified for three years, the
mill levy in subsequent years being determined by that years valuation for
assessment. This excess revenue is approved for the specific purpose of
purchase of a replacement pumper truck, and will not accrue to the base
revenue for the purpose of the "7%" calculation in future years.
The balance of this excess revenue, totaling $8,088 will be added to your
base revenue for the purpose of the "7%" calculation in subsequent years.

Dear Mr. Lieuallen:
We have reviewed your request for approval to exceed the statutory property
tax revenue limit. I am sorry to inform you that this Division will not
approve your request at this time.
The specific reasons for this denial are: (1 ) The magnitude of the increase
is considerably beyond the percentage which our guidelines define as reason-
able, and (2) the need for the additional tanker truck is not clearly established,
nor is substantial local support clearly documented.
Please be advised that you may conduct a special election for the submission
of the question of an increased levy to the electors in your jurisdiction.
The law provides that, should you decide to hold such an election, the
deadline for certification of your mill levy is extended to December 15.
Notice should be given to the Board of County Commissioners and this Division
of your intent to do so.

A RESOLUTION APPROPRIATING SUMS OF MONEY TO THE VARIOUS FUNDS
AND SPENDING AGENCIES, IN THE AMOUNTS AND FOR THE PURPOSES AS
SET FORTH BELOW, FOR THE BRIGHTON FIRE PROTECTION DISTRICT,
COLORADO, FOR THE 1983 BUDGET YEAR.
WHEREAS, the Board of Directors of the Brighton Fire
Protection District has adopted the annual budget in accordance
with the Local Government Budget Law on October 13, 1982 ; and
WHEREAS, the Board of Directors of the Brighton Fire
Protection District has made provisions therein for revenue in
an amount equal to or greater than the total proposed expendi-
tures as set forth in said budget; and
WHEREAS, it is not only required by law, but also necessary
to appropriate the revenues provided in the budget to and for
the purposes described below, so as not to impair the operations
of the District.
NOW, THEREFORE, BE IT RESOLVED/ORDAINED BY THE BOARD OF

A RESOLUTION LEVYING GENERAL PROPERTY TAXES FOR THE YEAR 1983 ,
TO HELP DEFRAY THE COSTS OF GOVERNMENT FOR THE BRIGHTON FIRE
PROTECTION DISTRICT, COLORADO, FOR THE 1983 BUDGET YEAR.
WHEREAS, the Board of Directors of the Brighton Fire
Protection District has adopted the annual budget in accordance
with the Local Government Budget Law, on October 13, 1982 ; and
WHEREAS, the amount of money necessary to balance the
budget for general operating expenses is $ 390 , 606 . 00 ; and
WHEREAS, the amount of money necessary to balance the
budget for bonds and interest is $ 161,300. 00 ; and
WHEREAS, the amount of money necessary to balance the
budget for Firemen's Pension is $ 52 ,927 . 00 ; and
WHEREAS, the 1982 valuation for assessment for the Brighton
Fire Protection District as certified by the County Assessors

operating expenses of the Brighton Fire Protection District
during the 1983 budget year, there is hereby levied a tax of

ment of all taxable property within the District for the year
1983 .
Section 2 . That for the purpose of meeting all bonds and
interest of the Brighton Fire Protection District during the
1983 budget year, there is hereby levied a tax of 1. 524 mills
upon each dollar of the total valuation for assessment of all
taxable property within the District for the year 1983.
Section 3 . That for the purpose of meeting all Firemen' s
Pension payments of the Brighton Fire Protection District

WHEREAS , the Charter of the City of Greeley , Colorado, as
well as the laws of the state of Colorado , require the City Council to
establ ish the tax levy so as to fix the rate of taxation by the City of

WHEREAS , the City Council has considered a proposed budget ,

Dear Commissioners :
Pursuant to Colorado Revised Statutes 1973 , Section
37-41-120 , the directors of the Henrylyn Irrigation District by
resolution certified to you the amount of money required to meet
the maintenance , operating and current expenses for the ensuing
fiscal year; certified the total number of acres included within
the district ; and certified the levy necessary to obtain the
budget amount.
The resolution of the Henrylyn Irrigation District dated
October 4 , 1982 , contained an inadvertent error. At the time the
resolution was prepared, the Board of Directors failed to
subtract . 20 acres of land recently excluded from the district .
Therefore, the certified assessment was long the sum of $2 . 57 .
To indicate the correct situation, an original and two
duplicates of a resolution dated October 20 , 1982 , is attached
hereto. The October 20, 1982 resolution correctly certified the
total number of acres of land subject to assessment within the
Henrylyn Irrigation District as 32 ,850 . 61 acres and correctly
certified the amount of money required to meet the maintenance ,
operating and current expenses for the ensuing fiscal year to be
equivalent to $423 , 772 . 87 . The levy necessarily assessed against
each acre to obtain the budgeted amount remains the same at
$12 . 90 per acre.
If you have, pursuant to C .R. S 1973 , Section 37-41-123 ,
already fixed the rate of levy against the land included within
the Henrylyn Irrigation District ; I , as attorney for the Henrylyn
Irrigation District , request that you amend your proceedings in
accordance with the correct resolution submitted herewith and
dated October 20, 1982 . If you have not fixed the rate of levy
then I request that you accept the resolution dated October 20,
1982 , as superceding and replacing the resolution dated October
4, 1982 .

if there are further procedures necessary to clarify the error, I
will be pleased to respond immediately.

We have reviewed your request for approval to exceed the statutory property
tax revenue limit. I am sorry to inform you that this Division will not
approve your request at this time.
The specific reason for this denial is that the amount of increase is simply
too great for us to approve. Increases of this magnitude are an issue which
should, in my opinion, be a local decision between your Board and the electors.
Please be advised that you may conduct a special election for the submission
of the question of an increased levy to the electors in your jurisdiction.
The law provides that, should you decide to hold such an election, the dead-
line for certification of your mill levy is extended to December 15th. Notice
should be given to the Board of County Commissioners and this Division of your
intent to do so.

Dear Mr. Owen:
I am pleased to inform you that the Division of Local Government will approve
your request to exceed the statutory property tax revenue limit for 1982.
An excess levy of 5.025 mills can be certified for this year only. This will
earn your jurisdiction an excess amount of $89,716, and a total of $476,320 in
property tax revenue, based upon your current assessed valuation. This excess
dollar amount can be certified for the years 1982 and 1983, the mill levy in
subsequent years being determined by that years valuation for assessment. This
excess revenue is approved for the specific purpose of defraying expenses of
the purchase of firefighting equipment and will not accrue to the base revenue
for the purpose of the "7%" calculation in future years although the request
was for six years. The magnitude of that approval would have represented a
substantial burden on the taxpayers in the District. For this reason, we are
approving the excess in two years only, and expect the question of the re-
maining four years' excess to be put to the voters at the Districts' regular
election in May, 1984.

Dear Mr. Rodenberger:
I am pleased to inform you that the Division of Local Government will
approve your request to exceed the statutory property tax revenue limit
for 1982.
An excess levy of 8 mills can be certified for this year only. This will
earn your jurisdiction a total of $821,073 in 1982 property tax revenue,
based upon your current assessed valuation. $75,000 of excess dollars can
be certified for the years 1983, 1984 and 1985, the mill levy in those years
being determined by that year's valuation for assessment. This excess revenue
is approved for the specific purpose of defraying expenses involved in relo-
cating station #6, and will not accrue to the base revenue for the purpose of
the "7%" calculation in future years.

TO HELP DEFRAY THE COSTS OF GOVERNMENT FOR THE TOWN OF WINDSOR,
COLORADO, FOR THE 1983 BUDGET YEAR.
WHEREAS , the Board of Trustees of the Town of Windsor has
adopted the annual budget in accordance with the Local Govern-
ment Law, on September 2? , 1982 ; and
WHEREAS , the amount of money necessary to balance the General
Fund budget for general operating expenses is $211 , 000. 00
WHEREAS , the amount of money necessary to balance the budget
for debt retirement expenses is none; and
WHEREAS, the 1983 valuation for assessment for the Town of
Windsor, as certified by the County Assessor, is $12 ,654 ,650. 00.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF WINDSOR, COLORADO, AS FOLLOWS :
Section 1. That , for the purpose of meeting all general oper-
ating expenses of the Town of Windsor during the 1983 budget
year, there is hereby levied a tax of 16 .688 mills upon each
dollar of the total valuation for assessment of all taxable
property within the Town for the year 1983 .
Section 2. That , for the purpose of meeting all debt retire-
ment expenses of the Town of Windsor during the 1983 budget year,
there is hereby levied a tax of no mills upon each dollar of the
total valuation for assessment of all taxable property within
the Town for the year 1983.
Section 3. That , the Town Clerk is hereby authorized and
directed to immediately certify to the County Commissioners of
Weld County , Colorado, the mill levies for the Town of Windsor
as hereinabove determined and set .
