RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT #776 -
SUCKLA FARMS, INC., C/O JACOR BROADCASTING OF COLORADO, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated July 8, 1987,the Board did approve the request of Suckla
Farms, Inc., for Use by Special Review Permit#776, for a Radio Transmission Tower in the A
(Agricultural) Zone District, on the following described real estate, to-wit:
Part of the NW1/4 of Section 33, Township 2 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Jacor
Broadcasting of Colorado, Inc., 4695 South Monaco Street, Denver, Colorado 80237, to vacate a
portion of said Use by Special Review Permit#776, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to
Section 23-2-260.D of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#776 be, and hereby is, partially vacated,
with the abovementioned condition.

SUBJECT: Partial Vacation of USR-776
The Department of Planning Services has received the attached letter dated December 1, 2006
requesting the partial vacation of USR-776. Jacor Broadcasting of Colorado, INC. is
requesting that USR-776 for an 1,190 foot high radio transmission tower and equipment
building be partially vacated. The acreage being vacated out of USR-776 will be incorporated
into USR-1555 for A Site Specific Development Plan and a Special Review Permit for a Major
Facility (two 1.5 Million Gallon Water Storage Tanks) of a Public Utility or Public Agency in the
A (Agricultural) Zone District.

Legal Description: Pt. NW4 Section 33, Township 2 North, Range 67 West of the 6th P.M.
Weld County, Colorado
Location: East of and adjacent to County Road 17 and south of County Road 16
USR 776: The Use by Special Review permit is for an 1,190 foot high radio
transmission tower and equipment building as submitted in the
application materials on file in the Department of Planning Services and
subject to the Development Standards stated herein. (Approved by the
Board of County Commissioners on 7/8/87)
USR 1555: A Site Specific Development Plan and a Special Review Permit for a
Major Facility (two 1.5 Million Gallon Water Storage Tanks) of a Public
Utility or Public Agency in the A (Agricultural) Zone District (Approved by
Planning Commission on 5/16/06)

Should the Board of County Commissioners choose to approve the request for a partial
vacation of USR-776, Planning Staff recommends that a revised Partial Vacation USR plat of
USR-776 be recorded in compliance with Section 23-2-200.G of the Weld County Code.

Re: USR-1555
Dear Ms. Martin:
We are writing concerning the real property subject to USR-776, and owned by JACOR
BROADCASTING OF COLORADO, INC. (the surviving entity by merger with Tsunami
Communications, Inc pursuant to the Agreement and Plan of Merger dated December 14, 2001).
As you may be aware, the Town of Firestone has leased a portion of that property for
purposes of installing a water tank. In order to reflect the reduced area subject to the USR, we
have submitted to the County USR-1555. As part of the conditions of approval for our USR-
1555, Tsunami Communications requests the Partial Vacation of USR-776. The Partial Vacation
will allow for the continued use of our operations (Area A) and will allow for the additional uses
permitted under USR-1555 (Area B and Area C). Accompanying this letter is the USR Partial
Vacation plat which we have had prepared and are also providing as part of the conditions of
approval for USR-1555. A signed Mylar of this plat will be provided for recording after the
Board of County Commissioners has acted on the Partial Vacation.
We request this Partial Vacation be placed on the agenda for action by the Weld County
Board of Commissioners at their next available meeting.
