RESOLUTION
RE: ACTION OF THE BOARD CONCERNING CHANGE OF ZONE, PZ #1103, FROM
A (AGRICULTURAL) ZONE DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT)
ZONE DISTRICT - LIBERTY PROPERTIES, LLLP / KENNETH AND CONNIE
WILLIAMSON
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,a public hearing was held on the 18th day of October, 2006, at 10:00 a.m.for
the purpose of hearing the application of Liberty Properties, LLLP/Kenneth and Connie Williamson,
4068 Camelot Circle, Longmont, Colorado, 80504, requesting a Change of Zone from the
A (Agricultural)Zone District to the PUD (Planned Unit Development) Zone District for 131 lots
with R-1 (Low Density Residential)uses, a 23-acre lot with C-1 (Neighborhood Commercial)and
C-2(General Commercial)uses,and approximately 30 acres common open space,fora parcel of
land located on the following described real estate, to-wit:
NW1/4 of Section 21, Township 3 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing the Board deemed it advisable to continue the matter to
December 13, 2006, at 10:00 a.m., to allow adequate time for a Work Session to discuss the
location of the 1-25 Parallel Arterial Roadway and its impacts on the layout of the proposal, and
WHEREAS, on December 13, 2006, the applicant was represented by Ken Merritt,
Landmark Engineering, Ltd.,3521 West Eisenhower Boulevard, Loveland,Colorado,80537,and
WHEREAS,the Board of County Commissioners heard all the testimony and statements
of those present,studied the request of the applicant and the recommendation of the Weld County
Planning Commission, and
WHEREAS, pursuant to the Weld County Home Rule Charter,Article 3, Section 3-13, the
concurrence of three of the members of the Board is required to approve a Resolution, and
WHEREAS, the motion to approve Change of Zone #1103 received only two votes and
therefore failed; and the effect of the failure to obtain a majority vote is a denial of the motion.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the application of Liberty Properties, LLLP/Kenneth and Connie Williamson,
do Landmark Engineering, Ltd.,fora Change of Zone from the A(Agricultural)Zone District to the
PUD(Planned Unit Development)Zone District for 131 lots with R-1 (Low Density Residential)uses,
a 23-acre lot with C-1 (Neighborhood Commercial) and C-2 (General Commercial) uses, and
approximately 30 acres common open space, on the above referenced parcel of land, be, and
hereby is, denied.
