the Court to correct its Findings of Fact, Conclusions of Law and
Order entered by the Court on the 7th day of November, 1984 , in
the manner and form as attached hereto as Exhibit "A" .
A:; grounds therefor, the parties state as follows :
1 . That the preliminary draft of the final order as
prepared by the Defendants incorrectly recited the warranty deed
from Nellie E. Powars to Weld County School District No. 23 was
dated August 23, 1893, when in truth and fact, the date of the
warranty deed was August 23, 1898.
2. That in its preliminary draft-, the Defendants failed to
show the Plaintiffs were the sole heirs of Nellie E. Powars as
alleged and shown in the Complaint of the Plaintiffs.
3. That upon entering the corrected Findings of Fact,
Conclusions of Law and Order as requested by the parties to this
action, the parties have stipulated a full and complete
settlement of the above action.

-A Order.
BACKGROUND
This case deals with certain restrictive language contained in a warranty
deed and the subsequent compliance with that restrictive language by the grantee
therein. On August 23, 1898, Nellie E. Powers conveyed by warranty deed to
Weld County School District No. 23, several acres of land in Weld County to be used
"as a site for a school house and other school purposes and if diverted from such

use, shall revert to the grann hereof, her heirs or assigns." In February, 1982,
the plaintiffs, who are t-e sole heirs of Nellie E. Powars, brought this action
under Rule 105 to quiet f le :;n their names against the School District and all others
claiming an interest in tt a property.
FINDINGS OF FACT
1. The Court finds that on August 23, 1898, Nellie E. Powars conveyed
by warranty deed recorded April 27, 1899, in Book 162, Page 106, Weld County
Records, to Weld County School District No. 23, several acres of land in Weld •
County to be used "as a site for a school house and other school purposes and if
diverted from such use, shall revert to the grantor hereof, her heirs or assigns."
2. The Court finds that the plaintiffs are the sole heirs of Nellie E.
Powars and that School District No. 23 was the predecessor of Weld County School
District RE-8.
3. The Court finds that the property, in fact, was used for a school
building site until the mid-1960's, at which time the School District was con-
solidated into Weld County School District RE-8, which included the area that
encompassed the property in question. From the time of the consolidation of the
School District forward, the school building was used variously for adult educa-
tion classes, special education classes and migrant worker classes. The building
more recently has been used to store books, furniture and sports equipment for
the consolidated School District.
4. On December 17, 1974, the School District, by special warranty
deed recorded February 10, 1975 in Book 7/2, Reception No. 1653778, Weld
County Records, granted to the defendant ii ulton Irrigating Ditch Company, the
South 106 feet of the property.
5. The Court finds that the plaintiffs, who are the sole heirs of Nellie
• E. Powars, seek to quiet title against the School District and the Fulton Irrigating
• Ditch Company and all other persons claiming an interest in the property.
6. The Court finds that based on its visit to and inspection of the
school house, the property is currently used by the School District for storage.
The Court further finds that from the testimony that the School District fully in-
tends to continue using the building for storage and that the future use of the
building for some type of special class purposes cannot be ruled out.
7. Finally, the Court finds that there was no intent by the School Dis-
trict to abandon the property.

CONCLUSIONS
From the evidence presented and the law cited by the parties, the
Court concludes:
1. That Nellie E. Powars by warranty deed dated August 23, 1898,
recorded April 27, 1899, in Book 162, Page 106, Weld County Records, granted
the Weld County School District a parcel of land located in Weld County for use
as a site for a school house and other school purposes and if diverted from such
• use, to revert to the grantor, her heirs or assigns, who are plaintiffs in this
action, the property more fully described as follows:
Commencing at a point two hundred sixty (260) feet north
of the Southeast corner of the Southeast Quarter (SE 1/4)
• of Section Nineteen (19), Township One (1) North, Range
sty-si:: (66) West of the 6th P.M.; thence West 209 feet-
thence South along the East line of sa.d Section 19, 418 feet
F.' to the place of beginning. Containing 2 acres more or less.
2. That the restrictive language contained in the deed to the School
District created a right of entry for condition broken and not a possibility of
rev- ter. See Cole v. Colorado Springs Company, 152 Colo. 162, 381 P.2d 13
(196's); Colorado Practice, King. §509; Independent Con negational Society v.
Davenport Me. , 391 A.2d 1137 (1978).
3. That the law abhors a forfeiture and that there is a strong public
policy against forfeitures of interests in real property. See Cole v. Colorado
Springs Company , supra; Union Colony of Colorado v. Gallie, 104 Colo. 46,
88 P.2d 120 (1939); Brown v. State, 5 Colo. 496 (1881); C.R.S. 1973 §38-34-101.
4. That restrictive language in a deed must be construed in favor of
the grantee rather than the grantor. See Kanarado Mining and Development
Company v. Sutton, 36 Colo. App. 375, 539 P.2d 1325 (1975); Clevenger v.

Continental Oil Company, 149 Colo. 417, 369 P.2d 550 (1962).
5. That the property has been and continues to be used for school pur-
` poses and the restrictive or limiting language in the deed has not been activated.
6. That the defendants have not abandoned the property.
